ON
DESIGNATION OF STANDARD PRICES FOR
THE CALCULATION OF FOREST RESOURCE ROYALTY PROVISION (PSDH) THE MINISTER OF INDUSTRY AND TRADE,
Considering :
a. that the standard prices for the calculation of PSDH was valid until June 30, 2002, and in the framework of the enforcement of Government Regulation No. 59/1998 on tariff on types of non-taxable state revenues applicable in the department of forestry and plantations, which has been amended by government regulation No. 74/1999, it is necessary to designate standard prices for the calculation of PSDH for wood and rattan; b. that for that purpose, a decree of the minister of trade and industry needs to be issued. In view of :
1. Government Regulation No. 51/1998 on PSDH (Statute Book of 1998 No. 84, Supplement to Statute Book No. 3759);
2. Government Regulation No. 59/1998 on tariff of types of non-tax state revenues applicable within the department of forestry and plantations PSDH (Statute Book of 1998 No. 94, Supplement to Statute Book No. 3767) which has been amended by Government Regulation No. 74/1999 (Statute Book of 1999 No. 137);
3. Presidential Decree No. 260/1997 on affirmation of duty and responsibility of the Minister of Trade in the field of international commerce;
4. Presidential Decree No. 228/M/2001 on the establishment of the mutual cooperation cabinet;
5. Presidential Decree No. 102/2001 on departmental status, duty, function, authority, organizational structure, and work procedures;
6. Presidential Decree No. 109/2001 on organizational units and duty of departmental echelon I;
7. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on organizations and work procedures of the department of trade and industry.
Observing :
Resolutions of the inter-departmental meeting with related associations on June 20, and 25, 2002. DECIDES :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON DESIGNATION OF STANDARD PRICES FOR THE CALCULATION OF FOREST RESOURCE PROVISON (PSDH).
Article 1
1. PSDH or is a levy imposed as a substitute of the intrinsic value of the produce of the state-owned forests;
2. The amount of the standard prices for the calculation of PSDH shall be based upon market value, which constitutes the average value of forest produce applicable in the domestic and international markets.
Article 2
1. Standard prices for the calculation of PSDH for wood and rattan shall be designated as the one specified in the attachment to this decree;
2. The standard prices, as set forth in paragraph (1), shall be valid from July 1st, 2002 to December 31st, 2002.
Article 3
This decree comes into full force and effect from July 1, 2002.
For public cognizance, I order the announcement of this decree by placing it in the state gazette of the Republic of Indonesia.
