relatif aux credits ｦｲ｡ｮｾｩｳ＠ destines au developpement ecoromique de l' INIX>NESIE
Le Gouvernement de la Republique de l'Indonesie et le Gouvernement de la Republique ｆｲ｡ｮｾ｡ｩｳ･＠ sont convenus des dispositions suivantes en vue de faci-liter l'effort de developperrent econanique de l'Indonesie.
ARI'ICLE 1.
a) Une sonme globale de TROIS CENT QUATRE VINGI'S MILLIONS DE FRANCS (300 MF) est mise
a
la disposition du Gouvernement indonesien sous forne de credits, pour financer l'achat par l'Indonesie d'equiperrents lourds et deservices ｦｲ｡ｮｾ｡ｩｳＬ＠ y corrpris le fret.
ARI'ICLE 2.
Les CX)ncours financiers prevus
a
l'article 1 ci-dessus SJnt cnnstitues d'un pret du Tresor ｦｲ｡ｮｾ｡ｩｳ＠ au Ministere des Finances, agissant pour le corrpte de l'Etat indonesien, d'un rrontant de CENI' CINQUANTE DEUX MILLICNS DE FRANCS(152 MF) et de credits bancaires garantis par le Tresor ｦｲ｡ｮｾ｡ｩｳ＠ d'un montant de
DEUX CENI' VINGT HUIT MILLIONS IE FRANCS (228 MF) destines
a
financerl'irrputation d'equipements lourds et de services selon les modalites definies
a
l'article 4 du present texte.ARTICLE 3.
Les prets du Tresor et les credits bancaires ga.rantis qui les accompa-gnent seront utilises dans les proportions de 40 % et 60 % respectivernent pour chaque CX)ntrat irrpute au titre de l'article 2 du present protocole.
Les droits de tirage sur le pret du Tresor seront done egaux
a
40 % de la valeur des biens CX)rrmandes en France au titre de dlacun de ces CX)ntrats.ARTICLE 4.
Les rroyens de financement prevus
a
l'article 2 ci-dessus sont affectes en totalite au financernent d'importations d'equipements lourds et de services tels qu'ils sont definis par la liste des priorites du plan de develofPeirtent economique de l'Indonesie.ARI'ICLE 5.
Les prets du Tresor ｦｲ｡ｮｾ｡ｩｳ＠ rrentionnes
a
l'article 2 ci-dessus sont amortissables en trente-trois (33) ans par sernestrialites egales et successivesa
conpter de la date du premier tirage, et p:>rtent ｩｮｴ･ｮｾｴｳ＠ au taux de 2 % l'an. Ils corrportent un differe d'amortissement de treize (13) ans.Les interets sur le solde dG. sont payables
a
la fin de chaque semestre. Une convention d'application entre le Ministere des Finances, agissant pour le corrpte du Gouvernement indonesien et le Credit National, agissant p:>ur le CX)mpte du Gouvernernent ｦｲ｡ｮｾ｡ｩｳＬ＠ precisera les modalites d'utilisation et de rembour-sement de ces prets.5c>
ARTICLE 6.
Les credits bancaires garantis rrentionnes
a
l'article 2 ci-dessus sont arrortissables en dix (10) ans par sernestrialites egales et successives, la premiere echeant six nois apres l'achevernent du projet cu la (les) livraison(s) des equipern;:!nts, ou la fin des prestations de services, selcn les stipulations de chaque oontrat cx:mnercial ou de la oonvention de credit bancaire. Leur taux d'interet est le taux usuel des creditsa
l'exportaticn auquel s'ajoute le cout de l'assurance-credit de la OJFACE.Un accord financier entre le Ministere des Finances et les etablisse-ments bancaires ｦｲ｡ｮｾ｡ｩｳ＠ precisera, si necessaire, les m::xlalites de l'utilisa-tion et du rerrboursement de ces credits tancaires garantis.
ARTICLE 7.
Chaque cornnande fait l'objet entre le fournisseur ｦｲ｡ｮｾｩｳ＠ et l'ache-teur indonesien d'un contrat dont l'admissicn sur le present protocole doit etre prealablernent approuvee

La date limite de passation des oontrats finances en application du present protocole est fixee au 31 decembre 1984. La date lirnite applicable aux contrats restant

signer au titre des credits derneurant disponibles sur les precedents protocoles gouvernementaux est fixee au 31 decembre 1984.Aucun tirage ne pourra etre aff ectue sur les prets du Tresor ouverts par le present protocole apres le 31 decembre 1985.
ARTICLE 9.
Les articles 5 et 7 du present protocole ne s'appliquent pas au
f inancement des equipements et services fran¢s relatifs
a
la constructicn de l'aeroport de CENG KARENG qui reste regi p:tr les articles 5 et 7 du protocole du ler decembre 1900.ARI'ICLE 10.
Le present protocole entre en vigueur

FINANCIAL ffiREEMENr
The Govern.rrent of the Republic of Indonesia and the Governement of the Republic of France, with a view to facilitate the econanic rehabilitatien and
developement efforts of Indonesia, agreed en following provisions.
ARI'ICLE 1.
a) A total arrrnmt of 'IHREE HUNDRED AND FORI'Y MILLION FRAOCS (380 MF) is put at the disposal of the Indonesian Government in the fonu of credits to
finance the purchase of French heavy a:}Uiprrents and services, including freight,
by Indonesia.
ARI'ICLE 2.
The credits set in article 1 consist of a loan from the French Treasury to the Ministry of Finance, acting en the account of the Indonesian Government, of ONE HUNDRED AND FIFTY '!ID MIILION FRANCS (152 MF) and ranker's credits guaranteed by the French Treasury caning to a total arrount of 'IW) HUNDRED AND
TWENI'Y EIGHT MILLION FRAOCS (228 MF) to finance the import of heavy EqUipments and services in accordance with the provisions rrentioned in article 4of the present agreement.
ARTICLE 3.
'Ihe loan from the Treasury and the guaranteed bilker's credits which are extended in conjunction with the fonner will
re
respectively in theproportion of 40 % and 60 % for each oontract allocated l.mder article 2 of the present protocol.
'Ihe rights of drawing of the Treasury loan will thus
re
EqUal to 40 % of the value of the goods requirement ordered in France for each contract.ARI'ICLE 4.
The means of financing provided for in article 2 are ea.marked in totality for the financing of the irrportation of heavy equipments and services as rrentioned in the priority list of econcmic developrrent plan of Indonesia.
ARI'ICLE 5.
'Ihe loans from the French Treasury rrentioned in article 2 are repayable in thirty three (33) years 'by equal and successive semi-annual instalments
which are calculated from the date of the first drawing and bear an interest rate of 2 % per annum, allo.ving a grace periode of thirteen years ( 13) •
'Ihe interest due on the ba.lance are repayable at the end of each half-year. An agreement en the implementaticn between the Ministry of Finance acting on account of the Indonesian Governement and the Credit National, acting on behalf of the French Government will stipulate the terns and conditions of utiliza tion and repayment of these loans.

ARI'ICLE 6.
The guaranteed banker's credits rrentioned in article 2 will be redee-rred in twenty (20) equal and succesive semi-annual instalments, the first one
falling due six nonths after the o::rnpletion of the project or the delivery(ies) of equipnents, or the final delivery of the services, stipulatErl in each comner-cial o::>ntract or in the banker's credit agreement. 'Ihe rate of interest is the current export rate to which is addErl the cost of credit insurance of COFACE.
A financial agreerrent between the Ministry of Finance and the French Institution will stipulate, if necessary, the rrodalities of utilization and reimbursement of these guaranteed banker's credit.
ARI'ICLE 7.
Each order is subject to a o::>ntract between the french supplier and the Indonesian buyer, the qualification of wich into the present agreement requires a prior approval of the o::>rrpetent French and Indonesian authorities.
French franc will be usErl as currency of account arrl currency of payment for the o::>ntract.
A down-payment equal to at least 10 % of the anount of the o::>ntract will be paid when placing the order by drawing under the Treasury loan. The balance will be settled between the order and its receipt in o::>nfonnity with the terns and conditions of each contract, by jointly and proportionally utilizing the :rreans of financing foreseen in article 2 in accordance with the nodalities of article 3 of the present agreement.
ARI'ICLE 8.
The ultimate date for the signing of contracts to be financed under the present agreement is set at december 31, 1984.
'Ihe ultimate date for the signing of the o::>ntracts relating to the credits remaining available under the fonner governmental agreements is set at decernber 31, 1984.
No drawing nay be rrade in the Treasury loans allocated by the present protocol after December 31, 1985.
ARI'ICLE 9.
'Ihe articles 5 and 7 of the present protocol do mt apply to the
financing of the french equipnents arrl services relating to the construction of
the CEr:;K; KARENG airport, v.hich o::>ntinues to be ruled by the articles 5 and 7 of
the protocol of december 1, 1900 •
ARI'ICLE 10.
The present agreement enters into force a i the date of its signing.
IN WITNESS THERRro, the undersigned, duly authorised for this purpose by their respective Governments, have signed this Agreement and have affixed hereto their seal.
