TAHUN 1974 ANTARA KEDUA NEGARA DI LAUT ANDAMAN DAN SAMUDERA HINDIA

PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK INDIA, MENGINGAT Persetujuan antara Republik Indonesia dan

Republik India tentang penetapan garis-garis batas landas kontinen antara kedua negara yang ditandatangani pada tanggal 8 Agustus 1974, mulai berlaku sejak saat pertukaran piagam-piagam

pengesahan di New Delhi tanggal 17 Desember 1974,

BERHASRAT untuk memperpanjang batas antara kedua Negara ini di Laut Andaman dan Samudera Hindia di daerah-daerah yang tidak dicakup dalam Persetujuan tersebut diatas,

DAN MEMUTUSKAN, sebagai tetangga-tetangga yang baik dan di dalam semangat kerjasama dan persahabatan, untuk menetapkan secara tetap batas-batas dari daerah-daerah yang disebut dalam ayat terdahulu dimana masing-masing Pemerintah akan menjalankan hak-hak berdaulat mereka,

TELAH MENYETUJUI HAL-HAL SEBAGAI BERIKUT Pasal 1

Di daerah Laut Andaman :

Batas dasar laut antara Indonesia dan India di Laut Andaman adalah garis-garis lurus yang menghubungkan titik-titik 1 dan K, titik-titik K dan N, dan titik-titik N dan O.

Pas al 3

1. Koordinat- koordinat dari titik-titik yang diperinci dalam pasal-pasal 1 dan 2 adalah koordinat-koordinat geografi dan garis-garis lurus yang menghubungkannya ditunjukkan diatas peta yang dilampirkan sebagai larnpiran "B" dari Persetujuan ini.

2. Letak sebenarnya dari titik-titik ini di laut dan garis-garis yang menghubungkannya akan ditentukan dengan suatu cara yang disetujui bersama oleh pejabat-pejabat berwenang dari kedua

Pemerintah.

3. Yang dimaksud sebagai "pejabat-pejabat yang berwenang" dalam ayat 2 pasal ini, bagi Republik Indonesia adalah Ketua Badan Koordinasi Survey dan Pemetaan Nasional dan setiap orang yang

dikuasakannya dan bagi Republik India adalah Ketua Hidrografi Pemerintah India dan setiap orang yang dikuasakannya.

Pasal 4

Pemerintah Republik Indonesia dan Pemerintah Republik India mengakui dan mernbenarkan hak - hak berdaulat masing-masing Pemerintah di dan atas daerah-daerah dasar laut tersebut,

termasuk tanah di bawahnya di dalam batas-batas yang ditentukan berdasarkan Persetujuan ini.

Pasal 5

Apabila terdapat suatu struktur atau lapangan minyak burni atau gas alam, atau deposit mineral lainnya jenis apapun yang melintasi garis batas tersebut dalam pasal-pasal 1 dan 2, maka kedua Pemerintah akan saling menyampaikan semua keterangan

mengenai hal ini dan akan berusaha mencapai persetujuan tentang cara yang paling efektip untuk mengeksploitasi struktur, lapangan atau deposit dan keuntungan-keuntungan yang diperoleh dari

･ｫｳｰｬｾｳｩ＠ tersebut, akan dibagi secara adil.

Pasal 6

Setiap perselisihan antara kedua Pemerintah mengenai penafsiran atau pelaksanaan persetujuan ini akan diselesaikan secara damai melalui konsultasi atau perundingan.

Pasal 7

Persetujuan ini akan disyahkan sesuai dengan syarat-syarat ketatanegaraan Negara masing-masing. Persetujuan ini akan mulai berlaku pada tanggal pertukaran Piagam Pengesyahan yang akan dilakukan secepat mungkin di Jakarta.

UNTUK MEMBUKTIKANNYA, yang bertanda tangan di bawah ini, yang dikuasakan untuk maksud ini oleh Pemerintah masing-masing, telah menanda tangani Persetujuan ini.

DIBUAT DALAM RANGKAP DUA di New Delhi pada tanggal

14 Januari 1977, dalam bahasa Indonesia, Hindi dan Inggeris. Dalam hal timbul perbedaan antara naskah-naskah tersebut, maka naskah dalam bahasa Inggeris akan menentukan.

AGREEMENT BE'I'WEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE REPUBLIC OF INDIA ON THE EXTENSION OF THE 1974 CONTINENTAL SHELF BOUNDARY BETWEEN THE TWO COUNTRIES IN

THE ANDAMAN SEA AND THE INDIAN OCEAN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF INDIA

RECALLING the Agreement between the Republic of Indonesia and the Republic of India relating to the Delimitation of the Continental Shelf Boundary between the two countries signed on 8th August, 1974 which, upon the exchange of instruments of ratification in New Delhi on 17th December, 1974 entered into force with effect' from that date,

DESIRING TO extend this boundary between the two countries in the Andaman Sea and the Indian Ocean in areas not covered by the aforementioned Agreement,

AND RESOLVING, as good neighbours and in a spirit of co-operation and friendship, to settle permanently the limits of the areas referred to in the preceding paragraph within

which the respective Governments shall exercise sovereign rights,

HAVE AGREED AS FOLLOWS

Article 1

In the area of the Andaman Sea :

The boundary of the seabed between Indonesia and India

in the Andaman Sea is the straight lines connecting points 1 and K, points K and N, and points N and

Article 3

1. The co-ordinates of the points specified in Articles 1 and 2 are geographical co-ordinates and the straight lines joining them are indicated on the chart attached as Annexure "B" to this Agreement.

2. The actual location of these points at sea and of the lines joining them shall be determined by a method to be

mutually agreed upon by the competent authorities of the two Governments.

3 . For the purpose of paragraph 2 of this Article, the "competent authorities" in relation to the Republic of

Indonesia shall be the Ketua Badan Koordinasi Survey dan Pemetaan Nasional (Chief of the Co-ordinating Body for

National Survey and Mapping) and includes any person authorized by him, and in relation to the Republic of India shall be the Chief Hydrographer to the Government of Indi a and includes any person authorized by him.

Article 4

The Government of the Republic of Indonesia and the

Government of the Republic of India recognise and acknowledge the sovereign rights of the respective Governments in and over the seabed areas, including the subsoil thereof, within the

established by this Agreement.

-Article 5

If any single geological petroleum or natural gas structure or field, or other mineral deposit of whatever character, extends across the boundary line referred to in Articles 1 and 2, the two Governments shall communicate to each other all information in this regard and shall seek to reach agreement as to the manner in which the structure, field or deposit will be most effectively exploited and the benefits arising from such exploitation will be equitably shared.

Article 6

Any dispute between the two Governments relating to the interpretation or implementation of this Agreement shall be settled peacefully by consultation or negotiation.

Article 7

This Agreement shall be ratified in accordance with the constitutional requirements of each country. It shall enter into force on the date of the exchange of the Instruments of Ratification which will take place at Jakarta as soon as possible .

IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments, have signed this Agreement.

DONE IN DUPLICATE at New Delhi on the 14th January, 1977 in the Indonesian, Hindi and English languages. In the event of any conflict between the texts , the English text shall prevail.

ANDAMAN SEA AND THE INDIAN OCEAN

It was on the 14th Janua ·y 1977, that the Agreement between Indonesia and India relating to the Extension of the 1974 Continental Shelf Boundary between our two Countries in the Andaman Sea and the Indian Ocean was signed in the beautiful capital of Your country, New Delhi .

The conclusi on of the Agreement delimiting national jurisdiction of our two countries in the area reflects the existing friendly and good-neighbourly relations between the two countries and contributes to the further strengthening of those relations.

am happy, Excellency, that our two countries ha ve now ratified the

Agreement, thus enabling us today to exchange the Instruments of Ratification, making the Agreement enter into force as of today.

Allow me, Excellency, on this memorable occasion, to express, on behalf of my Government, our sincere appreciation for the spirit of goodwill, cooperation, and understanding that manifest themselves during the negotiations leading to the conclusion of the Agreement.

The entry into force of this Agreement as of today will certainly strengthen friendly relations between our two countries, facilitate our e fforts to increase the prosperity of our Peoples, and contribute to the mai ntenance and promotion of peace and stab ii ity in this region .

Whereas the Agreement between the Government of the

Republic of India and the Government of the Republic of Indonesia

on the Extension of the

1974

Continental Shelf Boundary between

the two countries in the Andaman Sea and the Indian Ocean was

signed at New Delhi on

1977

by the representatives of

the two Governments duly authorised for that purpose;

in accordance with J-.rticle 7 of the aforesaid

Agreement, it is subject to ratification and shall entGr into

force on the date of exchange of the Instruments of Ratification;

THEREFORE , the two Parties having ratified the

said Agreement pursuant to the above requirement, have today

exchanged their Instruments of Ratification through the undersigned,

acting on behalf of their respective Governments, so that the

Agreement shall enter into force with effect from the date of

this document.
