APPROVAL FOR THE HOLDING OF
TRADE EXHIBITIONS, CONVENTIONS AND/OR SEMINARS
THE MINISTER OF INDUSTRY AND TRADE
Considering :
a. that to bring about much benefit and keep order in the holding of trade exhibitions, conventions and/or seminars in increase the marketing and use of local goods and/or services and the marketing of foreign goods in the domestic market, it is deemed necessary to stipulate provisions on the granting of approval for the holding of trade exhibitions, conventions and/or seminars;
b. that for this purpose, it is necessary to issue a decree of the Minister of Industry and Trade.
In view of :
1. Trade Ordinance of 1934 (Statute Book of 1938 No. 86);
2. Law No. 1/1987 on the Chamber of Commerce and Industry (Statute Book of 1987 No. 8, Supplement to Statute Book No. 3346);
3. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612); 4. Law No. 22/1999 on regional administration (Statute Book of 1999 No. 60, Supplement to Statute Book No.
3839);
5. Government Regulation No. 36/1977 on the conclusion of foreign business activities in the trade field (Statute Book of 1977 No. 60, Supplement to Statute Book No. 3313) as has been several times amended the latest by Government Regulation No. 15/1998 (Statute Book of 1998 No. 25, Supplement to Statute Book No. 3734);
6. Government Regulation No. 25/2000 on the authority of the central government and the authority of provincial administrations as autonomous regional administrations (Statute Book of 2000 No. 54, Supplement to Statute Book No. 3952);
7. Presidential Decree No. 18/2000 on the guidelines for the procurement of goods/services for the government agencies;
8. Presidential Decree No. 234/M/2000 on the formation of the Cabinet for the 1999-2004 period, which has been several times amended the latest by Presidential Decree No. 177/M/2001;
9. Presidential Decree No. 165/2000 on the position, task, function, authority, organizational structure and working system of ministries as has been amended the latest by Presidential Decree No. 37/2001;
10.Presidential Decree No. 177/2000 on the organizational structure and task of ministries as has been several times amended the latest by Presidential Decree No. 58/2001;
11.Decree of the Minister of Industry and Trade No. 402/MPP/Kep/11/1997 on the licensing of the representative offices of foreign trade companies;
12.Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 regarding Organization and Working Procedures of the Ministry of Industry and Trade.

DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON APPROVAL FOR THE HOLDING OF TRADE EXHIBITIONS, CONVENTIONS AND/OR SEMINARS
Article 1
Hereinafter referred to as :
1. Trade exhibitions shall be the activity designed to display, demonstrate, and/or introduce goods and/or services in a certain place within a certain period of time to the public with the aim of increasing sales, expanding market and seeking trade partners.
2. Trade convention and/or seminar shall be the meeting of a group of people to discuss problems related to the holding of a trade exhibition.
3. The organizer of a trade exhibition, trade convention and/or seminar, hereinafter referred to as the organizer, shall be an individual company, corporate body, representative office of a foreign trade company and/or state agency, either at a central or regional level, that organize(s) and manage(s) a trade exhibition, trade convention and/or seminar.
4. International trade exhibition, convention and/or seminar shall be a trade exhibition, convention and/or seminar participated in by participants and/or displaying goods/services from several countries, including those organized by representative offices of foreign trade companies in Indonesia.
5. National trade exhibition, convention and/or seminar shall be a trade exhibition, convention and/or seminar participants and/or displaying goods/services from several provinces.
6. Local trade exhibition, convention and/or seminar shall be a trade exhibition, convention and/or seminar participated in by participants and/or displaying goods/services from one or several regencies/municipalities within a province.
7. Association shall be an association of organizer legally set up and registered at the Ministry of Industry and Trade and/or at the provincial government and/or regencial/municipal government and listed as a member of the Chamber of Commerce and Industry, either at the central or regional level.
8. Minister shall be the minister responsible for the trade sector.
CHAPTER II
THE HOLDING OF TRADE EXHIBITIONS, CONVENTION AND/OR SEMINARS
Article 2
Trade exhibitions, conventions and/or seminars shall be classified into : 1. International trade exhibition, convention and/or seminar,
2. National trade exhibition, convention and/or seminar, 3. Local trade exhibition, convention and/or seminar,
Article 3
(1) Any organizer of an international trade exhibition, convention and/or seminar shall secure a permit from the Minister
(2) The Minister shall delegate the authority as referred to in paragraph (1) to the Director General of Domestic Trade to issue the permit for the holding of an international trade exhibition, convention and/or seminar
Any organizer of a national trade exhibition, convention and/or seminar shall secure a permit from the Governor in this case the agency responsible for the trade sector.
Article 5
Any organizer of a local trade exhibition, convention and/or seminar shall secure a permit from the Regent/Mayor in this case the agency responsible for the trade sector.
Article 6
The permit for the holding of a trade exhibition, convention and/or seminar as referred to in Articles 3, 4 and 5 shall be valid for 1 (one) occasion only.
Article 7
The trade exhibition, convention and/or seminar as referred to in Article 2 shall only be organized by an organizer that has already secure a permit.
Article 8
(1) A foreign company having no representative office can organize an international trade exhibition, convention and/or seminar, provided it cooperates with an organizer.
(2) The representative office of a foreign trade company can organize an international trade exhibition, convention and/or seminar, provided the event is designed to promote its own products or the products of a group of business entities it represents.
(3) The organizer as referred to in paragraph (1) shall hold a letter of appointment/agreement from the concerned foreign company validated by the Head/Official of the Indonesian Representative office in the country of the concerned company.
CHAPTER III
THE PROCEDURE FOR GRANTING PERMITS
Article 9
(1) Any application for a permit to organize an international trade exhibition, convention and/or seminar as referred to in Article 3 shall be filed no later than 40 (forty) working days before the event is organized and the application shall be complete with :
a. a photocopy of trade permit (SIUP) or exhibition/convention service permit issued by the Capital Investment Coordinating Board (BKPM) or permit of representative office of foreign trade company and corporate registry number (TDP), except if the organizer is a government agency;
b. a certificate of time and venue issued by the management of the building and/or place; c. a list of participants' countries of origin and/or foreign speakers;
d. types of goods/services to be displayed; e. exhibition profile; and
f. company profile
(2) Any application for a permit to organize a national or local trade exhibition, convention and/or seminar as referred to in Article 4 or 5 shall be filed no later than 30 (thirty) working days before the event is organized and the application shall be complete with :
b. a certificate of time and venue issued by the management of the building and/or place; c. a list of participants' and/or speakers from other regions;
d. types of goods/services to be displayed; e. exhibition profile; and
f. company profile.
Article 10
The permit as referred to in Articles 3, 4 and 5 shall not be granted if in the same location and/or the nearby location at the same time a similar event is held and the types of good/services displayed and/or the title/theme are the same as those of the permit issued previously.
Article 11
(1) The permit to organize a trade exhibition, convention and/or seminar as referred to in Articles 3, 4 and 5 shall be issued no later than 7 (seven) working days after the requirements as referred to in Article 9 have been received in a complete and correct manner.
(2) The application for a permit to hold a trade exhibition, convention and/or seminar as referred to in Articles 3, 4 and 5 shall be rejected no later than 7 (seven) working days after the receipt date of the application if the requirements as referred to in Article 9 are not complete and/or correct.
(3) A copy of the permit as referred to in paragraph (1) shall be addressed to the relevant agency.
Article 12
The private organizer of a government-funded trade exhibition, convention and/or seminar shall secure a permit from the Association.
Article 13
In the event of a change in the title/theme and/or time/schedule as well as place after the issuance of a permit, the organizer shall notify the said change along with the reasons for the change to the official issuing the permit no later than 10 (ten) working days before the event is organized.
CHAPTER IV OBLIGATIONS
Article 14
Organizers shall be put under an obligation to : 1. Comply with the existing rules
2. Reexport foreign goods displayed in accordance with the existing provisions
3. Convey a report on the holding of a trade exhibition, convention and/or seminar to the official issuing the permit no later than 14 (fourteen) working days after the holding of the trade exhibition, convention and/or seminar
4. Convey a report on the trade exhibition, convention and/or seminar that can not be organized to the official issuing the permit no later than 14 (fourteen) working days after the schedule date of the abortive event.
CHAPTER V SANCTION
(1) The organizer of a trade exhibition, convention and/or seminar as referred to in Article 3, 4 and 5 that has no permit shall be liable to sanction in accordance with the existing rules and shall have its business.
(2) The business permit as referred to in paragraph (1) shall be revoked by the official issuing it.
Article 16
(1) If the organizer violates the provisions in Article 14 or if the holding of a trade exhibition, convention and/or seminar deviates from the origin purpose and aim, the relevant organizer shall miss a chance of securing a permit to organize the next trade exhibition, convention and/or seminar.
(2) The organizer violating the provisions in Article 14 points 1 and 2 shall be liable to sanction from the authority agency within the framework of the existing rules.
CHAPTER VI
TRANSITIONAL PROVISIONS
Article 17
The permit obtained by the organizer before the stipulation date of this decree to organize a trade exhibition, convention and/or seminar shall remain valid.
Article 18
Further provisions needed to implant this decree shall be provided for in a decision of the Director General of Domestic Trade.
CHAPTER VII CONSLUSION
Article 19
This decree shall begin to take effect on the date of stipulation.
For public cognizance, this decree shall be announced by placing it in the State Gazette of the Republic of Indonesia.
