THE ASEAN ATTORNEYS GENERAL CONSENSUS ON COOPERATION IN THE LEGAL FIELD

WE, the Attorney General of Brunei Darussalam , the Attorney General of Ind ones ia, the Attorney General of Malaysia, tl 1 Solicitor General ofthe Philippines, the
Att orn ey General of Singapore, and the Attorney General of Thai land ;
ATTENDING the Meeting of the ASEAN Attorneys Gen era l in Jakarta on 24 -25 Jul y !995 upon the invitation of His Excellency Mr. Singgih, the Attorn ey General of Indonesia;
REAFFIRMING our commitment to the Bangkok Declaration of 8 August 1967 and th e Declaration of ASEAN Concord of 24 February 1976, in particular to its programme of action ;
RECALLING (I) The Seventeenth ASEAN Ministerial Meeting, Jakarta 9-10 Jul y 1984 ; (2) The A ')EAN Ministerial Understanding on the Organizational Arrange ment for Cooperation in the Legal Field, Bali, 12 April 1986; (3) The Informal Meeting of the A SEAN Attorneys General, Denpasar, 9 December 1989;
RECOGNIZING the mutual need for cooperation in the legal field which has to be carried out with respect to the national legal systems in the respective ASEAN member countries, due to the diversity oflegal ; ' Stems present in such countries;
DESIRING to facilitate the cooperation in legal field for the mutual benefit of the ASEAN member countries;
DO HEREBY STATE the following points on which we have reached co nsensus:
I. Exchange of Information
b. The exchange of information - may be handled directly between the Attorney General's Offices.
2. Legal Education and Training
a . Cooperation in the field of education and training for officials of the Attorneys General Offices is to be accomplished through exchange of trainees, lecturers, instructors, educational material, and study visits. b. The Attorneys General Offices will cooperate in informing each other if
they have a legal education or training programmes suitable for participation by legal officers of other ASEAN member country, specifying the name of the programme, objective, curriculum and criteria for participation.
3. Legal R_esearch
a. An Attorney General Office may make available to another member country the legislations and results or findings of any lega l research which it deems to be of mutual benefit.
b. An Attorney General Office may initiate legal research programme son certain cases or legal issues to be conducted bilaterally or multilaterally. 4. Communication
To facilitate the realization of this consensus, communication will be conducted directly among the offices of the Attorneys General.
5. Meeting
The Attorney General shall meet at such appropriate intervals as is c ) nvenient, but not at longer intervals than once in 3 (three) years.

Jaksa Agung Brunei Darussalam, Jaksa Agung Indonesia,
Jaksa Agung Malaysia, Solisitor Jendral Philipina, Jaksa Agung
Singapura, dan Jaksa Agung Thailand;
MENGHADIRI
Pertemuan Jaksa Agung ASEAN eli Jakarta pacta
tanggal 24 dan 25 Juli atas undangan Yang Mulia Bapak Singgih, Jaksa
Agung Republlk Indonesia;
MENEGASKAN
komitmen kami terhadap Deklarasi Bangkok
tanggal 8 Agustus 1967, dan Deklarasi Kesepakatan A SEAN tanggal 24
Pebruari 1976, khususnya program pelak:sanaannya;
MENGINGA T (
1) Pertemuan Tingkat Menteri A SEAN ketuj uh
be las di Jakarta pacta tangga l 9- 10 Juli 1984; (2) Saling PL:n gertian P<Jra
Menteri ASEAN mengenai Susunan Organisasi bagi Ketjasama di
Bidang Hukum, di Bali, tanggal 12 April 1986; (3) Pertemuan Informal

MENANDAI,
adanya kepentingan bersama bagi ke1jasama di
bidang hukum yang harus dilaksanakan dengan menghormati sistem
hukum nasional di masing-masing negara anggota ASEAN, sehubungan
dengan perbedaan sistem hukum yang ada di negara-negara tersebut;
BERKEHENDAK
untuk mempermuclah ke1jasama eli bidang
hukum bagi kemanfaatan bersama negara-negara anggota ASEAN;
DENGAN INI MENYATAKAN
konsensus yang telah kami
capai, sebagai berikut :
1.
TUKAR-MENUKAR INFORMASI :
a.
Untuk mempermudah pertukaran informasi dalam
perkara-perkara penting dengan memperhatikan hukum, peraturan
dan praktek se11a memperhatikan pula kepentingan umum
dari pihak negara anggota ASEAN yang diminta.
b.
Tukar-meriukar
informasi
dapat
dilaksanakan
secara
langsung antar Kantor Kejaksaan Agung.
2.
PENDIDIKAN DAN PELATIHAN HUKUM
a.
Ke1jasama dalam bidang pendidikan dan pclatihan hukum
bagi para pejabat Kejaksaan dilaksanakan melalui pertukaran
siswa, pengajar, pelatih, bahan pelajaran dan kunjungan
membei·itahukan kepada satu sama lain jika mempunyai
program pendidikan atau pelatihan yang cocok bagi
keikutsertaan pejabat hukum clari negara anggota ASEAN
·lain,
dengan
men net
nama
program,
tuj uannya,
kurikulumnya, dan kriteria bagi keikutsertaan eli dalamnya.
3.
RISET HUKUM
a.
Kantor Kejaksaan Agung akan menyed iakan bagi Kejaksaan
Agung negara ASEAN lainnya, peraturan
perunclang-undangan dan hasil ataupun temuan riset hukum yang
dianggapnya akan memberikan manfaatan bersama.
b.
Setiap Kejaksaan Agung

mengenai perkara atau masalah hukum . tertentu guna
dilaksanakan secara bilateral atau multilateral.
4.
KOMUNIKASI
Unt'uk memudnhkan pelaksanann konsensus ini , komunikasi akcm
dilaksanakan secnra langsung di antara Kanlor-Kanlor Kejaksaan

PERTEM·UAN
Para Jaksa Agung akan bertemu dalam jangka yang tepat dan
dirasa baik, tetapi tidak lebih dari jangka sekali clalam 3 (tiga)
tahun.

OF THE ASEAN ATTORNEYS GENERAL OFFICES JAKARTA, 24 JULI 1995
I. The Meeting of Senior Officials of the ASEAN Attorney General offices was convened in Jakarta on 24 July 1995.
2. The Meeting was attended by
the Delegation of Brunei Darusalam, led by Pengiran Ha.ijah Zabaidah binti Pengiran Haji Kamaluddin, Principal Counsel, Attorney General of Chambers;
the Delegation of Indonesia, led by Mr. L.M.M. Samosir, Director of Social and Cultural Affairs, aエエッイョセZケ@ General Office;
the Delegation of Malaysia, led by Bhg. Data' Abdul Gani bin Patail, Head of Legal Counsel on International Law Division;
the Delegation of Philippines, led by Mr. Magdanga M. Deleon, Assistant Solicitor General;
the Delegation of Singapore, led by Mr. Mathew Joseph, Deputy Senior · State Counsel Attorney General Chambers;
the Delegation of Thailand, led by Mr. Maroon Charoonbara, Excecutive Director of the Office of Technical Affairs, Office of the Attorney General.
3. The delegation of the Republic of Socialist Vietnam, led by Mr. Hoang Khan, head the Department of Control oflnvestigation, Attorney General Office, attended the meeting as observer and as Guest of the Indonesian Attorney General Office.
4. Mr. L.M.M. Samosir, leader of the Indonesian delegation, and Mr. H.T. Rasmin Saleh, Chief of Education and Training Centre, Indonesian Attorney General Office were unanimously elected Chairman and Vice chairman.
Informal Meeting of the A SEAN Attorneys General Meeting held in Bali on 9 December 1989, discussed only general matters, but in this Meeting we can discuss more details matter relating to the cooperation.
6. The Meeting agreed that th.e exchange of information among ASEAN member country should be develop.
7. In the field of legal education and training, the Meeting agreed to hold the exchange and informed of any legal education programme.
8. The leaders of Senior Official of the ASEAN Attorney General Offices expressed their sincere appreciation to the Indonesian Attorney General Office for the warm hospitality accorded to the delegation and for the excellent facilitation and arrangements made for the Meeting.
