DECISION OF THE DIRECTOR GENERAL OF METAL, ELECTRONIC MACHINE AND MULTIFARIOUS INDUSTRIES NO. 009/SK/DJ-ILMEA/7/2000 DATED JULY 10, 2000 ON PROVISIONS AND PROCEDURES FOR CERTIFICATION OF GENERAL WORKSHOP OF

MOTOR VEHICLE

THE DIRECTOR GENERAL OF METAL, ELECTRONIC MACHINE AND MULTIFARIOUS INDUSTRIES

Considering :

1. Presidential Decree No. 235/1998 on the appointment of the Director General of Metal, Electronic Machine and Multifarious Industries, the Ministry of Industry and Trade;

2. Presidential Decree No. 335/M/1999 on the Establishment of the Cabinet for the Period of 1999-2004;

3. Presidential Decree No. 136/1990 on the Status, Duties, Functions, Organizational Structure and the Working Arrangement of Ministries;

4. Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 on the General Workshop of Motor Vehicle;

5. Joint Decree of the Minister of Industry and Trade No. 581/MPP/Kep/10/1999 and the Minister of Communications No. KM 79A/1999 on the General Workshop of Motor Vehicle Which Is Promoted As The Periodical Testing Unit of Motor Vehicle;

6. The Decision of the Director General for Metal, Electronic Machine and Multifarious Industries No. 04/SK/DJ-ILMEA/V/2000 on the Requirements and Evaluation of the Classification of General Workshop of Motor Vehicle.

DECIDES : To Stipulate :

THE DECISION OF THE DIRECTOR GENERAL OF METAL, ELECTRONIC MACHINE AND MULTIFARIOUS INDUSTRIES ON PROVISIONS AND PROCEDURES FOR CERTIFICATION OF GENERAL WORKSHOP OF MOTOR VEHICLE.

CHAPTER I GENERAL PROVISIONS

Article 1

In this decision referred to as :

1. Institution for Certification shall be the institution which carries out the process of certification and issues the workshop certificate.

2. General Workshop of Motor Vehicle shall be the general workshop of motor vehicle as referred to in KKI 38431.9900 and KKI 38441.9900 which functions to repair and maintain motor vehicle so as to meet technical requirements and operational worthiness, which is hereinafter referred to as the workshop.

3. Classification of workshop shall be the classification of workshop into various classes in accordance with the evaluation on the four elements required, namely the system of quality, facilities and equipment, mechanics and the information management.

4. Certification shall be the process of classifying workshop carried out by the Institution for Certification for the application which has met the requirements stipulated.

5. Verification shall be the activity to evaluate documents, activities, officers/executives and guidelines/ procedures based on the existing provisions.

6. Field Inspection shall be the activity carried out by the Institution for Certification concerning the system of quality, facilities, equipment, mechanics and information management which are possessed by the workshop and applied by the workshop in relation to the process of certification of the workshop.

8. Certificate Change shall be the change which is submitted by the workshop, if one element of classification or more changes the value of weight required.

9. Minister shall be the Minister of Industry and Trade of the Republic of Indonesia. CHAPTER II

CERTIFICATION Article 2

(1) Any workshop shall be classified through the process of certification of workshop.

(2) The classification as referred to in paragraph 1 is carried out to obtain the certificate of workshop.

(3) The process of certification as referred to in paragraph 1 is carried out by the Institution of Certification which is appointed by the Minister as the institution carrying out the classification of workshop

(4) The appointment of the institution carrying out the classification of workshop as referred to in paragraph 3 is carried out through a tender in accordance with the existing laws.

Article 3

(1) The Institution for Certification shall carry out the verification and field inspection for any workshop which submits the application for classification as referred to in Article 5.

(2) The provisions on the verification and field inspection as referred to in paragraph 2 are stipulated by the Institution for Certification.

CHAPTER III

PROCEDURES FOR CERTIFICATION Article 4

Any workshop submitting the application and has met the requirements for classification is granted a certificate in accordance with the class and type.

Article 5

(1) Any application for classification of workshop is submitted to the Institution for Certification by attaching a copy of the Business Permit possessed and a copy of Corporate Registry Number (TDP) possessed which are still valid.

(2) In addition to the documents as referred to in paragraph 1, the workshop shall submit other supporting documents which are stipulated by the Institution for Certification.

(3) Within a maximal period of 5 (five) work days as from the date of application as referred to in paragraphs 1 and 2 are received and the documents are declared complete and true, the Institution for Certification carries out the verification and field inspection.

(4) Within a maximal period of 10 (ten) work days as from the date of the process of verification and field inspection as referred to in paragraphs 3, the Institution for Certification issues a certificate based on the results of the verification and field inspection.

Article 6

Any workshop which submits the application for classification as referred to in Article 2 paragraph 1, has the right to obtain one consultation in accordance with the schedule arranged by the Institution for Certification.

Article 7

(2) The workshop receiving the notification on the delay as referred to in paragraph 1, within a maximal period of 5 (five) work days the relevant workshop shall supplement the incomplete documents.

(3) If the relevant workshop does not supplement the documents within a period of 5 (five) work days as referred to in paragraph 2, the application for classification is declare void and the relevant workshop can submit a new application for classification.

Article 8

The Institution for Certification has the authority to determine the class and type of workshop by conducting the process of certification submitted by the workshop.

Article 9

If within the time set as referred to in Article 5 paragraphs 3 and 4 the Institution for Certification has not issued the certificate, the relevant workshop has the right to obtain a certificate in accordance with the class and type submitted in the application.

Article 10

(1) The workshop can raise objections against the results of the stipulation of the type and class by the Institution for Certification as referred to in Article 8

(2) The objections as referred to in paragraph 1 shall be submitted in writing within a maximal period of 7 (seven) work days as from the date of receipt of the certificate by the workshop.

CERTIFICATE Article 11

The certificates as referred to in Article 4 consist of : a. Certificate of class I types A, B and C;

b. Certificate of class II types A, B and C; c. Certificate of class III types A, B and C;

Article 12

The certificates as referred to in Article 11 are valid for 5 (five) years as long as the relevant workshop still meets the existing provisions.

Article 13

(1) The validity period of the certificates as referred to in Article 12 can be extended after the results of the last supervision has found no deviations from the fulfillment of the requirements for the classes and types in accordance with the certificates possessed.

(2) The application for the extension of the certificate as referred to in paragraph 1 can be submitted within a period of 30 (thirty) work days before the validity period expires.

(3) If the application for the extension has exceeded the limit of the validity period as referred to in paragraph 2, the application for the extension is rejected and the relevant workshop shall submit a new application for classification in accordance with the provisions in Article 5.

Article 14

(1) If the workshop which has obtained a certificate makes a change in the requirements for the class and type in accordance with the certificate possessed, the workshop shall submit an application for the certificate change to the certification institution issuing the certificate.

(3) For the application for certificate change as referred to in paragraph 1, the Institution for Certification carries out the verification and field inspection as referred to in Article 3.

Article 15

(1) If the certificate obtained by the workshop is lost or damaged and cannot be read, the relevant workshop shall submit the application for replacement of the certificate in writing to the Institution issuing the certificate. (2) The application for the certification which is lost or damaged as referred to in paragraph 1 is submitted under

the following provisions :

a. Attaching the letter from the local police stating that the certificate is lost. b. Attaching the original certificate for the damaged certificate.

(3) Within a maximal period of 5 (five) work days as from the date on which the application for the replacement of certificate as referred to in paragraph 2, the relevant Institution for Certification shall issues a replacement certificate.

Article 16

(1) The relevant workshop is changed with the cost of the certification, including the process of certificate change (2) The cost charged to the workshop as referred to in paragraph 1 is stipulated by the Institution for Certification.

CHAPTER IV SUPERVISION

Article 17

(1) The Institution for Certification shall exercise periodical supervision over the workshop which has obtained certificate

(2) The periodical supervis ion as referred to in paragraph 1 covers the examination on the system of quality, facilities and equipment, mechanics as well as the information management in accordance with the class and type of the workshop

(3) The examination as referred to in paragraph 2 is carried out at least 2 (twice) a year and the implementation is arranged by the Institution for Certification.

(4) The result of the examination as referred to in paragraph 3 is final and is notified to the workshop. CHAPTER V

REPORTING

Article 18

(1) The Institution for Certification which is appointed shall submit periodical reports to the Minister once in 6 (six) months.

(2) The reports as referred to in paragraph 1 are submitted at the latest on July 15 and January 15 in each on going year.

Article 19

The submission of the reports as referred to in Article 18 paragraph 2 is made by using the form as indicated in the Attachment to this Decision.

CHAPTER VI PUBLICATION

Article 20

(2) The publication as referred to in paragraph 1 covers the class, type of the result of the certification and the result of the periodical supervision.

CHAPTER VII SANCTION

Article 21

The class of the workshop is demoted, if the result of the examination as referred to in Article 17 paragraph 2 proves that the workshop no longer fulfill the requirements in accordance with the certificate which has been possessed.

CHAPTER VIII CLOSING PROVISIONS

Article 22

(1) Any workshop which has been in operation before the stipulation of this decision shall be classified with the implementation being done gradually.

(2) The stage of the implementation of the classification referred to in paragraph 1 is further stipulated by the Director General of Metal, Electronic Machine and Multifarious Industries.

Article 23 This decision shall come into force as from the date of stipulation.

For public cognizance, this decision shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
