PERSETUJUAN ANT ARA

PEMERINTAH REPUBLIK INDONESIA DE NGAN

PEMERINTAH REPUBLIK ISLAM AFGHANISTAN MENGENAI

PERSAHABATAN DAN KERJA SAMA

Pemerintah Republik Indonesia dan Pemerintah Republik Islam Afghanistan selanjutnya disebut sebagai "Para Pihak";

MENYADARI kepentingan abadi pemerintah dan masyarakat kedua negara dan tuntutan global dewasa ini;

MENYADARI kebutuhan untuk menjamin perdamaian dan keamanan di kawasan dan dunia, memerangi terorisme, ekstremisme, perdagangan gelap narkoba, kemiskinan, keterbelakangan, dan untuk memajukan nilai-nilai kemanusiaan yang signifikan;

M.ENYADARI adanya niat untuk memperkuat kerja sama politik dan keamanan, memperdalam kerja sama ekonomi, meningkatkan kerja sama sosial budaya, dan memperluas pertukaran hubungan antar non-pemerintah;

MENGINGAT Perjanjian Persahabatan antara Republik Indonesia dan Kerajaan Afghanistan yang telah ditandatangani pada tanggal 24 April 1955;

MEMPERTIMBANGKAN Piagam Perserikatan Bangsa-Bangsa, perjanjian dan konvensi hukum lainnya yang disetujui oleh kedua negara;

SESUAI dengan peraturan perundangan-perundangan yang berlaku di masing-masing negara;

UNTUK LEBIH MENINGKATKAN kerja sama saling bersahabat,

PARA PIHAK telah menyepakati hal-hal sebagai berikut:

I. RUANG LINGKUP KERJA SAMA

1 1 A. Kerja Sama Politik

1. Meningkatkan kontak dan komunikasi, serta mendorong dialog topik-topik bilateral, kawasan dan internasional yang menjadi kepentingan dan perhatian bersama melalui pembentukan sebuah mekanisme konsultasi bilateral.

2. Terus mendorong saling pengertian dan saling dukung terhadap prinsip saling menghormati kemerdekaan, kedaulatan, dan integritas wilayah para Pihak.

3. Mendorong kerja sama keamanan dan regional, memajukan saling pengertian dan solidaritas antara masyarakat dan pemerintah di kawasan .

4. Secara aktif turut serta dalam pencegahan konflik dan memerangi

terorisme, perdagangan gelap narkoba, ekstrimisme, dan

separatisme.

5. Mempertahankan kerja sama yang aktif dan erat antara perwakilan-perwakilan para Pihak di Perserikatan Bangsa Bangsa dan organisasi internasional lainnya, serta di negara-negara mitra.

6. Menjamin perdamaian, keamanan, dan pembangunan berkelanjutan untuk masyarakat para Pihak dengan menghormati prinsip-prinsip demokrasi dan hak asasi manusia.

B. Kerja Sama Ekonomi dan Perdagangan

1. Mempromosikan kemitraan berkelanjutan dan penting dalam hubungan ekonomi dan perdagangan bilateral antara para Pihak, di bawah prinsip-prinsip persamaan, saling menguntungkan, saling melengkapi dan keberagaman.

2. Mempromosikan kerja sama ekonomi dan teknik antara para Pihak.

3. Memperkuat kerja sama antara para Pihak di kawasan di dalam organisasi ekonomi internasional serta kerja sama keuangan, serta memajukan transaksi perdagangan dan industri antara para Pihak.

C. Kerja Sama Akademis dan Kebudayaan

1. Bekerja sama di bidang pendidikan, pelatihan, penelitian dan

pengembangan hak asasi manusia dan kebebasan asasi

berdasarkan prinsip kesetaraan dan keadilan.

2. Mempromosikan kerja sama di bidang pendidikan, termasuk pendidikan tinggi dan pendidikan kejuruan, pembangunan kapasitas, dan pengembangan ilmu pengetahuan dan teknologi.

3. Mendorong pengenalan terhadap budaya dan bahasa masing-masing negara, termasuk kesusastraan, seni, pariwisata, dan

antropologi melalui program akademis dan kebudayaan baik

kawasan dan bilateral.

4. Memperkuat kerja sama di bidang renovasi dan restorasi monumen bersejarah dan bekerja sama dengan United Nations Educational,

Scientific and Cultural Organization (UNESCO) dan Islamic

Educational, Scientific and Cultural Organization (IESCO).

II. MEKANISME KOORDINASI DAN IMPLEMENTASI

Persetujuan ini akan dilaksanakan dalam kerangka kerja Konsultasi Bilateral di tingkat pemerintahan. Tugas dan mekanisme Konsultasi Bilateral akan ditetapkan pada persetujuan terpisah.

Ill. KETENTUAN AKHIR

1. Setiap masalah yang timbul dari penafsiran Persetujuan ini diselesaikan secara damai, melalui negosiasi antara Para Pihak.

2. Persetujuan ini dapat diubah secara tertulis melalui kesepakatan bersama para Pihak; setiap perubahan tersebut berlaku pada tanggal pemberitahuan terakhir para Pihak.

3. Persetujuan ini mulai berlaku pada tanggal penandatanganannya. Perjanjian ini akan berlaku selama 5 (lima) tahun dan dapat diperpanjang untuk jangka waktu 5 (lima) tahun berikutnya dengan kesepakatan bersama Para Pihak.

4. Salah satu Pihak dapat mengakhiri Persetujuan ini setiap saat, namun harus memberikan pemberitahuan tertulis kepada Pihak lainnya paling lambat 90 (Sembilan puluh) hari sebelum penghentian Persetujuan ini.

EBAGAI BUKTI, yang bertandatangan di bawah ini, telah menandatangani ·erjanjian ini.

1IBUAT dalam dua naskah asli di Bali, Indonesia, pada tanggal 9 November 012 atau sama dengan tanggal 19/8/1391 , dalam bahasa Indonesia, Pashto, 1ari, dan lnggris, semua naskah mempunyai kekuatan hukum yang sama. 1alam hal terdapat perbedaan penafsiran Perjanjian ini, maka naskah dalam ahasa lnggris yang berlaku.

AGREEMENT BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE ISLAMIC REPUBLIC OF AFGHANISTAN ON

FRIENDSHIP AND COOPERATION

The the Government of the Republic of Indonesia and Government of the Islamic Republic of Afghanistan (hereinafter referred to as "the Parties");

RECOGNIZING the everlasting interests of the governments and the people of two countries and the contemporary global demands;

RECOGNIZING the need for the ensuring peace and security in the region and the world, combating terrorism, extremism, illicit trafficking in narcotic drugs, poverty and backwardness, and in order to advance the significant human values;

RECOGNIZING the intentions to strengthen political and security cooperation, deepening economic and development cooperation, enhancing socio-cultural I cooperation, and expanding non-governmental exchanges;

BEARING IN MIND the Treaty of Friendship between the Republic of Indonesia and the last Kingdom of Afghanistan signed on 24 April 1955;

TAKING INTO CONSIDERATION the United Nations Charter and other laws, 1 1

treaties and conventions approved by the two countries;

PURSUANT to the prevailing law and regulations of the respective countries; TO FURTHER PROMOTE mutual friendship cooperation;

HAVE AGREED

as follows:

I. AREAS OF COOPERATION

A. Political Cooperation

1. To improve contacts and communications as well as to promote dialogue

on bilateral, regional and international topics of common interests and

concerns through the establishment of a bilateral consultation mechanism.

2. To continuously promote mutual understanding and support to principles of

mutual respect for independence, sovereignty and territorial integrity of the

Parties.

3. To

promote security and

regional cooperation,

advance mutual

understanding and solidarity between the people and the regional

governments.

4. To actively participate in conflict prevention and combating terrorism, illicit

trafficking in narcotic drugs, extremism and separatism.

5. To maintain an active and close cooperation between the representatives of 1 1

the Parties at the United Nations and other international organizations and

in partner countries.

6. To ensure peace security and sustainable development for the people of

the Parties with respect to the principles of democracy and human rights.

B. Economic and Trade Cooperation

1. To promote a sustainable and vital partnership in bilateral economic and

trade relation between the Parties, under the principles of equality, mutual

benefit, complementarities and diversity.

2. To promote an economic and technical cooperation between the Parties.

3. To strengthen the cooperation between the Parties in regional and

international economic and financial cooperation organizations, as well as to

advance trade and industrial transactions between the Parties.

C. Academic and Cultural Cooperation

1. To collaborate on education, training, research and development of human

rights and fundamental freedom on the basis of equality and equity.

2. To promote cooperation in education, including higher education and

vocational education, capacity building and development of sciences and

technology.

3. To encourage introduction to the culture and language of each country,

including literature, arts, tourism and anthropology by means of regional and

bilateral academic and cultural programs.

4. To strengthen cooperation in the field of renovation and restoration of

historical monuments and cooperation with the United Nations Educational,

Scientific and Cultural Organization (UNESCO) and Islamic Educational,

Scientific and Cultural Organization (IESCO).

II.

COORDINATION AND IMPLEMENTATION MECHANISM

This agreement will be implemented under the framework of Bilateral Consultations

at governmental level. The work and mechanism of Bilateral Consultations will be

set out in a separate agreement.

Ill. FINAL PROVISIONS

1. Any matter arising from the interpretation of this Agreement is to be settled

amicably, through negotiation between the Parties.

2. This Agreement may be modified in writing by mutual consent by the

Parties. Any such modification becomes operative on the date of latter

notification of the Parties.

3. This Agreement shall enter into force on the date of its signing. This

Agreement will be valid for five (5) years and may be extended for another

five (5) years by mutual consent of the Parties.

4. Either Party may terminate this Agreement at any time, but should

endeavor to provide written notice to the other at least 90 (ninety} days

prior to its intention to terminate this Agreement.
