PRESIDENTIAL DECREE

NO. 83/2001 DATED JUNE 30, 2001

SELLING PRICES OF ELECTRICITY PROVIDED BY

STATE ELECTRICITY LIMITED LIABILITY COMPANY PT (PERSERO)

PERUSAHAAN LISTRIK NEGARA

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering :

a.

that within the framework of maintaining the continuity of electricity supply in urban and rural areas as well

as promoting economic activities, it is necessary to restipulate selling prices of electricity provided by the

state electricity limited liability company PT (Persero) Perusahaan Listrik Negara, so as to gradually reach

the economic value;

b.

that in fixing the selling prices of electricity, the government considers factors of justice, purchasing power

of society, production costs and operational efficiency, scales of exploitation and interconnection of systems

applied;

c.

that in the framework of supporting the sustainable economic growth, subsidies made available to

subscribes will be abolished in phases;

d.

that pursuant to the provisions in force, the selling prices of electricity need to be stipulated by a Presidential

Decree.

In view of :

1.

Article 4 paragraph (1) of the Constitution of 1945 as already amended by the Second Amendment to the

Constitution of 1945;

2.

Law No. 15/1985 on electrical energy (Statute Book of 1985 No. 74, Supplement to Statute Book No.

3317);

3.

Law No. 8/1999 on consumer protection (Statute Book of 1999 No. 42, Supplement to Statute Book No.

3821);

4.

Law No. 35/2000 on the State Budget of Revenue and Expenditure for the fiscal year of 2001 (Statute Book

of 2000 No. 250, Supplement to Statute Book No. 4052);

5.

Government Regulation No. 23/1994 on the change in status of the state electricity public corporation

(Perum) into a state limited liability company (Persero) (Statute Book of 1994 No. 34).

D E C I D E S :

To stipulate

THE PRESIDENTIAL DECREE ON SELLING PRICES OF ELECTRICITY PROVIDED BY STATE

ELECTRICITY LIMITED LIABILITY COMPANY PT (PERSERO) PERUSAHAAN LISTRIK NEGARA.

Article 1

Selling prices of electricity provided by the state limited liability company PT (Persero) Perusahaan

Listrik Negara shall be specified into basic tariffs of electricity for 2001 on the basis of groups of basic tariffs of

electricity as contained in Attachment I to this Presidential Decree.

Article 2

The basic tariffs of electricity for 2001 as meant in Article 1 shall consists of :

a.

Basic tariffs of electricity for social service, as contained in Attachment II;

c.

Basic tariffs of electricity for business, as contained in Attachment IV;

d.

Basic tariffs of electricity for industries, as contained in Attachment V;

e.

Basic tariffs of electricity for government offices and public road illumination, as contained in Attachment

VI;

f.

Basic tariffs of electricity for traction, as contained in Attachment VII;

g.

Basic tariffs of electricity for bulk, as contained in Attachment VIII;

h.

Basic tariffs of electricity for multipurpose, as contained in Attachment IX;

Article 3

The Minister of Mines and Energy shall supervise the implementation of this Presidential Decree.

Article 4

Further provisions for the implementation of this Presidential Decree shall be stipulated by the Minister

of Mines and Energy

Article 5

With the enforcement of this Presidential Decree, the Presidential Decree No. 48/2000 on selling prices

of electricity provided by the state limited liability company PT (Persero) Perusahaan Listrik Negara (Statute

Book of 2000 No. 42) shall be declared null and void.

Article 6

This Presidential Decree shall come into force as from July 1, 2001.

For public cognizance, this Presidential Decree shall be promulgated by placing it in Statute Book of the

Republic of Indonesia.

1). This tariff is only meant for electricity consumption which for various reasons cannot be covered by

the standard tariffs as contained in Attachment II, III, IV, V, VI, VII and VIII to this presidential

decree or based on agreements between parties.

2). This tariff can be used as the basis for different purposes, including :

a.

For calculating the export-import price of electricity between PT (Persero) Perusahaan Listrik Negara

and other parties to create reciprocal relations which are mutually beneficial;

b.

Tariff for calculating the price of electricity expected by subscribers to have characteristics of a

higher standard or is agreedpon PT (Persero) Perusahaan Listrik Negara as the standard

characteristics in terms of quality, reliability and services;

c.

For calculating the price of electricity for subscribers of PT (Persero) Perusahaan Listrik Negara

whose load and is allowed to be regulated, reduced or excluded from the system by PT (Persero)

Perusahaan Listrik Negara as agreed upon;

d.

For calculating the price of electricity for parties within to have electricity system interconnection

with PT (Persero) Perusahaan Listrik Negara, with or without intersystem capacity flows;

e.

For calculating the price of electricity for those needing electricity from PT (Persero) Perusahaan

Listrik Negara on a seasonal basis or with certain load patters as mutually agreed upon;

f.

For calculating the price of electricity which due to some reasons can not be covered by the standard

tariffs as contained in Attachments II, III, IV, V, VI, VII and VIII to this presidential decree, among

others, because :

- the consumption is temporary (short-term);

- it depends on the condition of the electricity system of PT (Persero) Perusahaan Listrik Negara;

- there are mutually profitable business opportunities for parties.
