B. (1) The Government of the United Kingdom s 11 2 opt the arrangements and procedures described in the following ｾｲ＠ r aphs of this 1 ote in so f r as t ey relate t o things to be done by or on behalf of

adopt the arrangements and rocedures so described in so far as they relate to things to be done by or on behalf of that Governm nt ,.

( 2)( ) Fo r the purpose of t ese a rr ngements , the Government of Indonesi through the Central Ba of Indonesia
{Bank I ndonesia) shall, by r ests in the orm set out i n Annex. A t o this Note , open s pe cial Accounts (hereinafter refer11ed to as 'the Accounts •) with
bank in London ( hereinafte refe re t o as "the
Banks ' ). h se Accounts shall be ｯｾ･＠ ated solel y fo r
the purposes of the loan and in accordance vith the instructions contained in the said re _uests .
(b) As soon as these Accounts -re opened and before takin any other step required by these arrangements for obtaining any part of the loan, the Government of Indonesia sh 11 furnish the Government of· t e Uni t ed
ingdom w-ith a co1 y of the Government'a instructions to the Banlts given in accordance ith the fo going
p ovisions of thi s I ndonesia shall,

( c) The Government of Indonesia shall ensure that the Banks shall forward monthly to the Government of t e United Kingdom st tements of all ecei_ts t o and payments from the Accounts .
(d) Unless the Government of the United Kingdom other1ise agree , payments i nto the Accounts hall not be made after the 31st arch 1971.
(3 ) Save to the extent , i f any , t o which the Government
of the United Kingdom may other1ise agree, dra:inga rom the loan shall be used only to reimburse banks in the United Kingdom for payments ( made in pur u nee of i rrevoc ble letters of credit hich a e opened or advised af'ter t he date
or
this Note ) to facilitatethe ca rying out of a contract for t he purchare in the United Kingdom of goods holly produced or
manufacture i n the United Kingdom or , i n the case of' chemical and allied p oduc s , goods hich are duly
eclared to be of United Kingdo origin on the form set out i n Anne C (Chemicals) to this Note , and being goods that ppe a r in Parts ' ' and ' B' of the import list m de under Article 2 of the ep rtment o Tra e
egulation { o 69/KP IV/ 1970) (the Indonesian official l ist of goods for which ｰ ｾ＠ ent by means of ' e vis a Kredi t" fo1'leign exchange from :forei n
credits is authorise by the Goverrunent of I ndonesia) and being a contract , hi ch:
( i) provides :for payment in sterling to persons
carrying on business in the United Kingdom; and
{ii) is approved by the Government of Indonesia and acce...-te by the Government 0.1.. the United
Kin dom for :financin from the loan; and
(i ii) i s entered into fte the ate of this Hote and
before the 31st ecember 1970 .
(4) ) -vhere the Government o:f Indonesia propose th · t part
of the l oan.shall be appli d to a contract , that Government shall ensure th t there are foria1ded t
the earlies t opportunity to the Government of the United Kingdom:
(1) a co y of the contract, or of a letter of
credit relating to the contract; and
{ii) t o co Jies of a Certificate :from the supplier concerned in the United Kingdom in the form set out in Anne C or Annex C (Chemicals) to this Note , ｾｨｩ｣ｨ･ｶ･ ｲ＠ i s pp opriate .
( b) The Gove ent of Indonesia shall ensure th t the Government of the United i dom re info rmed if t
any t i e contract {being a contract in espect of hich ocuments h ve been submitted in accordance ith the foregoing provisions) is amended or if
liability is incurred or is to be incurred thereunder to a greater or lesser ｾ＠ cunt than the amount
specified in the ｃｯｮｴ ｲｾ｣ｴ＠ Certificate and , in either of these cases , the Government of Indoneoia shall ensu e th t there are forwarded as soon as p ssible to the Government of the United Kingdom the relevant supplementary
or
revised documents .( 5)(a) After the Government of the United I ingdom have consi dered the documents forwarded i ursuance of the procedure described in the foregoing provisions of this Note and any additional i nformation which i t may r uest for this purpose from the Banks
acting on behalf of the Government of I ndonesi (and which that Government shall ensure is supplied on i ts behalf) , the Gov rnment of the nited Kingdo
s all notify the Banks in the for set out in
Annex C( i) to this Note · 1hether and to ·wrh::it extent it acce ts th· t a contract i s eligible for payment f o the loan.
(b) To the extent that the Government of the United Kingdom so acce t a contract and agree to ayment
from the Accounts , they shall on receipt of a r quest duly signed by one of the Banks on behalf of the
Government of Indonesia , in the form set out in Annex B to this Note , gi vin · details f' po.yme t due
and about to be ma e, make payments i n sterling into the Accounts and each such p ｹｭｾｮｴ＠ ｾｨ｡ｬｬ＠ constitute a
r win on t.!1e loan.
( 6) ｾ＠ ｾｩ＠ thdra · als ram t e Accounts shall be made only in
the manne r and subject to t he conditions hereinaf't r set out in this para6 ra h:
{a) or t e reimbursement to a bank in the cases to which para rah (3) refers , ·1ithdr·w ls shall be made only on receipt by the Danks of the
relevant documents including:
( i) a Payment Certificate in the form sho m in Allllex D to this ote and the invoices
referred to therein; or
(ii) fo r contr· cts in respect of iliich a Contract Certificate in the form shown in Annex 0
(Chemicals ) to this ote has been provided , the invoices only;
rovided that
( aa) the amount of reimbursement made in respect of any one contract shall not
e ceed the amount specified i n relation to that contract i n the notification i n the f'orm set o t in Annex C( i) to t his Note; and
(bb) the Banks shall forwara to the Government of the United Kingdom the relevant ayment Certificate (1here applicabl) and
invoices immediately any such eimbursements have been made;
(b) hotocopies or duplicates of invoices m y be
submitted instead of the originals for the purposes of this paragraph.
(7) If any monies that h ve been paid out of an Account are sub equen.tly refunded either by the supplier
or by a guarantor, the Government of I ndonesia shall , so long as there are payments or reimbursements to be made from that c count , pay an equi valent of such sums into that Account and i n any other case , apply the refunds to the reduct·o of the lo

(8) ｾｨ･＠ Government of Indonesia shall rep -y to the
Government of the United Kingdom in pounds sterling in London the total sum b orrowed under the arrange-ments set out in this Note , such repayment to be made by instalments paid on the dates and in the
amounts spe cified below , except that if , on the date when any such instalment is due to be paid , there i s then outstanding less t han the amount s pecified fo r t hat instalment, only the amount t hen outstanding shall be payable :

Any
amendment ｮ･｣･ｳｳｾｲｹ＠ to a contract , ihich af ects the details of the relev nt Contract Certificate , after the contract has been accepted in hole or in part by theGovernment of the United {ingdom for financing from the loan, must be notified to the Government of the United
Kingdom . The advising bank will accordingly be required to submit to you three copies of a fr sh Contr ct Certificate duly signed by the supplier togethe r ii th t o copies of the pro osed amendment nd action will then proceed in paragraph 3 above .

Sir,
I have the honour to refer to the Agreement on
development aid concluded to- day betv1een the Government
of the United Kingdom of Great Britain and Northern
Ireland and the Government of the Republic of Indonesiao
:i:n order to simplify the admiru.stration of the Joan
provided for under the terms of the Agreement , it had been
agreed that a list should be published showing those
items on parts A and B of' the current D. K,. Li st v1hich
are either unobtainable from the United Kingdom o·,.
ineligible under the terms of the loanc 'A list of these
i terns is attached comprising: ..
(a) :i.tems which are not normally produced in or exported from the United Kingdom; and
(b) i terns which will not q_ualify as being of United
Kingdom origin; and
(c) capital items which in the view of the UK
Govern-ment are more appl,OIJI''l ately handled under
project aid , calling in each case for a special
project o.greement1
