KONSTRUKSI

TAHAP PERTAMA

BAGIAN I

PENDAHULUAN

Pemerintah Indonesia dengan Bank Dunia telah menandatangani Naskah Perjanjian Pinjaman (Loan Agreemnet) untuk Western Indonesia National Roads Improvement Project (WINRIP) IBRD Loan No. 8043-ID pada tanggal 14 Desember 2011. Loan efektif 12 Maret 2012 dan akan berakhir pada tanggal 31 Desember 2017, senilai USD250 juta. Porsi sharing Loan dan GOI adalah 70:30 untuk Civil Works, dimana Pemerintah Indonesia menyediakan Dana USD 100 juta, sehingga total nilai proyek adalah USD 350 juta. Pinjaman tersebut akan digunakan untuk mendukung penguatan berkelanjutan Sistem Jaringan Jalan Nasional di wilayah Indonesia Barat,yaitu untuk pekerjaan jalan dan jembatan.

Tujuan utama proyek WINRIP adalah untuk meningkatkan status jaringan yang sebelumnya berfungsi sebagai jalan provinsi atau jalan non status agar sesuai dengan standar yang baru yaitu jalan nasional; memastikan bahwa jaringan jalan nasional tersebut menjadi lebih lancar dan berkeamanan; dan mampu mendukung peningkatan ekonomi daerah. Sesuai dengan Schedule 2 Section IC Naskah Perjanjian Pinjaman WINRIP,dan Bab 11 Project Management Manual (PMM) WINRIP, Pemerintah Indonesia dan Bank Dunia menyepakati pelaksanaan Anti-Corruption Action Plan (ACAP) atau Rencana Tindak Anti Korupsi (RTAK) dalam pelaksanaan proyek.

Adapun tujuan RTAK adalah untuk;

1. Mengidentifikasi resiko bagi pemerintah dan langkah-langkah pencegahan sehingga mencapai standard sistem kendali yang lebih baik dari yang telah dilakukan pada program-program sebelumnya.

2. Mengatasi semua resiko dalam bentuk rencana tindak yang dikendalikan oleh Ditjen. Bina Marga.

3. Mencapai pelaksanaan RTAK WINRIP yang sejalan dengan Pedoman Bank Dunia tentang Pencegahan dan Upaya Memerangi Penipuan dan Tindak Korupsi pada program-program yang didanai oleh Bank Dunia.

Pelaksanaan komponen RTAK WINRIP pada dasarnya adalah dalam rangka peningkatan transparansi dalam proses pelaksanaan proyek dengan menarik pelajaran dan pengalaman dari pelaksanaan RTAK pada proyek-proyek sebelumnya agar lebih kuat dan efektif, dengan melakukan langkah-langkah pencegahan dan meningkatkannya pada pelaksanaan rencana tindak-nya. Berdasarkan pelajaran dan pengalaman pada proyek sebelumnya, maka RTAK yang akan dilakukan meliputi

lima area sebagaimana diformulasikan dalam Matrik Pemetaan Resiko Korupsi dan Rencana Tindak yaitu:

a. Meningkatkan Penyebarluasan Informasi dan Transparansi

b. Meningkatkan Pemantauan yang dilakukan oleh Masyarakat Madani c. Meningkatkan Mekanisme Penanganan Pengaduan

d. Pencegahan Kolusi serta Pemalsuan dan Resiko Penipuan, dan e. Penerapan Sanksi dan Tindakan Hukum

Sedangkanruanglinkup pelaksanaan RTAK atau ACAP meliputi komponen-komponen berikut:

1. Pelibatan Wakil Pengamat dari Masyarakat (WPM) / Community Representative Observers (CROs) dalam pemantauan atau pengamatan terhadap proses pelelangan / pengadaanjasakonstruksi.

2. Keterbukaaninformasikepada public / Public Disclosure.

3. Penanganandan pengelolaan Pengaduan dari Masyarakat / Complaint Handling Mechanism System (CHS).

4. Pelibatan Pemantauan oleh Pihak Ketiga / Third Party Monitoring (TPM) dalam pemantauan proses konstruksi.

WPM berperan sebagai komponen yang mewakili masyarakat madani dalam mengamati dan mencermati proses pelelangan / pengadaan jasa konstruksi untuk mencegah terjadinya praktek korupsi, kolusi, dan nepotisme, serta tindak pemalsuan dan resiko penipuan.

Rapat Penjelasan Awal /Pre-Bid Meeting (aanwizjing dilaksanakan pada hari Senin tgl. 15 Juni 2015 dibuka pada jam 9.30 s.d jam 15.00 bertempat di Kantor Balai Besar Pelaksanaan Jalan Nasional II, Jl. Jati No. 109 Kota Padang.

Pembukaan rapat oleh Ir. Elvi Roza,MT sebagai Ketua Pokja WINRIP Satker Pelaksanaan Jalan Nasional Wilayah II Provinsi Sumatera Barat mewakili pejabat Kepala Balai Besar Pelaksanaan Jalan Nasional .

Rapat dihadiri unsur-unsur instansi terkait yaitu:

2. KUNJUNGAN LAPANGAN / SITE VISIT

2.1. Jelaskan kapan pelaksanaan kunjungan lapangan/ site visit dilaksanakan :

Tanggal 16 Juni 2015.

2.2. Jelaskan tentang pertemuan persiapan kunjungan lapangan, lokasi pertemuan, yang memimpin pertemuan, unsur-unsur terkait yang mengikuti kunjungan lapangan:

Pertemuan dilasnakan di awal, tengah dan akhir STA, yang dihadiri oleh Pokja, PPK, WPM dan rekanan.

2.3. Daftar rekanan yang mengikuti kunjungan lapangan :

12 rekanan (absen terlampir).

2.4. Siapa yang memimpin kunjungan lapangan tersebut :

Pokja.

2.5. Jelaskan kronologis kegiatan kunjungan lapangan mulai dari berangkat sampai kembali kekantor Satker/PPK:

Tanggal 16 Juni 2015 Jam 8.30 berangkat ke lapangan, jam 12.30 tiba di KM 130.00 (awal STA), jam 16.05 tiba di Akhir KM 180.00, dan jam 17.30 tiba di Tapan. Jam 23.40 tiba kembali di Padang.

2.6. Catat lokasi titik awal proyek, pada KM 130+00 (Lapangan Sepak Bola Kambang) dan titik akhir pada KM 180 + 00 (Tikungan maut Indrapura).

2.7. Catat kondisi existing jalan atau jembatan yang ada seperti:

 Lebar existing jalan, apakah sama sepanjang ruas proyek ataau bervariasi, kondisi pondasi dan perkerasannya, jenis konstruksi, kondisi drainase dan pembuangan limpasan air, ketersediaan quarry material di lokasi proyek, dll.

Lebar 6,00 m relative sama lebar sepanjang jalan, kondisi pondasi jalan 25 % rusak, drainase 80% tidak ada.

 Kondisi topografi/konturnya (daerah datar rendah/dataran tinggi, gambut/ berawa/tanah lunak, perbukitan/ pegunungan, rawan bencana/longsor/banjir/abrasi, tanah labil, dll);

 Kondisi rona lingkungan kiri/kanan jalan (pemukiman, lokasibisnis/pasar, kebun, sawah,

hutan, cagarbudaya, kelompok masyarat adat/indigenous people, hutan lindung, daerah koservasi, kemungkinan dampak negatif terhadap masyarakat, dll)

Kondisi rona lingkungan kiri/kanan jalan 15 % daerah pemukiman dan selebihnya daerah konservasi dan hutan lindung

2.8. Catat semua penjelasan dari pemimpin kunjungan dan pertanyaan dari para rekanan.

Dokumen cukup jelas dan detail.

2.9. Buatlah foto dokumentasi tentang kondisi lapangan proyek, terutama yang menjadi critical points, titik awal dan akhir.

7 BAGIAN IV

PENUTUP

1. KESIMPULAN

Kesimpulan hasil pengamatan pada kegiatan Pre-Bid Meeting dan Site Visit, apakah ada pelanggaran yang terjadi atau hal-hal yang berhubungan dengan prosedur pelelangan berdasarkan prinsip-prinsip ACAP.

Kesimpulan mengacu pada Berita Acara Aanwijzing / Menutes of Pre-Bid Meeting. Pokja/Panitia sudah melaksanakan kegiatan dengan baik, tapi rekanan kurang aktif dan mungkin belum memahami dokumen dengan baik dan detail. Sehingga terkesan Aanwijzing belum mencapai sasaran, dan hamper seperti acara seremonial saja.

2. CATATAN DAN SARAN

Catatan dari kegiatan Pre-Bid Meeting dan Site Visit yang telah berlangsung, dan berilah saran-saran berdasarkan catatan-catatan tersebut.

Untuk Rekanan :

Aanwijzing merupakan kegiatan yang sangat penting, sebagai acuan dalam melakukan penawaran. Pada kegiatan Aanwijzing dapat lebih memahami dokumen rencana, dan dapat mengetahui peluang/kemudahan, serta mengetahui tantangan dan kendala lapangan. Lokasi kegiatan merupakan jalan antar kabupaten dan propinsi. Jadi harus memahami strategi pelaksanaan, supaya tidak berdampak signifikan pada kelancaran lalu lintas nantinya.

Untuk Panitia :

Disamping rekanan dapat mengajukan pertanyaan tertulis dan dijawab panitia tertulis melalui email, juga sebaikmya diberi kesempatan rekanan untuk bertanya secara langsung pada saat Aanwijzing kantor.

now invites sealed bids from interested eligible bidders

for the construction and completion of the construction of the above project (“the Works”).

3. Interested eligible Bidders may download a complete set of bidding documents in the

English language, after login as described below (free of charge).

4. All bidders -Foreign and Domestic– interested to bid must use the e-procurement system.

In order to use this system, the Bidders must register in the system electronically through the

Ministry Public Works website, (www.pu.go.id) under the procurement section to obtain

access code to the system. In particular, for international Bidders, this access code will only be

valid for WINRIP Project. Local bidders will follow as usual registration process for the

project financed by government own budget (APBN).

The two step registration process is explained below:

iii. Select the Language as necessary

iv. Click “Registrasi bagi Penyedia Jasa yang belum memiliki User-ID”

Select “Tahun Anggaran” (Fiscal Year), select “Provinsi” (Province) and

choose “Direktorat Jenderal Bina Marga” (Directorate General of

Highways) in the menu of “Satminkal” (Administration Based Unit). All

in the left column. The registration period can be seen in the right column

of “Tanggal Pendaftaran” (Registration Date).

Fill the “User ID” and “Password” in the left column, and click “Login”

Select the Package Name in the column of “Nama Paket” (Package

Name)

vii.

Click the icon of “Pendaftaran” (Registration)

viii.

Fill the registration form completely, especially for “Kualifikasi”

(Qualification):

a.

Bidang (maximum 50 characters) : Civil Works

b.

Sub-bidang (maximum 50 characters) : Road and Bridge Works

c.

Lingkup Layanan (maximum 50 characters): Construction Works

and for asterisk (*) in red color may be filled or unfilled as necessary.

Click “Pemenang Pelelangan” (Notification of Award). If the bidder is not

satisfied with it’s the award, then the bidder can do the complain.

Click “Sanggah” (Complain). Enter your complain on the fields and then send

Click “Penunjukan Pemenang” (Bidding award). The award of bidder can

download notify the successful bidder.

6. Foreign applicants who are interested to work in Indonesia are required to have a

working license certification “Badan Usaha Jasa Konstruksi Asing - BUJKA” from the

Minister of Public Works Regulation (PERMEN PU) No. 05/PRT/M/2011 prior to signing the

contract (but not a pre-condition for bidding). With respect to the working license certification

requirement under the above regulation, the requirement for the foreign firms to form mandatory

associations (joint ventures/joint operations/sub-contracting) with local firms will not be

applicable to this contract. Bidders may however form such associations if they themselves

choose to do so.

Description of Works : The Carriageway of 55,20 km is being widening to 7 m plus 1.0 – 2.0

m hard shoulders on both sides. Drainage is being provide along the entire lenght of the project road. The project starts at Km.131+334 from Kambang and ends at Km.186+534 in Indrapura (Link N 03.044), West Sumatera Province. The road works consist of road betterment, asphalt overlay, drainage improvement and road widening.

II. RECORD OF THE PRE BID MEETING

- Opening on 10.00 a.m local time,

- The pre bid meeting was opened by Ir. Elvi Roza, MT, chairman of Procurement Commitee (POKJA) WINRIP Satker Pelaksanaan Jalan Nasional II Provinsi Sumatera Barat-ULP Sumatera Barat;

- An opening remarks was conducted by chairman of Procurement Committee to examine the Technical requirement that bidders must consider in their bids for package 12: Kambang - Indrapura. He state that the purpose of the pre bid meeting is to inform the bidder the complete requirement of the work to avoid any mis-interpretation.

- Explanation of the Official Commitment Maker (PPK 15) regarding the scope of work for Package No: 12;

- Presentation of the bidding procedures of WINRIP as well as emphasis were highlighted on the requirement of the bid document by Ir. M. Edi Fachri (Procurement Specialist 2 CTC WINRIP)

- A Prospective Bidder requiring clarification shall contact the comittee in writing at the comittee’s email address stated in the bid document to be submitted no later than 22 Juni 2015;

- The result of clarification by POKJA will be uploaded with this Minutes of Pre Bid Meeting by LPSE system on date June 25, 2015;

- Deadline of Bid submission will be at 10.00 a.m on date July 13, 2015 . Late bids will be automatically rejected by LPSE system (the bidder cannot upload the bids after the deadline);

- For an explanation of the field will be conducted on Tuesday dated June 16, 2015 with the rallying point in the office of Balai Besar Pelaksanaan Jalan Nasional II at 08:00 a.m local time.

1. Is the bid security form must be in accordance with the format of the document procurement?

Please refer to ITB Clause 19.3: ... the bid

security shall be submitted either using the Bid Security Form included in Section IV, Bidding Forms, or in another substantially similar format approved by the Employer prior to bid submission…….

2. Regarding the experience of similar work. If in the case of JV whether minimum contract value may be a combined value of the contract between the members of JV? please explain.

In the case of JV, the minimum contract value for similar work can not be combined, must be meet by the main contractor.

3. For the credit facility is listed in the bidding documents? and what is the nominal value of the Line of Credit?

The credit facility could not be as the requirement, otherwise, the remaining balance available may be counted as part of the cash flow. Please see Page 79 Form FIN -.3: Financial Resources for more explanation. 4. For the 2014 financial statements were not

audited, whether it can attach a letter being audited? ( reference letter signed by the person in charge of the company)

12. What about land acquisition progress? Is it already 100%?

The process of land acquisition is still on going. The process will be complete before site take over.

13. Are the bridges in the project links that have a short or long span only get overlay?

There are only routine maintenance works for the existing bridges as listed in Division 10.1.5 and only AC-WC overlay

14. Are there licensing assistance from the committee (Environmental Permit) to basecamp, in order to facilitate our work, if we win the tender?

The committee does not have authority to provide the assistance.

15. Is the equipment capacity can be lowered (stone crusher), by adding the equipment to keep producing material needed?

16. Does the experience of carrying out the work of asphalt concrete and aggregate base with production value indicated on the document during the last 5 years become the administrative requirements that must be met?

17. How is progress of land Acquisition ? Please see answer number 12 18. In Contract data Point 13.8 : “The Price

Adjustment shall be payable after 13 months from commencement of works. But, at the statement below in “Pn : Not applicable”. Why are these contradictive ? because Pn is the adjustment multiplier to be applied to the estimated contract value in the relevant currency of the work carried out in period ?
