FINANCIAL PROTOCOL
RELATING TO FRENCH CREDITS DESTINED FOR THE EC ONOMIC
The Government of the Republic of Indones ia and the Government of the Republic of France have, with a view to facilitate the economic rehabilitation and development e f for ts of Indonesia,agreed on the following p rovisions :
ARTICLE 1
A total amount of one hundre d and thirty five million and six hundred thous ands francs ( F 135 . 600.000) is made at the disposal of the Indonesian Government in the form of a grant and credits to finan -ce the purchase of French commodities and servi-ces by Indonesia .
ARTICLE 2
The entire financial aid consists of :
- A g r a nt from the Frennh Public Treasury to the Indo-nesian Government of fourteen million and six h und r ed thousands francs
(F 14.600.000) destined to finance certa in amortization maturities of guaranteed bank credits, in conjunction with the treasury loans in accor-dance with the provisions ment ioned in Articl e 5 of the presen t textand
to lower the interest rate of these credits.
- A loan from the French Treasury to the Central Bank of Indonesia, acting for account of the I ndonesian Governmen t of thirty six mi llion and five hundred thousands francs ( 36 .500. 000) and bankers' credits guaranteed by the French Treasury of thirty six mill ion and five hundred thousands francs ( F 36 .500.000), making a tot a l of seventy three million francs ( F.73.000.000) destined for financi ng the i mp orta-tion of heavy equipment in accordance with the provisions mentioned in Article
7,
parag raph a, of the p r es ent t ex t.- A loan from the French Tre a sury to the Central Bank of Indonesia, acting for account of the Indonesian Government of twenty four million francs (F.24.000.000) and bankers' credits guaranteed by
t he French Treasury of twenty four million fran cs ( F . 2 4.000 .000 ) ,making • a tot al of fourty eight million francs (F.48.000.000) de stined for
fi-nancing the importa tion of g oods, in accord ance with the p rovisions men-tioned in Art icle
7,
paragraph b, of the present Protocol.ARTICLE 3
The two loans from the French Treasury a r e rep a y abl e in twenty five years by equal and successive semi-annual i ns talments which are cal culated from the date of each drawing and bearing an inte-rest rate of 3,5% per annum, allowing a grace pe riod of seven years .
- The interests du e on the balance are payable at the e nd of each h a l f year . An agreement on the implementation be tween Credit Na tiona l acting for acc ount of the French Government and the Central Bank of Indonesia acting for account of the Indonesian Government will stipu-late the terms and conditions of utilization and reimbursement of these loans .
ARTICLE
4
The guaranteed bankers ' credi ts a r e redeemable in ten years. Their rate of interest is the usual expor t credit rate to which is added the cost of the credit insurance .

- 2 - A financial agreement between the French Institutions and the Central Bank of Indonesia will stipulate the modalities of uti-lization and reimbursement of these guaranteed bankers• credits.
The agreements relating to the bankers' credits intented for financing of heavy equipment of Article 7, paragraph a, will be appro -ved by the Central Bank of Indonesia in case they are not directly signed by this Bank.
ARTICLE 5
The loans from the Treasury and the guaranteed bankers ' credits which are extended run conjunction with the former will be utilised in equal proportions for each contract.
The rights of drawing on the Government loans will thus be equal to half of the value of the ｧｾｯ､ｳ＠ ordered ｾｮ＠ France for each contract .
ARTICLE 6
The grant provided in Article 2 above amounting fourt een million and six hundred thousands francs ( F.14.600.000) will be made availa-ble on march 15 th 1973, and deposited with the Banque Frangaise du Commerce Exterieur to the credit of a special account called "Finan-cial Protocol of January 31 st 1973" .
This amount, increased with the capitalized interest by the B. F . C . E . will enable :
- on one hand , the settlement of four semi annual instalments of the guaranteed bankers ' credits provided in the present protocol,which has itself a grace period of eighteen months;
- on the other hand , for the surplus, a reduction of the rate of interest of the guaranteed bankers 1 ere.di ts; this ｲ｡Ｇｴｾｩｬｬ＠ vary accor
-ding to the conditions mentioned in article 4 .
The Banque Frangaise du Commerce Exterieur and the Central Bank of Indonesia wi ll determine the modalities of the implementation of this Ar ticle.
ARTICLE 7
The means of financing provided for in Article 1 are earmarked to the amount of
a) Sev enty three million francs ( F.73.ooo rooo) for the financin of the importation of such heavy equipment as mentioned in the priori -ty li st of the economic development plan of Indonesia.
b) Fourty ･ｾｧｨｴ＠ million francs ( 4s .ooo.ooo) for the purchase of a l l commodities and productsthe importation of which is eovili!rned , by the fore ign trade regulationsof Indonesia under list8 A, B and C of the Indonesian decree of 24 th of january I967 as amend ed , with the exception of mineral products , raw metals , products of the first trans formation of these metals , weapons , amunitions and military equipment.
Derogations .in favour of items of the D list of above men-tioned decree C11!S amended can be au t hor i sed by the commercial coiuns.ello to the Frerich mbassy in Indonesia .
This credit will be utilized up to ten million francs for purchase of fertilizers .
The minimum unit amount of each order i s fixed at twenty fixe
ARTICLE 8
Each order relating to the heavy equipment under Ar -ticle 7, paragraph a, is subject to a contract between the French Supplier and the Indonesia buyer, the qualification of which into the p resent Protocol requires a prior appro-val of the competent Indonesian and French authorities.
French Franc will be used as currency of account and currency payment of the contracts.
A down-payment equal to 10% of the amount of the con-tract will be paid when placing the order and the balance will be settled between the order and its ｲ･｣･ｾｰｴ＠ in con-formity with the terms and conditions of each ｣ｯｮｴｲ｡｣ｴＬ｢ｾ＠
successively utilizing the means of financing foreseen in Article 2 in accordance with the modalities of Article
5
of the present Protocol.ARTICLE 9
The ultimate date for the drawing up of contracts to be financed under the present Protocol is fixed on December 31 ｳｴＬＱＹＷｾＮ＠
ARTICLE 10
The present Protocol enters into force on the date of its signing.

Le Gouvernement de la Republique de l'Indone sie et le Gouver-nement de la Republique frangaise sont convenus des dispositions
sui-ｶ｡ｾｴ･ｳ＠ en vue de faciliter 11effort de redressement et de ､･ｶ･ｬｯｰｰ･ ｭ ･ｾｴ＠
ec onomique de l'Indonesie.
ARTICLE 1
Une somme globale de CENT TRENTE CINQ MILLIONS SIX CENT MILLE
francs (135.600.000 F.) est mise
a
la disposition du Gouvernementindo-nesien sous forme d'un don et de credits, pour financer l'achat par l'Indonesie de biens et de services frangais.
ARTICLE 2
-L'ensemble de ces concours financiers est constitue par :

4
-Les credits bancaires garantis sont amortissables en dix ans .
Leur taux ､Ｇｩｮｴ･ｲｾｴ＠ est le taux usuel de credit

11exportation, auquels'ajoute le coat de 11assurance-credit.
Un accord financier entre la Banque Centrale de l'Indonesie et l es etablissements bancaires fran9ais precisera les modalites de leur utilisation et de leur remboursement.
Les accords relatifs aux credits bancaires destines au
finan-cement des equipements lourds de l'article
7,
alinea a), serontapprou-ves par la Banque Centrale de l'Indonesie s'ils ne sont pas signes directement par elle.
ARTICLE
5
-Les ｰｲｾｴｳ＠ du Tre sor et les credits bancaires garantis qui l'accompagnent seront, pour chaque contrat, utilises dans une propor-tion egale .
Les droits de tirage sur les ｰｲｾｴｳ＠ du Tresor seront done
egaux

la moitie de la valeur des biens commandas en France au titrede chaque contrat.

B.F.C.E., permettra :
- d'une part, le reglement de quatre semestrialites des credits bancaires garantis prevus au present protocole, qui comporteront
eux-ｭｾｭ･ｳ＠ une periode de differe d'amortissement de dix-huit mois ;
- d'autre part, pour le surplus, une reduction du taux des credits
bancaires garantis , taux qui variera ｬｵｩＭｭｾｭ･＠ dans les conditions
