DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 418/MPP/Kep/4/2002 DATED APRIL 30, 2002
ON
THE FORMATION OF A TEAM IN CHARGE OF SELECTING PROSPECTIVE MEMBERS OF THE
NATIONA; CONSUMERS' PROTECTION BOARD THE MINISTER OF INDUSTRY AND TRADE
Considering :
a. that to form a National Consumers' Protection Board as mandated by Law No. 8/1999 on consumers' protection, it is necessary to form an inter-ministerial team to select prospective members of the National Consumers' Protection Board;
b. that for that purpose, it is necessary to issue a decree of the Minister of Industry and Trade.
In view of :
1. Law No. 8/1999 on consumers' protection (Statute Book of 1999 No. 42, Supplement to Statute Book No. 3821);
2. Presidential Regulation No. 57/2001 on the National Consumers' Protection Board (Statute Book of 2001 No. 102, Supplement to Statute Book No. 4125);
3. Presidential Decree No. 17/2000 on the realization of the state budget;
4. Presidential Decree No. 90/2001 on the formation of Consumers' Dispute Settlement Board at the Municipal Governments of Medan, Palembang, Central Jakarta, West Jakarta, Bandung, Semarang, Yogyakarta, Surabaya, Malang and Makassar (Statute Book of 2001 No. 105);
5. Presidential Decree No. 228/M/2001 on the formation of Mutual-Help Cabinet;
6. Presidential Decree No. 102/2001 on the position, task, function, authority, organizational structure and working system of ministry;
7. Presidential Decree No. 109/2001 on the organizational units and tasks of first echelon officials within a ministry;
8. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organizational structure and working system of the Ministry of Industry and Trade.
DECIDES : To stipulate :
FIRSTLY :
To form a team in charge of selecting prospective members of the National Consumers' Protection Board, hereinafter referred to as the selecting team of BPKN, with the line up attached thereto.
SECONDLY :
The selecting team of BPKN as referred to in the first dictum shall be assigned to :
1. make the guidelines to name prospective members of the National Consumers' Protection Board; 2. make a list of members of the National Consumers' Protection Board ;
3. hold discussions to select prospective members of the National Consumers' Protection Board;
5. prepare a presidential decree on the definitive members of the National Consumers' Protection Board as a result of consultations with the House of Representatives of the Republic of Indonesia (DPR-RI), through the Minister of Industry and Trade for further approval.
THIRDLY :
In carrying out tasks, the Chairman of the Selecting Team of BPKN shall be responsible to and submit a written report to the Minister of Industry and Trade.
FOURTHLY :
To ensure that the team can carry out its tasks smoothly, the Chairman of the Selecting of BPKN can form a secretariat according to the need.
FIFTHLY :
The Selecting Team of BPKN as referred to in the first dictum shall be assigned for 4 (four) months and be declared as being dissolved after the expire of its assignment
SIXTHLY :
All expenses arising from the execution of the tasks of the team shall be borne by the budget of consumers protection project of budget year 2002 of the Ministry of Industry and Trade.
SEVENTLY :
This decree shall begin to take effect on the date of stipulation and be made retroactive to April 1, 2002.
