MEMORANDUM SALING PENGERTIAN ANT ARA

PEMERINTAH REPUBLIK INDONESIA DAN

REPUBLIK RAKYAT SOSIALIS ARAB LIBYA RAY A MENGENAI

PEMBENTUKAN KOMISI BERSAMA

Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Sosialis Arab Libya Raya (selanjutnya disebut "Para Pihak"),

MERUJUK pada Persetujuan Dasar mengenai Kerjasama Ekonomi, llmu Pengetahuan dan Teknik antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Sosialis Arab Libya Raya yang ditandatangani di New York pada tanggal 28 September 1995;

MEMPERTIMBANGKAN bahwa kerjasama tersebut merupakan kepentingan bersama untuk membentuk mekanisme bilateral antara para pihak untuk mendorong kerjasama bilateral kedua negara;

BERKEINGINAN untuk memperluas dan mempercepat kerjasama antara kedua negara dalam bidang-bidang kerjasama yang telah disetujui kedua negara berdasarkan prinsip-prinsip kesetaraan, saling menguntungkan ,

penghormatan penuh terhadap kedaulatan dan ketentuan hukum

internasional;

MEMPERHATIKAN persetujuan yang telah ada antara kedua negara dalam berbagai bidang;

SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di kedua negara;

Pasal 1

Komisi bersama (selanjutnya disebut sebagai "Komisi") akan dilaksanakan pada tingkat Menteri dengan keanggotaan pihak-pihak yang terkait dengan sektor kerjasama Para Pihak;

Pasal2

Komisi akan menjalankan tugas-tugas sebagai berikut:

(a) tukar menukar pandangan dan informasi untuk mendorong kerjasama yang disetujui oleh para pihak;

(b) meninjau kembali pelaksanaan kerjasama dan persetujuan yang telah ada antara Para Pihak;

(c) mengajukan rekomendasi kepada pemerintah kedua negara untuk

mengambil tindakan yang d ianggap perlu untuk melaksanakan

rekomendasi tersebut dalam rangka meningkatkan kerjasama bilateral; dan (d) mengidentifikasi bentuk-bentuk lain dari kerjasama yang disetujui bersama

oleh para pihak.

Pasal 3

Komisi akan bertemu sekali setiap dua tahun. Di antara dua Sidang Komisi Bersama, Komite, Sub-Komite dan/atau Kelompok Kerja dapat bertemu setiap tahun sekali pada tingkat Menteri atau Pejabat Senior untuk menjaga kesinambungan struktur Komisi. Pertemuan tersebut akan dilaksanakan dalam sesi pleno dan dipimpin oleh wakil dari negara tuan rumah. Komite, Sub-Komite, dan Kelompok Kerja dapat bertemu apabila dibutuhkan berdasarkan permintaan salah satu pihak. Dalam hal ini, pertemuan diselenggarakan di negara pihak yang meminta.

Pasal 4

Komisi menetapkan aturan dan prosedur dan dapat membentuk komite, sub-komite, dan/atau kelompok kerja untuk membicarakan isu-isu khusus yang telah disepakati sebelumnya.

Pasal 6

Negara tuan rumah mengusulkan agenda pertemuan dan menyampaikan kepada pihak lain sekurang-kurangnya 2 (dua) bulan sebelum pertemuan dilaksanakan.

Pasal 7

Departemen Luar Negeri Republik Indonesia dan Komite Rakyat untuk Hubungan Luar Negeri dan Kerjasama lnternasional Republik Rakyat Sosialis Arab Libya Raya bertindak sebagai badan pelaksana Memorandung Saling Pengertian.

Pasal 8

Setiap perbedaan dalam interpretasi atau pelaksanaan dari Memorandum Saling Pengertian ini akan diselesaikan secara bersahabat melalui konsultasi antara Para Pihak.

Pasal9

Memorandum Saling Pengertian ini dapat diubah secara tertulis melalui persetujuan Para Pihak. Perubahan tersebut akan berlaku pada tanggal yang ditentukan oleh Para Pihak dan menjadi bagian yang tidak terpisahkan dari Memorandum Saling Pengertian ini.

Pasal 10

1. Memorandum Saling Pengertian ini berlaku sejak tanggal ditandatangani.

2. Memorandum Saling Pengertian ini berlaku untuk jangka waktu 5 (lima) tahun, dan akan tetap berlaku berturut-turut selama 5 (lima) tahun, kecuali salah satu pihak memberitahukan pihak lain tentang keinginannya untuk mengakhiri Memorandum Saling Pengertian ini 6 (enam) bulan sebelumnya.

3. Seluruh mekanisme yang telah dibuat sebelumnya oleh kedua negara akan tetap berlaku.

SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah menandatangani Memorandum Saling Pengertian ini,

DIBUAT dalam rangkap dua di Yogyakarta, pada tanggal dua puluh empat bulan Maret tahun dua ribu sembilan dalam bahasa Indonesia, Arab dan lnggris dan semua naskah memiliki kekuatan hukum yang sama. Apabila terdapat perbedaan penafsiran, naskah bahasa lnggris yang berlaku.

REPUBLIK INDONESIA

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GREAT SOCIALIST PEOPLE'S LIBYAN ARAB JAMAHIRIYA ON

THE ESTABLISHMENT OF THE JOINT COMMISSION

The government of the Republic of Indonesia and the Government of the Great Socialist People's Libyan Arab Jamahiriya (hereinafter referred to as "the Parties");

REFERRING to the Basic Agreement for Economic, Scientific and Technical Cooperation between the Government of the Republic of Indonesia and the Socialist People's Libyan Arab Jamahiriya, signed in New York on 26September1995;

CONSIDERING that it would be in their mutual interest to establish a bilateral mechanism between the Parties for encouraging bilateral cooperation between the two countries;

DESIRING to expand and accelerate the cooperation between the two countries in the areas of cooperation agreed upon by the Parties on the basis of principles of equality, mutual benefit, full respect of sovereignty and provision of international law;

TAKING INTO ACCOUNT the existing Agreements between the two countries in various fields;

PURSUANT TO the prevailing laws and regulations in their respective countries;

Article 1

The Joint Commission (hereinafter referred to as "Commission") shall be formed in the Ministerial level with the membership of concerned sectors in cooperation of the Parties.

Article 2

The Commission shall undertake the following functions:

(a) to exchange views and information on measures to encourage areas of cooperation agreed upon by the Parties;

(b) to review the implementation of the existing cooperation and agreements between the Parties;

(c) to propose recommendations to the respective governments and take necessary measures to implement such recommendation in order to enhance the bilateral cooperation ; and

(d) to identify other forms of cooperation mutually agreed upon by the Parties.

Article 3

The Commission shall meet once every two years. In between of two Joint Commission Meetings, Committee, Sub-Committee, and/or Working Group at Ministerial or Senior Official level may meet annually to maintain the sustainability of the structure of the Commission. The Meeting shall convene in plenary session and chaired by the representative of the host country. The committee, sub-committee, and/or Working Group may meet as deemed necessary based on the request of either Party. In this case, the meeting is conducted in the requesting Party's Country.

Article 4

The Commission shall determine its rules and procedures and may establish committee, sub-committee, and/or Working Group to deal with specific issues brought before it.

Article 6

The host country shall propose the agenda of the meeting and shall be presented to the other party at least 2 (two) months prior to the meeting.

Article 7

The Department of Foreign Affairs of the Republic of Indonesia and the General People's Committee for Foreign Liaison and International Cooperation of the Great Socialist People's Libyan Arab Jamahiriya shall be the executive body of the Memorandum of Understanding

Article 8

Any differences regarding the interpretation or application of this Memorandum of Understanding shall be resolved amicably by consultation between the Parties.

Article 9

This Memorandum of Understanding may be amended in writing by mutual consent of the Parties. Such amendment shall come into effect on such date as determined by the Parties and shall form an integral part of this Memorandum of Understanding.

Article 10

1. This Memorandum of Understanding shall become effective on the date of signature

2. This Memorandum of Understanding shall be valid for a period of 5 (five) years, and shall remain valid for consecutive period of 5 (five) years, unless either Party notifies the other, 6 (six) months in advance of its decision of terminating the Memorandum of Understanding.

3. All existing mechanism made previously by both Countries shall continue to function unaffected

IN WITNESS WHEREOF, the undersigned, have signed the Memorandum of Understanding.

DONE in duplicate, at Yogyakarta, on this twenty fourth day of March in the

year two thousand and nine, in Indonesian, Arabic and English languages and all text are being equally authentic. In case of any divergence of interpretation, the English texts shall prevail.
