PRESDIENTIAL INSTRUCTION NO. 2/2002 DATED MARCH 13, 2002
ON
CONTROL OVER SEA SAND MINING
THE PRESIDENT OF THE REPUBLIC OF INDONESIA,
Considering :
a. that in the framework of maximizing the utilization of sea sand, mining, exploitation and export of sea sand for interests of national development need to be controlled by observing the conservation of ecosystem in mining areas of sea sand;
b. that in relation thereto, it is deemed necessary to issue a presidential instruction on control over sea sand mining.
In view of :
1. Article 4 paragraph (1) of the Constitution of 1945 as already amended by the Third Amendment to the Constitution of 1945;
2. Law No. 11/1967 concerning mining basic provisions (Statute Book of 1967 No. 22, Supplement to Statute Book No. 2831);
3. Law No. 3/1985 on fishery (Statute Book of 1985 No. 16, Supplement to Statute Book No. 3209);
4. Law No. 23/1997 on the environmental management (Statute Book of 1997 No. 68, Supplement to Statute Book No. 3699);
5. Law No. 22/1999 on regional administration (Statute Book of 1999 No. 60, Supplement to Statute Book No. 3839);
6. Government Regulation No. 25/2000 on the authority of the government and the authority of provinces as autonomous regions (Statute Book of 2000 No. 54, Supplement to Statute Book No. 3952);
INSTRUCTS :
1. The Minister of Home Affairs; 2. The Minister of Industry and Trade; 3. The Minister of Marine and Fishery;
4. The Minister of Energy and Mineral Resources; 5. The Minister of Forestry;
6. The State Minister for Environment; 7. The Indonesian Military Commander; 8. The Indonesian Police Chief;
9. Governors; 10.Regents/Mayors.
To observe the following provisions :
FIRST :
To coordinate and prepare legislation on the arrangement and supervision over the implementation of sea sand mining, exploitation and export systems integratedly.
SECOND :
b. The Minister of Industry and Trade shall coordinate the arrangement of sea-sand exploitation and export systems.
c. The Minister of Marine and Fishery shall coordinate aspects of marine lay-out, coastal areas and conservation of marine and fishery resources in regions where sea-sand mining, exploitation and export activities are executed.
d. The Minister of Energy and Mineral Resources shall coordinate aspects of supervision over production and mining techniques of sea sand.
e. The Minister of Forestry shall coordinate aspects of conservation of biological resources and their ecosystems in regions sea-sand mining, exploitation and export activities are executed.
f. The State Minister for Environment shall coordinate environmental aspects connected with sea-sand mining, exploitation and export activities.
g. The Indonesian Military Commander shall coordinate national security aspects connected with sea-sand mining, exploitation and export activities.
h. The Indonesian Police Chief shall coordinate aspects of supervision and police affairs connected with sea-sand mining, exploitation and export activities.
i. Governors and regents/mayors shall freeze licenses to mine sea sand provisionally and shall not issue new licenses in accordance with their respective fields of authority and coordinate the central government with regard to with sea-sand mining, exploitation and export activities.
THIRD :
To ensure the smooth execution of the tasks mentioned in FIRST and SECOND Dictum, a coordinating team led by the Minister of Marine and Fishery shall be established.
FOURTH :
The coordinating team shall have completed the legislation as meant in FIRST Dictum not later than May 18, 2002.
FIFTH :
Every institution concerned shall help ensure the smooth implementation of this presidential instruction.
This presidential instruction shall come into force as from the date of issuance.
