Introduction

The Internationa l Conventio n fo r th e Preventio n o f Pollutio n fro m Ships , 197 3 (MARPO L Convention) , wa s adopted b y the Internationa l Conferenc e on Marin e Pollutio n convene d b y the Internationa l Maritim e Organi- zation (IMO ) fro m 8 Octobe r t o 2 Novembe r 1973 . Protoco l I (Provision s concernin g report s o n incident s involving Harmfu l Substances ) an d Protoco l I I (Arbitration ) wer e adopte d a t th e sam e Conference . Thi s Convention wa s subsequentl y modifie d b y th e Protoco l o f 197 8 relatin g thereto , whic h wa s adopte d b y th e International Conferenc e o n Tanke r Safet y an d Pollutio n Preventio n (TSP P Conference ) convene d b y IM O from 6 to 17 Februar y 1978. The Convention, a s modified by the 197 8 Protocol, i s known as the "International Convention fo r th e Preventio n o f Pollutio n fro m Ships , 1973 , a s modifie d b y th e Protoco l o f 197 8 relatin g thereto", or , i n shor t form , "MARPO L 73/78" . Regulation s coverin g th e variou s source s o f ship-generate d pollution ar e contained i n th e five Annexes of the Convention. Th e Convention ha s als o been modifie d b y the Protocol o f 1997, whereb y a sixth Anne x was added. I t may be note d that the Marine Environmen t Protectio n Committee (MEPC), at its fifty-sixth session, decide d that, when referrin g to the Convention and it s six Annexes as a whole, th e term "MARPOL " shoul d b e preferred to "MARPOL 73/78" , a s the latte r would leav e Annex VI on Preventio n o f air pollution fro m ships , whic h ha d bee n adopte d b y the 199 7 Protocol , outsid e it s scope .

The Marin e Environmen t Protectio n Committee , sinc e it s inceptio n i n 1974 , ha s reviewe d variou s provision s of the MARPO L Conventio n tha t hav e bee n foun d t o requir e clarificatio n o r hav e give n ris e t o difficultie s i n implementation. I n orde r to resolv e suc h ambiguitie s an d difficultie s i n a unifor m manner , th e MEP C agree d that i t was desirabl e to develo p unifie d interpretations . I n certai n cases , th e MEP C recognize d that there was a nee d t o amen d existin g regulation s o r t o introduc e ne w regulation s wit h th e ai m o f reducin g eve n furthe r operational an d accidenta l pollutio n fro m ships . Thes e activitie s b y th e MEP C hav e resulte d i n a numbe r o f unified interpretation s an d amendment s t o th e Convention .

The purpos e o f thi s publicatio n i s t o provid e a n eas y referenc e t o th e up-to-dat e provision s an d unifie d interpretations o f the articles, protocol s an d Annexe s of the MARPO L Convention , includin g the incorporatio n of all o f the amendments that hav e bee n adopte d b y the MEP C an d hav e entered int o force, u p to and includ - ing the 201 0 amendment s (a s adopte d b y resolutio n MEPC.190(60 ) an d MEPC.194(61)") . I t shoul d b e noted , however, tha t the Secretariat has n o intentio n o f changing the authentic texts editorially or otherwise. THE PARTIE S T O THE CONVENTION ,

BEING

CONSCIOUS of the need to preserve the human environment in general and the marine environment in particular,

RECOGNIZING that deliberate, negligen t or accidental releas e of oil an d other harmful substance s from ship s constitutes a serious source of pollution,

RECOGNIZING ALSO the importance of the International Convention for the Prevention of Pollution of the Sea by Oil, 1954 , as being the first multilateral instrumen t to be concluded with the prime objective of protecting the environment, and appreciating the significant contribution which that Convention has made in preserving the seas and coastal environment from pollution,

DESIRING to achieve the complet e elimination o f intentional pollutio n o f the marin e environment by oil an d other harmful substance s and the minimization of accidental discharge of such substances,

CONSIDERING that this object may best be achieved by establishing rules not limited to oil pollution having a universal purport ,

HAVE AGREE D a s follows :

Article 1

General obligations under the Convention

(1) Th e Partie s to the Convention undertak e to give effect to the provisions of the present Convention an d those Annexe s theret o b y whic h the y ar e bound , i n orde r t o preven t the pollutio n o f the marin e environ - ment by the discharge of harmful substance s or effluents containing such substance s i n contraventio n o f the Convention.

(2) Unles s expressly provided otherwise, a reference to the present Convention constitutes at the same time a reference to its Protocols and to the Annexes.

Article 2 Definitions

For the purposes of the present Convention, unles s expressly provided otherwise:

(1)

Regulation

means the regulations contained in the Annexes to the present Convention.

(2)

Harmful substance

mean s an y substanc e which, i f introduce d int o the sea, i s liabl e to creat e hazard s

to huma n health , t o har m livin g resource s an d marin e life , t o damag e amenitie s o r to interfer e wit h othe r

legitimate uses of the sea, and include s any substance subject to control by the present Convention.

release howsoever caused from a ship and includes any escape, disposal, spilling, leaking , pumping, emitting o r emptying ;

(b) Discharge doe s no t include :

(i) dumpin g withi n th e meanin g o f th e Conventio n o n th e Preventio n o f Marin e Pollutio n b y Dumping of Wastes an d Othe r Matter , don e a t Londo n o n 1 3 Novembe r 1972 ; o r

(ii) releas e o f harmfu l substance s directl y arisin g fro m th e exploration , exploitatio n an d associ - ated offshor e processing of sea-bed minera l resources ; o r

(iii) releas e o f harmfu l substance s fo r purpose s o f legitimat e scientifi c researc h int o pollutio n abatement o r control .

(4) Ship mean s a vessel o f any type whatsoever operating i n th e marin e environment and include s hydrofoi l boats, air-cushio n vehicles , submersibles , floatin g craft and fixed or floating platforms .

(5) Administration mean s th e Governmen t o f th e Stat e unde r whos e authorit y th e shi p i s operating . Wit h respect to a shi p entitle d t o fl y a fla g o f an y State , th e Administratio n i s th e Governmen t o f that State . Wit h respect t o fixe d o r floatin g platform s engage d i n exploratio n an d exploitatio n o f th e sea-be d an d subsoi l thereof adjacen t t o th e coas t ove r whic h th e coasta l Stat e exercise s sovereig n right s fo r th e purpose s o f exploration an d exploitatio n o f thei r natura l resources , th e Administratio n i s th e Governmen t o f th e coasta l State concerned.

(6) Incident mean s a n even t involvin g th e actua l o r probabl e discharg e int o th e se a o f a harmfu l substance , or effluents containin g suc h a substance .

(7) Organization mean s th e Inter-Governmenta l Maritim e Consultativ e Organization. *

Article 3

Application

(1) Th e presen t Convention shal l appl y to :

(a) ship s entitle d t o fly the flag of a Part y to the Convention ; an d

(b) ship s no t entitled t o fly the flag o f a Part y bu t which operat e unde r the authorit y o f a Party . (2) Nothin g i n th e presen t articl e shal l b e construe d a s derogatin g fro m o r extendin g th e sovereig n right s of th e Partie s unde r internationa l la w ove r th e sea-be d an d subsoi l thereo f adjacen t t o thei r coast s fo r th e purposes o f exploration an d exploitatio n o f their natura l resources .

(3) Th e presen t Convention shal l no t apply to an y warship, nava l auxiliar y o r othe r shi p owne d o r operate d by a Stat e an d used , fo r th e tim e being , onl y o n governmen t non-commercia l service . However , eac h Part y shall ensur e b y th e adoptio n o f appropriat e measure s no t impairin g the operation s o r operationa l capabilitie s of such ship s owne d o r operated b y it , tha t such ship s ac t i n a manne r consistent, s o far as i s reasonabl e an d practicable, wit h th e presen t Convention.

Article 4 Violation

(1) An y violatio n o f the requirement s o f the presen t Conventio n shal l b e prohibite d an d sanction s shal l b e established therefo r unde r the la w o f the Administratio n o f the shi p concerne d whereve r the violatio n occurs . If th e Administratio n i s informe d o f suc h a violatio n an d i s satisfie d tha t sufficien t evidenc e i s availabl e t o enable proceeding s t o b e brough t i n respec t o f th e allege d violation , i t shal l caus e suc h proceeding s t o b e taken a s soon a s possible, i n accordanc e with it s law .

Whenever suc h a violatio n occurs , tha t Part y shal l either :

(a) caus e proceeding s to b e taken i n accordanc e with it s law ; o r

(b) furnis h t o the Administration o f the ship suc h informatio n an d evidenc e as ma y b e i n it s possessio n that a violation ha s occurred .

(3) Wher e informatio n o r evidenc e wit h respec t t o an y violatio n o f th e presen t Conventio n b y a shi p i s furnished t o th e Administratio n o f tha t ship , th e Administratio n shal l promptl y infor m th e Part y whic h ha s furnished th e informatio n o r evidence , an d th e Organization , o f the actio n taken .

(4) Th e penaltie s specifie d unde r th e la w o f a Part y pursuan t t o th e presen t articl e shal l b e adequat e i n severity t o discourag e violation s o f the presen t Conventio n an d shal l b e equall y sever e irrespectiv e o f where the violation s occur .

Article 5

Certificates and special rules on inspection of ships

(1) Subjec t t o th e provision s o f paragrap h (2 ) o f the presen t articl e a certificat e issue d unde r th e authorit y of a Part y t o th e Conventio n i n accordanc e wit h th e provision s o f th e regulation s shal l b e accepte d b y th e other Partie s an d regarde d fo r all purpose s covere d b y the presen t Convention a s havin g the sam e validity a s a certificat e issue d b y them.

(2) A ship require d to hol d a certificate i n accordanc e with the provisions o f the regulation s i s subject , whil e in th e port s o r offshor e terminal s unde r th e jurisdictio n o f a Party , t o inspectio n b y officer s dul y authorize d by that Party . An y such inspectio n shal l b e limite d to verifying that there i s on boar d a valid certificate, unles s there ar e clea r ground s fo r believin g tha t th e conditio n o f th e shi p o r it s equipmen t doe s no t correspon d substantially with th e particular s of that certificate. I n tha t case, o r i f the ship does no t carry a valid certificate , the Part y carrying out the inspectio n shal l tak e such step s as will ensur e that the ship shal l no t sail unti l i t can proceed to sea without presenting an unreasonabl e threat of harm to the marin e environment. Tha t Party may, however, gran t such a shi p permissio n t o leav e the por t or offshor e termina l fo r the purpos e o f proceeding to the neares t appropriat e repai r yar d available .

(3) I f a Part y denie s a foreig n shi p entr y t o the port s o r offshor e terminals unde r it s jurisdiction o r takes an y action agains t suc h a shi p fo r th e reaso n tha t th e shi p doe s no t compl y wit h th e provision s o f th e presen t Convention, th e Part y shall immediatel y infor m th e consul o r diplomatic representativ e of the Part y whose flag the shi p i s entitle d t o fly , o r i f this i s no t possible , th e Administratio n o f the shi p concerned . Befor e denyin g entry o r taking such actio n th e Part y ma y reques t consultation wit h th e Administration o f the ship concerned . Information shal l als o b e give n t o the Administration whe n a shi p does no t carry a valid certificat e i n accord - ance wit h th e provision s o f the regulations .

(4) Wit h respec t t o th e shi p o f non-Partie s t o th e Convention , Partie s shal l appl y th e requirement s o f the present Convention a s ma y b e necessar y t o ensur e tha t n o mor e favourable treatment i s give n t o suc h ships .

Article 6

Detection of violations and enforcement of the Convention

(1) Partie s t o th e Conventio n shal l co-operat e i n th e detectio n o f violation s an d th e enforcemen t o f th e provisions o f th e presen t Convention , usin g al l appropriat e an d practicabl e measure s o f detectio n an d environmental monitoring , adequat e procedure s fo r reportin g an d accumulatio n o f evidence.

(2) A ship to which the present Convention applie s may , i n an y port or offshore terminal o f a Party , b e subject to inspectio n b y officer s appointe d o r authorized b y that Part y for the purpos e of verifying whether the ship ha s discharged an y harmfu l substance s i n violatio n o f the provision s o f the regulations . I f an inspectio n indicate s a violation o f the Convention , a repor t shall b e forwarded t o the Administratio n fo r any appropriat e action .

(4) Upo n receivin g suc h evidence , th e Administratio n s o informe d shal l investigat e th e matter , an d ma y request th e othe r Part y t o furnis h furthe r o r bette r evidenc e o f th e allege d contravention . I f th e Administra - tion i s satisfie d tha t sufficien t evidenc e i s availabl e t o enabl e proceeding s t o b e brough t i n respec t o f th e alleged violation , i t shall caus e suc h proceeding s to b e taken i n accordanc e with it s la w a s soo n a s possible . The Administratio n shal l promptl y infor m th e Part y whic h ha s reporte d th e allege d violation , a s wel l a s th e Organization, o f the actio n taken .

(5) A Part y ma y als o inspec t a shi p t o whic h th e presen t Conventio n applie s whe n i t enter s th e port s o r offshore terminals under its jurisdiction, i f a request for an investigatio n i s received from any Party together with sufficient evidence that the ship ha s discharge d harmfu l substance s o r effluents containin g such substance s i n any place . Th e repor t of such investigatio n shal l b e sent to the Part y requestin g i t and to the Administration s o that the appropriat e actio n ma y b e taken unde r the presen t Convention.

Article 7

Undue delay to ships

(1) Al l possibl e effort s shal l b e mad e t o avoi d a shi p bein g undul y detaine d o r delaye d unde r article s 4 , 5 or 6 o f the presen t Convention .

(2) Whe n a ship i s undul y detained or delayed unde r articles 4, 5 o r 6 of the present Convention, i t shall b e entitled t o compensatio n fo r an y los s o r damag e suffered .

Article 8

Reports on incidents involving harmful substances

(1) A repor t of an inciden t shall b e mad e withou t delay t o th e fullest extent possible i n accordanc e wit h th e provisions o f Protoco l I t o the presen t Convention.

(2) Eac h Part y to the Convention shall :

(a) mak e al l arrangement s necessar y fo r a n appropriat e office r o r agenc y t o receiv e an d proces s al l reports o n incidents ; an d

(b) notif y the Organizatio n wit h complet e detail s o f such arrangement s fo r circulatio n t o othe r Partie s and Membe r State s o f the Organization .

(3) Wheneve r a Part y receive s a repor t unde r the provision s o f the presen t article , tha t Part y shal l rela y the report without dela y to :

(a) th e Administration o f the shi p involved ; an d (b) an y othe r Stat e which ma y b e affected .

(4) Eac h Part y t o th e Conventio n undertake s t o issu e instruction s t o it s maritim e inspectio n vessel s an d aircraft and to other appropriate services, t o repor t to it s authorities any inciden t referred to i n Protoco l I to the present Convention. Tha t Part y shall , i f i t considers i t appropriate, repor t accordingly to the Organizatio n an d to an y othe r Part y concerned .

Article 9

Other treaties and interpretation

(1) Upo n it s entr y int o force , th e presen t Conventio n supersede s th e Internationa l Conventio n fo r th e Prevention o f Pollution o f the Sea by Oil, 1954 , a s amended, a s betwee n Partie s to that Convention.

(2) Nothin g i n th e presen t Conventio n shal l prejudic e th e codificatio n an d developmen t o f th e la w o f the sea b y th e Unite d Nation s Conferenc e o n th e La w o f the Se a convene d pursuan t to resolutio n 275 0 C(XXV ) of the Genera l Assembl y o f the Unite d Nation s no r th e presen t o r future claim s an d lega l view s o f any Stat e concerning the la w o f the se a an d th e natur e an d exten t of coastal an d fla g Stat e jurisdiction.

(3) Th e ter m "jurisdiction " i n th e presen t Conventio n shal l b e construe d i n th e ligh t o f internationa l la w i n force a t the tim e o f application o r interpretatio n o f the presen t Convention .

Article 10

Settlement of disputes

Any disput e betwee n tw o o r mor e Partie s t o th e Conventio n concernin g th e interpretatio n o r applicatio n o f the present Convention shall , i f settlement by negotiatio n betwee n th e Partie s involve d ha s no t been possible , and i f these Partie s d o no t otherwise agree, b e submitted upo n reques t of any of them t o arbitratio n a s se t out in Protoco l I I t o the presen t Convention.

Article 11

Communication of information

(1) Th e Partie s t o the Conventio n undertak e to communicat e to th e Organization :

(a) th e tex t o f laws , orders , decree s an d regulation s an d othe r instrument s whic h hav e bee n promul - gated o n th e variou s matter s withi n th e scop e o f the presen t Convention;

(b) a lis t of non-governmenta l agencie s whic h ar e authorize d t o ac t o n thei r behal f i n matter s relatin g to the design, constructio n an d equipmen t of ships carrying harmfu l substance s i n accordanc e with the provision s o f the regulations; *

(c) a sufficien t numbe r of specimens o f their certificate s issue d unde r the provision s o f the regulations ; (d) a lis t o f receptio n facilitie s includin g thei r location , capacit y an d availabl e facilitie s an d othe r

characteristics;

(e) officia l report s o r summaries o f official report s i n s o far a s the y sho w the result s o f the applicatio n of the presen t Convention; an d

(f) a n annua l statistica l report , i n a for m standardize d b y th e Organization , o f penaltie s actuall y imposed fo r infringemen t o f the presen t Convention .

(2) Th e Organizatio n shal l notif y Partie s o f th e receip t o f an y communication s unde r th e presen t articl e and circulat e to al l Partie s an y informatio n communicate d t o i t unde r subparagraph s (1)(b ) t o (f ) o f the presen t article.

Article 12

Casualties to ships

(1) Eac h Administratio n undertake s to conduc t a n investigatio n o f any casualt y occurrin g to an y o f it s ship s subject to th e provision s o f the regulation s i f such casualt y ha s produce d a majo r deleteriou s effec t upo n th e marine environment .

(2) Eac h Part y t o th e Conventio n undertake s t o suppl y th e Organizatio n wit h informatio n concernin g th e findings o f such investigation , whe n i t judges that such informatio n ma y assist i n determinin g what changes i n the presen t Conventio n migh t b e desirable .

Article 14

Optional Annexes

(1) A State ma y at the time of signing, ratifying , accepting , approvin g or acceding to the present Convention declare tha t i t doe s no t accep t an y on e o r al l o f Annexe s III , I V an d V (hereinafte r referre d t o a s "Optiona l Annexes") o f the presen t Convention. Subjec t to the above , Partie s to th e Conventio n shal l b e boun d b y an y Annex i n it s entirety .

(2) A Stat e whic h ha s declare d tha t i t i s no t boun d b y a n Optiona l Anne x ma y a t an y tim e accep t suc h Annex b y depositin g with th e Organizatio n a n instrumen t of the kin d referre d t o i n articl e 13(2) .

(3) A Stat e whic h make s a declaratio n unde r paragrap h (1 ) o f the presen t articl e i n respec t o f a n Optiona l Annex an d whic h ha s no t subsequently accepte d tha t Annex i n accordanc e with paragrap h (2 ) o f the presen t article shal l no t b e unde r an y obligatio n no r entitle d t o clai m an y privilege s unde r th e presen t Conventio n in respec t o f matter s relate d t o suc h Anne x an d al l reference s t o Partie s i n th e presen t Conventio n shal l no t include that State i n s o far as matter s relate d t o suc h Anne x ar e concerned.

(4) Th e Organization shal l infor m the State s which hav e signed o r acceded t o the present Convention o f any declaration unde r the presen t article as well a s the receip t of any instrumen t deposited i n accordanc e with the provisions o f paragraph (2 ) o f the presen t article .

Article 15 Entry in force

(1) Th e presen t Convention shal l ente r int o force 1 2 month s afte r the date on whic h no t les s than 1 5 States , the combine d merchan t fleets o f which constitut e no t les s than 5 0 pe r cen t of the gross tonnage of the world's merchant shipping , hav e becom e partie s to i t i n accordanc e with articl e 13 .

(2) A n Optiona l Anne x shal l ente r int o force 1 2 month s afte r the dat e on whic h th e condition s stipulate d i n paragraph (1 ) o f the presen t article hav e bee n satisfie d i n relatio n t o tha t Annex.

(3) Th e Organizatio n shal l infor m th e State s whic h hav e signe d th e presen t Conventio n o r accede d t o i t of th e dat e o n whic h i t enter s int o forc e an d o f th e dat e o n whic h a n Optiona l Anne x enter s int o forc e i n accordance with paragrap h (2 ) o f the presen t article.

(4) Fo r State s whic h hav e deposite d a n instrumen t o f ratification , acceptance , approva l o r accessio n i n respect o f th e presen t Conventio n o r an y Optiona l Anne x afte r th e requirement s fo r entr y int o forc e thereo f have been me t but prior to the date of entry int o force, th e ratification , acceptance , approva l o r accession shal l take effec t o n th e dat e o f entry int o forc e o f the Conventio n o r suc h Anne x o r thre e month s afte r th e dat e o f deposit o f the instrumen t whichever i s th e late r date .

(5) Fo r State s whic h hav e deposite d a n instrumen t o f ratification , acceptance , approva l o r accessio n afte r the dat e o n whic h th e Conventio n o r a n Optiona l Anne x entere d int o force , th e Conventio n o r the Optiona l Annex shal l becom e effectiv e thre e month s afte r the dat e o f deposit of the instrument .

(6) Afte r the date on whic h al l the conditions require d unde r article 1 6 to bring an amendmen t to the present Convention o r a n Optiona l Anne x int o forc e hav e bee n fulfilled , an y instrumen t o f ratification , acceptance , approval o r accession deposite d shal l appl y to th e Conventio n o r Annex a s amended .

Article 16

Amendments

(1) Th e present Convention ma y be amended b y any of the procedures specified i n the following paragraphs.

(2) Amendment s afte r consideratio n b y th e Organization :

(a) an y amendment proposed b y a Part y to the Convention shal l b e submitted to the Organization an d circulated b y it s Secretary-Genera l t o al l Member s o f the Organizatio n an d al l Partie s a t leas t si x months prio r to it s consideration ;

(b) an y amendmen t propose d an d circulate d a s abov e shal l b e submitte d t o a n appropriat e bod y b y the Organizatio n fo r consideration ;

(c) Partie s to the Convention, whethe r or not Members of the Organization, shal l b e entitled to partici- pate i n th e proceeding s o f the appropriat e body ;

(d) amendment s shall b e adopted b y a two-thirds majorit y of only the Partie s to the Convention presen t and voting ;

(e) i f adopted i n accordanc e with subparagrap h (d ) above , amendment s shall b e communicated b y the Secretary-General o f the Organizatio n t o al l th e Partie s t o th e Conventio n fo r acceptance ;

(f) a n amendmen t shall b e deeme d t o hav e bee n accepte d i n th e following circumstances :

(i) a n amendmen t t o a n articl e o f th e Conventio n shal l b e deeme d t o hav e bee n accepte d o n the date on whic h i t i s accepte d b y two thirds o f the Parties , th e combined merchan t fleets o f which constitut e no t les s tha n 5 0 pe r cent of the gross tonnag e o f the world's merchan t fleet;

(ii) a n amendmen t t o a n Anne x t o th e Conventio n shal l b e deeme d t o hav e bee n accepte d i n accordance wit h th e procedur e specifie d i n subparagrap h (f)(iii ) unles s th e appropriat e body , at th e tim e o f it s adoption , determine s tha t th e amendmen t shal l b e deeme d t o hav e bee n accepted o n th e dat e o n whic h i t i s accepte d b y tw o third s o f th e Parties , th e combine d merchant fleet s o f whic h constitut e no t les s tha n 5 0 pe r cen t o f th e gros s tonnag e o f th e world's merchan t fleet. Nevertheless , a t any time before the entry int o force of an amendmen t to an Anne x to the Convention , a Part y ma y notif y the Secretary-General o f the Organizatio n that it s express approva l wil l b e necessar y befor e the amendmen t enters int o forc e for it . Th e latter shal l brin g such notificatio n an d th e dat e o f it s receip t to th e notic e o f Parties ;

(iii) a n amendmen t t o a n appendi x t o a n Anne x t o th e Conventio n shal l b e deeme d t o hav e been accepte d a t th e en d o f a perio d t o b e determine d b y th e appropriat e bod y a t th e tim e of it s adoption , whic h perio d shal l b e no t les s tha n te n months , unles s withi n tha t period a n objection i s communicate d t o the Organization b y no t les s than on e third o f the Partie s or b y the Partie s th e combine d merchan t fleets o f which constitut e no t les s than 5 0 pe r cen t of the gross tonnag e o f the world' s merchan t fleet whichever condition i s fulfilled ;

the amendment s to the Annexe s to the Convention , a s provide d fo r i n subparagraph s (f)(ii ) o r (f)(iii) above ;

(v) a n amendmen t to Protoco l I I to the Convention shal l b e subject to the same procedures as for the amendments to an articl e of the Convention, a s provide d for i n subparagrap h (f)(i ) above ; (g) th e amendmen t shall ente r int o force unde r the following conditions :

(i) i n th e cas e o f an amendmen t to a n articl e o f the Convention , t o Protoco l II , o r t o Protoco l I or t o a n Anne x t o th e Conventio n no t unde r th e procedur e specifie d i n subparagrap h (f)(iii) , the amendmen t accepted i n conformit y with the foregoing provision s shal l ente r int o force six months afte r th e dat e o f it s acceptanc e wit h respec t t o th e Partie s whic h hav e declare d tha t they hav e accepte d it ;

(ii) i n the case of an amendmen t to Protoco l I , t o an appendi x to an Anne x or to an Anne x to the Convention unde r th e procedur e specifie d i n subparagrap h (f)(iii) , th e amendmen t deeme d to hav e bee n accepte d i n accordanc e with th e foregoing condition s shal l ente r int o force si x months afte r it s acceptanc e fo r al l th e Partie s wit h th e exceptio n o f those which , befor e tha t date, hav e mad e a declaratio n tha t they do no t accept i t or a declaration unde r subparagraph (f)(ii), tha t their express approva l i s necessary .

(3) Amendmen t b y a Conference :

(a) Upo n th e reques t o f a Party , concurre d i n b y a t leas t on e thir d o f th e Parties , th e Organizatio n shall conven e a Conferenc e o f Partie s t o th e Conventio n t o conside r amendment s t o th e presen t Convention.

(b) Ever y amendmen t adopte d b y suc h a Conferenc e b y a two-third s majorit y o f thos e presen t an d voting o f th e Partie s shal l b e communicate d b y th e Secretary-Genera l o f th e Organizatio n t o al l Contracting Partie s fo r thei r acceptance .

(c) Unles s the Conference decides otherwise, th e amendment shall b e deemed to hav e been accepte d and t o hav e entere d int o forc e i n accordanc e wit h th e procedure s specifie d fo r tha t purpos e i n paragraph (2)(f ) and (g ) above.

(4) (a ) I n th e cas e o f an amendmen t to a n Optiona l Annex , a referenc e i n th e presen t article t o a "Part y to the Convention " shal l b e deeme d t o mea n a referenc e to a Part y boun d b y that Annex.

(b) An y Part y which ha s declined to accept an amendmen t to an Anne x shall b e treated a s a non-Part y only fo r the purpos e o f application o f that amendment .

(5) Th e adoptio n an d entr y int o forc e o f a ne w Anne x shal l b e subjec t t o th e sam e procedure s a s fo r th e adoption an d entr y int o force o f an amendmen t to a n articl e o f the Convention .

(6) Unles s expressly provided otherwise , an y amendment to the presen t Convention mad e unde r this article , which relate s t o the structur e o f a ship , shal l appl y onl y to ship s for which th e buildin g contract i s placed , o r in th e absenc e o f a buildin g contract, th e kee l o f which i s laid , o n o r after the dat e o n whic h th e amendmen t comes int o force .

(7) An y amendmen t to a Protoco l o r to an Anne x shall relat e to the substanc e of that Protoco l o r Annex and shall b e consisten t with th e article s o f the presen t Convention.

(8) Th e Secretary-Genera l o f the Organizatio n shal l infor m al l Partie s o f any amendment s whic h ente r int o force unde r the presen t article, togethe r with th e dat e on whic h eac h suc h amendmen t enters int o force.

(9) An y declaratio n o f acceptanc e o r o f objectio n t o a n amendmen t unde r th e presen t articl e shal l b e notified i n writin g t o th e Secretary-Genera l o f th e Organization . Th e latte r shal l brin g suc h notificatio n an d the dat e o f it s receip t to the notic e o f the Partie s t o th e Convention .

Article 17

Promotion of technical co-operation

The Partie s t o th e Conventio n shal l promote , i n consultatio n wit h th e Organizatio n an d othe r internationa l bodies, wit h assistanc e an d co-ordinatio n b y th e Executiv e Directo r o f th e Unite d Nation s Environmen t Programme, suppor t for those Partie s whic h reques t technical assistanc e for:

(a) th e trainin g o f scientific an d technica l personnel ;

(b) th e suppl y o f necessar y equipmen t an d facilitie s fo r receptio n an d monitoring ;

(c) th e facilitatio n o f othe r measure s an d arrangement s t o preven t o r mitigat e pollutio n o f the marin e environment b y ships ; an d

(d) th e encouragemen t o f research ;

preferably withi n th e countrie s concerned , s o furtherin g the aim s an d purpose s o f the presen t Convention.

Article 18 Denunciation

(1) Th e presen t Convention o r any Optiona l Anne x ma y b e denounce d b y an y Partie s t o th e Conventio n a t any time after the expiry of five years from th e date o n whic h th e Convention o r such Anne x enter s int o force for tha t Party .

(2) Denunciatio n shal l b e effecte d b y notificatio n i n writin g t o th e Secretary-Genera l o f the Organizatio n who shall infor m al l th e other Partie s o f any suc h notificatio n receive d an d o f the dat e of its receip t as well a s the date o n whic h suc h denunciatio n take s effect .

(3) A denunciatio n shal l tak e effec t 1 2 month s afte r receip t o f th e notificatio n o f denunciatio n b y th e Secretary-General o f the Organizatio n o r afte r th e expir y o f any othe r longe r perio d whic h ma y b e indicate d in the notification .

Article 19

Deposit and registration

(1) Th e presen t Conventio n shal l b e deposite d wit h th e Secretary-Genera l o f th e Organizatio n wh o shal l transmit certified tru e copie s thereo f to al l State s whic h hav e signe d th e presen t Convention o r accede d t o it . (2) A s soo n a s th e presen t Conventio n enter s int o force , th e tex t shal l b e transmitte d b y th e Secretary - General o f the Organizatio n t o th e Secretary-Genera l o f the Unite d Nation s fo r registratio n an d publication , in accordanc e with Articl e 10 2 o f the Charte r of the Unite d Nations .

Article 20 Languages

The present Convention i s established i n a single copy i n the English , French , Russia n an d Spanish languages , each tex t being equally authentic. Officia l translation s i n th e Arabic, German , Italia n an d Japanese language s shall b e prepare d an d deposite d with th e signed original.

Article II

Implementation of Annex II of the Convention

1 Notwithstandin g th e provision s o f articl e 14(1 ) o f th e Convention , th e Partie s t o th e presen t Protoco l agree that they shal l no t b e boun d b y the provision s o f Annex I I o f the Conventio n fo r a perio d o f three years from th e dat e o f entr y int o forc e o f th e presen t Protoco l o r fo r suc h longe r perio d a s ma y b e decide d b y a two-thirds majorit y o f th e Partie s t o th e presen t Protoco l i n th e Marin e Environmen t Protectio n Committe e (hereinafter referre d t o a s "th e Committee" ) o f th e Inter-Governmenta l Maritim e Consultativ e Organizatio n (hereinafter referre d t o a s "th e Organization"). *

Article III

Communication of information

The text of article 11(1)(b ) o f the Conventio n i s replace d b y the following:

"a lis t o f nominate d surveyor s o r recognize d organization s whic h ar e authorize d t o ac t o n thei r behal f in th e administratio n o f matter s relatin g t o th e design , construction , equipmen t an d operatio n o f ships carrying harmfu l substance s i n accordanc e wit h th e provision s o f the regulation s fo r circulatio n t o th e Parties fo r informatio n o f their officers. Th e Administratio n shal l therefor e notif y the Organizatio n o f the specific responsibilitie s an d condition s o f the authorit y delegate d t o nominate d surveyor s o r recognize d organizations;".

Article IV

Signature, ratification, acceptance, approval and accession

1 Th e presen t Protoco l shal l b e ope n fo r signatur e a t th e Headquarter s o f th e Organizatio n fro m 1 Jun e 1978 to 31 Ma y 197 9 and shall thereafter remain open for accession. State s may become Parties to the present Protocol by :

(a) signatur e without reservatio n a s to ratification , acceptanc e o r approval; o r

(b) signature , subjec t t o ratification , acceptanc e o r approval , followe d b y ratification , acceptanc e o r approval; or

(c) accession .

2 Ratification , acceptance , approva l o r accessio n shal l b e effecte d b y th e deposi t of an instrumen t to tha t effect with th e Secretary-Genera l o f the Organization .

Article V

Entry into force

1 Th e present Protocol shal l ente r int o force 1 2 month s after the date on whic h no t less than 1 5 States , th e combined merchan t fleet s o f whic h constitut e no t les s tha n 5 0 pe r cen t o f th e gros s tonnag e o f the world' s merchant shipping, hav e becom e Partie s to i t i n accordanc e with articl e I V of the presen t Protocol .

2 An y instrumen t of ratification , acceptance , approva l o r accessio n deposite d afte r the dat e o n whic h th e present Protoco l enter s int o forc e shal l tak e effec t three month s afte r the dat e o f deposit.

The procedures set out in articl e 1 6 of the Convention i n respec t of amendments to the articles, a n Annex and an appendi x to a n Anne x of the Convention shal l appl y respectivel y to amendments to the articles, th e Annex and a n appendi x t o th e Annex o f the presen t Protocol .

Article VII

Denunciation

1 Th e presen t Protoco l ma y b e denounced b y any Part y to the presen t Protoco l a t any time after the expiry of fiv e years from th e date o n whic h th e Protoco l enter s int o force for that Party.

(i) eac h ne w signature or deposit of an instrumen t of ratification, acceptance , approva l o r acces- sion, togethe r with th e dat e thereof;

(ii) th e dat e of entry int o force of the presen t Protocol ;

(iii) th e deposi t o f any instrumen t o f denunciatio n o f the presen t Protoco l togethe r wit h th e dat e on whic h i t was receive d an d th e dat e o n whic h th e denunciatio n take s effect ;

(iv) an y decision mad e i n accordanc e wit h articl e 11(1 ) o f the presen t Protocol ;

(b) transmi t certifie d tru e copie s o f th e presen t Protoco l t o al l State s whic h hav e signe d th e presen t Protocol o r accede d thereto .

3 A s soon a s the present Protoco l enter s int o force, a certified true copy thereof shall b e transmitted b y the Depositary to the Secretariat of the Unite d Nation s for registration an d publicatio n i n accordanc e with Articl e 102 o f the Charte r of the Unite d Nations .

Article IX Languages
