Regulation 16 Measures of control

2 Whe n a surveyo r appointed or authorized b y the Government of the Party to the Convention ha s verified that an operatio n ha s bee n carrie d ou t i n accordanc e with th e requirement s o f the Manual , o r ha s granted a n exemption fo r a prewash , the n tha t surveyor shal l mak e a n appropriat e entr y i n th e Carg o Recor d Book . 3 Th e maste r o f a shi p certifie d t o carr y noxiou s liqui d substance s i n bul k shal l ensur e tha t the provision s of regulation 1 3 an d of this regulatio n hav e been complie d with an d that the Cargo Recor d Boo k is completed in accordanc e with regulatio n 1 5 wheneve r operations as referre d t o i n tha t regulatio n tak e place .
4 A tank which ha s carried a category X substance shall b e prewashed i n accordanc e with regulatio n 13.6 . The appropriat e entrie s o f thes e operation s shal l b e mad e i n th e Carg o Recor d Boo k an d endorse d b y th e surveyor referre d to unde r paragrap h 1 o f this regulation .
5 Wher e the Governmen t of the receivin g part y i s satisfie d tha t i t i s impracticabl e to measur e the concen - tration o f th e substanc e i n th e effluen t withou t causin g undu e dela y t o th e ship , tha t Part y ma y accep t th e alternative procedur e referre d to i n regulatio n 13.6. 3 provide d that the surveyor referre d to unde r paragraph 1 of this regulatio n certifie s i n th e Cargo Recor d Boo k that:
.1 th e tank, it s pum p an d pipin g systems hav e bee n emptied ; an d
.2 th e prewas h ha s bee n carrie d ou t i n accordanc e with th e provision s o f appendix V I o f this Annex ; and
.3 th e tank washings resultin g from suc h prewas h hav e been discharge d to a receptio n facilit y and the tank i s empty .
6 A t th e reques t o f th e ship' s master , th e Governmen t o f th e receivin g Part y ma y exemp t th e shi p fro m the requirement s fo r a prewas h referre d t o i n th e applicabl e paragraph s o f regulatio n 1 3 whe n on e o f th e conditions o f regulation 13. 4 i s met .
7 A n exemptio n referre d t o i n paragrap h 6 o f this regulatio n ma y onl y b e grante d b y th e Governmen t o f the receivin g Part y t o a shi p engage d i n voyage s t o port s o r terminal s unde r th e jurisdictio n o f othe r State s Parties to the present Convention. Whe n suc h a n exemptio n ha s been granted , th e appropriate entry mad e i n the Cargo Recor d Boo k shall b e endorsed b y the surveyo r referre d t o i n paragrap h 1 o f this regulation . 8 I f th e unloadin g i s no t carrie d ou t i n accordanc e wit h th e pumpin g condition s fo r th e tan k approve d by th e Administration s an d base d o n appendi x V o f thi s Annex , alternativ e measure s ma y b e take n t o th e satisfaction o f the surveyo r referre d t o i n paragrap h 1 o f this regulatio n t o remov e the carg o residue s fro m th e ship to quantities specifie d i n regulatio n 1 2 a s applicable . Th e appropriate entries shal l b e mad e i n th e Cargo Record Book .

9 Port State control on operational requirements*

Shipboard marine pollution emergency plan for noxious liquid substances

3 I n th e cas e o f ships t o whic h regulatio n 3 7 o f Annex I o f the Convention als o applies, such a plan may be combined wit h th e shipboar d oi l pollutio n emergenc y pla n require d unde r regulatio n 3 7 o f Annex I o f the Convention. I n thi s case , th e title of such a pla n shal l b e "Shipboar d marin e pollution emergenc y plan".

Regulation 18
Reception facilities and cargo unloading terminal arrangements

3 Th e Governments of Parties to the Convention, th e coastlines of which borde r on an y given specia l area , shall collectivel y agre e an d establis h a dat e b y whic h tim e th e requiremen t o f paragrap h 1 o f this regulatio n will b e fulfille d an d fro m whic h th e requirement s o f the applicabl e paragraph s o f regulatio n 1 3 i n respec t o f that area shal l tak e effect and notif y the Organization o f the date so established at leas t six month s i n advanc e of that date. Th e Organizatio n shal l the n promptl y notif y al l Partie s o f that date .
4 Th e Government of each Part y to the Convention shal l undertak e to ensure that cargo unloadin g terminals shall provid e arrangement s t o facilitat e strippin g o f cargo tank s o f ships unloadin g noxiou s liqui d substance s at thes e terminals . Carg o hose s an d pipin g system s o f th e terminal , containin g noxiou s liqui d substance s received from ship s unloadin g these substance s a t the terminal, shal l no t be draine d bac k to the ship.
5 Eac h Part y shal l notif y th e Organization , fo r transmissio n t o th e Partie s concerned , o f an y cas e wher e facilities require d unde r paragraph 1 o r arrangements require d unde r paragraph 4 of this regulatio n ar e alleged to b e inadequate .
