Regulation 10

Duration and validity of certificate SEE INTERPRETATION 15

1 A n Internationa l Oi l Pollutio n Preventio n Certificat e shall b e issue d for a period specifie d b y the Admin- istration, whic h shal l no t exceed five years.

2.1 Notwithstandin g the requirements of paragraph 1 o f this regulation, when the renewal survey is completed within thre e month s befor e th e expir y dat e o f the existin g certificate , th e ne w certificat e shal l b e vali d fro m the dat e of completion o f the renewa l surve y to a dat e no t exceeding five year s from th e dat e o f expiry o f the existing certificate .

2.2 Whe n the renewa l surve y i s completed after the expiry date of the existing certificate, th e ne w certificate shall b e valid fro m th e dat e o f completion o f the renewa l surve y t o a dat e no t exceeding fiv e years fro m th e date o f expiry o f the existin g certificate .

2.3 Whe n th e renewa l surve y i s complete d mor e tha n thre e month s befor e th e expir y dat e o f the existin g certificate, th e ne w certificat e shal l b e vali d fro m th e dat e o f completion o f the renewa l surve y t o a dat e no t exceeding five years from th e dat e o f completion o f the renewa l survey .

3 I f a certificat e i s issue d fo r a perio d o f les s tha n fiv e years , th e Administratio n ma y exten d th e validit y of the certificat e beyon d th e expir y dat e t o th e maximu m perio d specifie d i n paragrap h 1 o f this regulation , provided that the survey s referre d t o i n regulation s 6.1. 3 an d 6.1. 4 o f this Annex applicabl e when a certificate is issue d for a perio d o f five years are carrie d ou t as appropriate .

4 I f a renewa l surve y ha s bee n complete d an d a ne w certificat e canno t b e issue d o r place d o n boar d th e ship befor e the expiry date of the existing certificate, th e perso n o r organization authorize d b y the Administra- tion ma y endorse the existing certificat e an d suc h a certificat e shal l b e accepte d a s valid fo r a furthe r perio d which shal l no t exceed fiv e month s from th e expir y date .

5 I f a ship at the time when a certificate expires is not in a port in which i t is to be surveyed, the Administra- tion ma y extend th e perio d o f validity o f the certificate bu t this extensio n shal l b e granted onl y for the purpos e of allowing th e shi p t o complet e it s voyag e t o th e por t i n whic h i t i s t o b e surveyed , an d the n onl y i n case s where i t appear s prope r an d reasonabl e t o d o so . N o certificat e shal l b e extende d fo r a perio d longe r tha n three months , an d a shi p to which a n extensio n i s grante d shal l not , o n it s arriva l i n th e por t i n whic h i t i s to be surveyed, b e entitled b y virtue of such extensio n t o leav e that port without having a ne w certificate. Whe n the renewa l surve y i s completed , th e ne w certificate shall b e vali d t o a date no t exceeding five years from th e date o f expiry o f the existin g certificate befor e the extensio n wa s granted .

6 A certificate issue d to a ship engaged on shor t voyages which ha s no t been extended unde r the foregoing provisions o f this regulatio n ma y b e extended b y the Administratio n fo r a perio d o f grace of up to one mont h from th e dat e o f expiry state d o n it . Whe n th e renewa l surve y i s completed , th e ne w certificat e shal l b e valid to a dat e no t exceedin g fiv e year s fro m th e dat e o f expiry o f the existin g certificat e befor e the extensio n wa s granted.

7 I n specia l circumstances , a s determined b y the Administration, a ne w certificate need no t be dated from the dat e o f expiry o f the existin g certificat e a s require d b y paragraph s 2.2 , 5 o r 6 o f this regulation . I n thes e special circumstances , th e ne w certificat e shal l b e vali d t o a dat e no t exceedin g fiv e year s fro m th e dat e o f completion o f the renewa l survey .

8 I f a n annua l o r intermediat e surve y i s complete d befor e th e perio d specifie d i n regulatio n 6 o f thi s Annex, then :

.1 th e anniversar y dat e show n o n th e certificat e shal l b e amende d b y endorsemen t to a dat e whic h shall no t b e mor e than thre e month s late r than th e dat e on whic h th e surve y wa s completed ; .2 th e subsequen t annua l o r intermediat e surve y require d b y regulatio n 6. 1 o f thi s Anne x shal l b e

completed a t the interval s prescribe d b y tha t regulatio n usin g the ne w anniversar y date ; an d .3 th e expir y dat e ma y remai n unchange d provide d on e o r mor e annua l o r intermediat e surveys , a s

appropriate, ar e carrie d ou t s o tha t th e maximu m interval s betwee n th e survey s prescribe d b y regulation 6. 1 o f this Anne x ar e no t exceeded.

9 A certificat e issue d unde r regulatio n 7 o r 8 o f this Anne x shal l ceas e t o b e vali d i n an y o f the followin g cases:

.1 i f the relevan t survey s ar e no t completed withi n th e period s specifie d unde r regulatio n 6. 1 o f this Annex;

Regulation 11

Regulation 11

Port State control on operational requirements*

2 I n the circumstances given i n paragraph 1 o f this regulation, the Party shall take such steps as will ensure that th e shi p shal l no t sai l unti l th e situatio n ha s bee n brough t to orde r i n accordanc e wit h th e requirement s of this Annex .

3 Procedure s relatin g to the por t State control prescribe d i n articl e 5 o f the present Convention shal l appl y to this regulation .

Part A - Construction

Regulation 12

Tanks for oil residues (sludge)

1 Ever y ship of 400 gross tonnage and above shall be provided with a tank or tanks of adequate capacity, having regard to the type of machinery and length of voyage, to receive the oil residues (sludge) which cannot be dealt with otherwise in accordance with the requirements of this Annex.

2 Oi l residu e (sludge) ma y be disposed of directly from the oil residu e (sludge) tank(s) through the standard discharge connectio n referre d t o i n regulatio n 13 , o r an y othe r approve d mean s o f disposal . Th e oi l residu e (sludge) tank(s) :

.1 shal l b e provided with a designated pum p for disposal that is capable of taking suction from the oil residue (sludge ) tank(s) ; an d

.2 shal l hav e n o discharg e connection s t o th e bilg e system , oil y bilg e wate r holdin g tank(s) , tan k to p or oil y wate r separator s excep t tha t the tank(s ) ma y b e fitte d wit h drains , wit h manuall y operate d self-closing valve s an d arrangement s fo r subsequen t visua l monitorin g o f th e settle d water , tha t lead t o a n oil y bilg e water holdin g tank or bilg e well , o r a n alternativ e arrangement , provide d suc h arrangement does no t connect directly t o th e bilg e pipin g system .

4 I n ship s delivere d afte r 3 1 Decembe r 1979 , a s define d i n regulatio n 1.28.2 , tank s fo r oil residue s shal l be designe d an d constructe d s o a s to facilitate their cleaning and th e discharg e o f residue s to receptio n facili - ties. Ship s delivere d o n o r befor e 3 1 Decembe r 1979 , a s define d i n regulatio n 1.28.1 , shal l compl y wit h thi s requirement as far as i s reasonabl e and practicable .

Regulation 12A

Oil fuel tank protection

1 Thi s regulatio n shal l appl y to all ship s with a n aggregat e oil fue l capacit y of 600 m3 an d abov e which ar e delivered on o r after 1 Augus t 2010, a s defined i n regulatio n 1.28. 9 o f this Annex.

2 Th e applicatio n o f thi s regulatio n i n determinin g th e locatio n o f tank s use d t o carr y oi l fue l doe s no t govern ove r th e provision s o f regulation 1 9 o f this Annex .

Regulation 12 A

.2 Load line draught (ds) i s th e vertica l distance , i n metres , fro m th e moulde d baselin e a t mid-lengt h to the waterline correspondin g to the summe r freeboard draugh t to b e assigne d t o the ship . .3 Light ship draught i s th e moulde d draugh t amidship s correspondin g t o th e lightweight .

.4 Partial load line draught (dP) i s th e ligh t shi p draugh t plu s 60 % o f the differenc e betwee n th e ligh t ship draugh t and th e loa d lin e draugh t (ds). The partia l loa d lin e draugh t (dp ) shal l b e measure d i n metres.

.12 Small oil fuel tank i s a n oi l fue l tan k wit h a maximu m individua l capacit y no t greater than 3 0 m3. .13 C i s the ship' s total volum e of oil fuel , includin g that of the smal l oi l fue l tanks , i n cubi c metres , a t

98% tan k filling.

.14 Oil fuel capacity mean s th e volum e o f a tan k i n cubi c metres , a t 98 % filling .

4 Th e provision s o f this regulatio n shal l appl y t o al l oi l fue l tank s excep t smal l oi l fue l tanks , a s define d in 3.12 , provide d that the aggregat e capacity of such exclude d tank s i s no t greater than 60 0 m3.

5 Individua l oi l fue l tank s shal l no t hav e a capacit y o f over 2,500 m3.

The minimu m valu e of w = 1. 0 m ; however , fo r individua l tank s with a n oi l fue l capacit y of less than 50 0 m3 the minimu m valu e i s 0.7 6 m .

.5.4 I n the case of bottom damage, a portion from the outflow from an oil fuel tank may be captured by non-oi l compartments . Thi s effec t i s approximate d b y applicatio n o f th e facto r CDB(i) fo r each tank, whic h shal l b e taken a s follows:
