A Reception facilities outside special areas

2 Receptio n facilitie s i n accordanc e with paragrap h 1 o f this regulatio n shal l b e provide d in :

.1 al l port s an d terminal s i n whic h crud e oi l i s loade d int o oi l tanker s wher e suc h tanker s hav e immediately prio r t o arriva l complete d a ballas t voyag e o f no t mor e tha n 7 2 h o r no t mor e tha n 1,200 nautica l miles ;

.2 al l port s and terminal s i n whic h oi l othe r than crud e oil i n bul k i s loade d a t an averag e quantit y of more tha n 1,00 0 tonne s pe r day ;

.3 al l port s havin g ship repai r yard s o r tank cleanin g facilities;

.4 al l port s an d terminals which handl e ships provide d with th e oil residu e (sludge ) tank(s) require d b y regulation 1 2 o f this Annex;

.5 al l port s i n respec t of oily bilg e waters an d othe r residue s that cannot be discharged i n accordanc e with regulation s 1 5 an d 3 4 o f this Annex; an d

.6 al l loadin g ports for bulk cargoes i n respec t of oil residue s from combinatio n carrier s which canno t be discharge d i n accordanc e wit h regulatio n 3 4 o f this Annex .

3 Th e capacit y for the receptio n facilitie s shal l b e a s follows :

.1 Crud e oil loadin g terminals shal l hav e sufficien t receptio n facilitie s t o receiv e oi l an d oil y mixture s which canno t b e discharge d i n accordanc e wit h th e provision s o f regulatio n 34. 1 o f thi s Anne x from al l oi l tanker s on voyage s a s describe d i n paragrap h 2. 1 o f this regulation .

.2 Loadin g port s an d terminal s referre d t o i n paragrap h 2. 2 o f thi s regulatio n shal l hav e sufficien t reception facilitie s to receiv e oil an d oily mixture s whic h canno t be discharged i n accordanc e with the provision s o f regulation 34. 1 o f this Anne x from oi l tanker s whic h loa d oi l othe r than crud e oi l in bulk .

.3 Al l port s havin g shi p repai r yard s o r tan k cleanin g facilitie s shal l hav e sufficien t receptio n facilitie s to receiv e al l residue s an d oil y mixture s whic h remai n o n boar d fo r disposa l fro m ship s prio r t o entering such yard s o r facilities.

.4 Al l facilities provided i n port s and terminals unde r paragraph 2.4 of this regulation shall b e sufficient to receiv e al l residue s retaine d accordin g t o regulatio n 1 2 o f thi s Anne x fro m al l ship s tha t ma y reasonably b e expected t o call a t such port s and terminals.

B Reception facilities within special areas

4 Th e Governmen t o f eac h Part y t o th e presen t Conventio n th e coastlin e o f which border s o n an y give n special are a shal l ensur e tha t al l oi l loadin g terminal s an d repai r port s withi n th e specia l are a ar e provide d with facilitie s adequat e for the receptio n an d treatmen t of all th e dirty ballas t and tan k washing water from oi l tankers. I n addition , al l port s withi n th e specia l are a shal l b e provide d wit h adequate * receptio n facilitie s for other residue s an d oil y mixture s from al l ships . Suc h facilitie s shal l hav e adequat e capacit y to mee t the need s of the ship s usin g them withou t causing undu e delay .

6 Wit h regar d to the Re d Se a area , Gulf s area+ Gul f of Aden are a an d Oma n are a of the Arabian Sea : .1 Eac h Part y concerne d shal l notif y th e Organizatio n o f the measure s take n pursuan t to provision s

of paragraph s 4 an d 5 o f this regulation . Upo n receip t o f sufficient notifications , th e Organizatio n shall establis h a date from whic h th e discharg e requirement s of regulations 1 5 an d 3 4 of this Annex in respec t o f the are a i n questio n shal l tak e effect . Th e Organizatio n shal l notif y al l Partie s o f the date s o establishe d n o les s than twelv e month s i n advanc e o f that date.

.2 Durin g th e perio d betwee n th e entr y int o forc e o f the presen t Conventio n an d th e dat e s o estab - lished, ship s whil e navigatin g i n th e specia l are a shal l compl y wit h th e requirement s o f regulation s 15 an d 3 4 of this Annex as regard s discharges outside special areas .

.3 Afte r suc h date , oi l tanker s loadin g i n port s i n thes e specia l area s wher e suc h facilitie s ar e no t yet available shal l als o full y compl y wit h th e requirement s o f regulation s 1 5 an d 3 4 o f this Anne x a s regards discharge s withi n specia l areas . However , oi l tanker s enterin g thes e specia l area s fo r th e purpose o f loadin g shal l mak e ever y effor t to ente r the are a wit h onl y clea n ballas t on board . .4 Afte r th e dat e o n whic h th e requirement s fo r th e specia l are a i n questio n tak e effect , eac h Part y

shall notif y the Organizatio n fo r transmission t o the Partie s concerne d o f all case s where the facili- ties ar e allege d to b e inadequate .

.5 A t leas t th e receptio n facilitie s a s prescribe d i n paragraph s 1 , 2 an d 3 o f thi s regulatio n shal l b e provided on e year afte r the dat e o f entry int o force o f the presen t Convention .

7 Notwithstandin g paragraphs 4, 5 an d 6 of this regulation , th e following rules apply to the Antarctic area:

.1 Th e Governmen t of each Part y t o th e presen t Conventio n a t whose port s ship s depar t e n route t o or arrive from the Antarctic area undertakes to ensure that as soon a s practicable adequate facilities are provided for the receptio n o f all oi l residu e (sludge), dirt y ballast , tan k washing water, an d othe r oily residue s and mixture s from al l ships , withou t causing undu e delay, an d accordin g to the need s of the ship s usin g them.

General requirements

8 Eac h Part y shal l notif y the Organizatio n fo r transmission t o the Partie s concerne d o f all case s wher e the facilities provide d unde r this regulatio n ar e allege d t o b e inadequate .

1 Thi s regulatio n applie s t o fixe d o r floatin g platform s includin g drillin g rigs , floatin g production , storag e and offloadin g facilities (FPSOs ) use d fo r the offshore productio n an d storag e o f oil, an d floatin g storag e unit s (FSUs) use d fo r the offshore storage of produced oil .

2 Fixe d o r floatin g platform s whe n engage d i n th e exploration , exploitatio n an d associate d offshor e processing of sea-bed minera l resource s an d othe r platform s shal l compl y with th e requirement s o f this Annex applicable to ships o f 400 gros s tonnage an d abov e other than oi l tankers , excep t that:

.1 the y shall b e equipped as far as practicable with the installation s required i n regulation s 1 2 an d 1 4 of this Annex ;

.2 the y shall kee p a record of all operations involving oil or oily mixture discharges, i n a form approved by the Administration; an d

.3 subjec t t o th e provision s o f regulatio n 4 o f thi s Annex , th e discharg e int o th e se a o f oi l o r oil y mixture shal l b e prohibite d excep t when th e oil conten t of the discharg e without dilution doe s no t exceed 1 5 ppm .

3 I n verifying compliance with this Annex i n relatio n to platforms configured as FPSO s or FSUs, i n addition to th e requirement s o f paragraph 2 , Administration s shoul d tak e accoun t of the Guideline s develope d b y th e Organization.*
