a. The existing agreement inadvertently failed to provide for the matter of the intellectual property rights over outputs, works or products resulting from activities under the agreement.

b. The parties therefore agree as follows:

1) Fundacion and U.P. Dillman shall renew the Agreement under the same terms and conditions for another two (2) years begirming 1 June 2001;

2) All research outputs, discoveries and/or inventions/

innovations produced by virtue of and pursuant to the Agreement shallbe recognized as the output of and shall be jointly owned by Fundacion and V.P. Diliman;

3) Anypublication arising from the activities undertaken by virtue of and pursuant to the Agreement shall clearly establish and identify both Fundacion and U.P. Diliman as the sources of the output;

4) All reports by virtue of and pursuant to the Agreement shall bemadeinthe names of Pundacion and V.P. Diliman, provided, that the names of the principal authors, researchers and/or project leaders shallbeidentified, recognized and included in the report; and

5) Fundacion and U.P. Dillman shall have equal right to use all outputs, works, products, information, data and findings

Duties and responsibilities of UPD-NEC, among others:

a. Arrange the facilities and equipment needed for the conduct of the trainingcourses;

b. Provide the support personnel such as training coordinators, secretariat, draftsmen, technicians, printing and janitorial services to undertake and ensure the efficient implementation of each training;

c. Arrange the meals and snacks of the participants, training staff, and resource persons during the course of the training at a sustainable and reasonable fee;

d. Issuecertificates ofcompletion signedbythe General Manager ofPWDCORP and the ExecutiveDirectorof the UPD-NEC;and e. Provide the network and contact to effectively market the programs as well as the distribution of the invitation/ notices.

Tools like brochures and advertisementsinpapers may be employed subject to approval of PWDCORP.

Duties and responsibilities of PWDCORP, among others:

a. Furnish UPD·NEC all the necessary details regarding each training, including schedule, course descriptions, course objectives, course outlines and methodology;

b. Develop the course materials needed for each training. One complete set of course materials shall be submitted to UPD- NEC for reproduction and distribution to the participants;

c. Provide qualified and competent resource speakers or appoint any from U,P. Diliman or UPD-NEe's pool of resource persons for each training course;

d. Provide a structure for capability-building of UPD-NECspool of resource persons to conduct the training course;

e. Provide the transportation, accommodation and per diem of foreign and out-of-town trainors for the duration of the training; and

f. Provide honoraria for lecturers, fees and other course-related expenses after proceeds of the training had been collected.

Effectivity:Effective upon the execution and signingbythe contracting parties for a period of 2 years ending on 30 June 2003.

PTOjed:Conduct of the seminar on Construction Project Management Particulars:

a. Duties and responsibilities of UPo-NEC:

1) Develop the course materials to be submitted to OOH-NCHFD for reproduction and distribution to the seminar participants.

Ownership of the course shall be retained by UPD-NEC.

Reproduction of any part of the materials isrestricted within OOH-NCHFD. No part of the publication may be reproduced or transmittedinany form or by any means externally, without

the prierwntten permission of the UPD-NEC, Dillman, Quezon City;

2) Assign resource person from its pool of lecturers who are experts intheir respective fields. They are practitioners and consultants who have extensive practical experience. Their curriculum vitae willbeprovided upon finalization of the seminar schedule;

3) Award a Certificate of Completion to participants who attended and completed at least 80% of the total lecture hours.

A Certificate of Attendance willbegiven to those who do not meet this requirement; and

4) Submit to the OOH-NOiFD the summary of evaluation reports accomplishedbythepartidpants after-theconduct of the seminar.

b. Duties and responsibilities of DOH-NCHFD:

1) Designate the venue of the seminar and provide the facilities and equipment needed for the conduct of the seminar. A list of the equipment needed by the lecturers shall be given a week before the seminar commences. These may include a slide and/

or overhead projector, LCD projector, notebook PC, blackboard or white board and others;

2) Provide a complete list of participants to UPO-NEC at least a week before the scheduled seminar date;

3) Assist the UPD-NEC staff in conducting post-seminar evaluation of the following: seminar conduct, lecturers, service and facilities including catering services; and

4) For and in consideration of the aforementioned services and facilities, the OOH-NCHFD shall pay the UPD-NEe the amount ofPlO1,OOO.OOlor the5-dayseminar. Thisamount shallbepaid through the UPD-NEC Trust Account No. 9692601-499-906.

Memorandum of Agreement with the Department of Environment and Natural Resources

Memorandum of Agreement entered into by and between U.P.

Dillman, through the College of Education, and the Department of Environment and Natural Resources, through the Environmental Management Bureau (DENR-EMB)

Project: Assessment of the Implementation of Environmental Education in Schools Nationwide

Particulars:

a. The DENR-EMB shall:

1) Provide appropriate funds for the conduct of project activities;

2) Select the participants to the pilot testing and monitoring activities; and

3) Collaborate with UPO-CoE in planning the project activities and providing the data necessary to conduct the project components.

b. The UPD-CoE shall:

1) Provide technical expertise required for the conduct of the project activities;

2) Manage and supervise the conduct of research and pilot testing upon approval of the design by the DENR-EMB; and 3) Submit the project report on or before 31 December 2001.

Effectivity: Effective upon signing ofboth parties and shall continue until 31 December 2001

Particulars:

a. PCHRD shall:

1) allocate the amount of Pl,307,966.50; and

2) provide technical assistance relevant to the achievement of the Project in coordination with other government agencies in matters requiringtheirattention or cooperation insofar as these are relevant to the project and within the capability of PCHRD.

b. U.P. Dillman, among others, shall:

1) Submit to PCHRD periodic reports, i.e., quarterly progress andfinancialreports, annual technical accomplishment report, audited financial report, etc.;

2) Report immediately and remit to PCHRD all income derived from the project and all unexpended balance,ifany, at the end of the project year;

3) Hire project personnel on contractual basis and coterminous with the Agreement; and

4) Provide appropriate assistance to PCHRD in pursuance of commercialization or transfer of Research and Development results that are product-based.

c. Cost and Terms of Payment

Payment under the Agreement shallhemade directly to U.P.

Dilimanby PCHRD. PCHRD shall release thefullamount to U.P.

Diliman upon execution of the Supplemental Memorandum of Agreement, and subject to the stated schedule and submission of required outputs.

Two Separate Memoranda of Understanding entered into byand between V.P. Los Banos and the Philippine Network of Rural Development Institutes (PhilNet RDI)

A. Project. Program on farm practice and thesis for undergraduate and graduate students of the Department of Horticulture, College of Agriculture, UPLB

Partial/ars:

a. UPLB, through the College of Agriculture, Department of Horticulture, shall,

1) provide support services through extension work, i.e. farm practice and thesis inBohol, Iloilo and Davao del Norte;

2) administer the overall management of the farm practice and thesis through a Project Management Committee (PMC) constituting the chair of the Department of Horticulture, the student adviser and a representative from PhilNet RDI which shall be tasked to coordinate the review, planning, implementation, monitoring and evaluation of the activities;

3) formulate the topic or thesis problem inrelation to mango in Iloilo, banana in Davao del Norte and palm oil in Bohol/

Sultan Kudarat for alternative technologies.

b. PhilNet RDI shall provide the area for farm practice and thesis implementation.Itwill also cover all expenses related to the agreed activities,i.e.faretoand from Los Banos,board and lodging, mobility and travel insurance to both the student and the adviser.

c. TheCA Department of Horticulture,thestudent and PhilNet RDI shall haveequalrights toownership to the farm practice and thesis output.

d. Any publication arising from the research and other activities undertaken in pursuant to this agreement shall identify the UPLB as the source of the output.

3) Formulate the topicor thesis problem in relation to sugarcane inCebu OrNegros Oriental and riceinPampanga for alternative technologies.

b. PhilNet RDI shall provide the area for farm practice and thesis implementation. The institution will cover all expenses related to the agreed activities i.e. fare to and from Los Banos, board and lodging, mobility and travel insurance to both the student and the adviser.

c. UPLB, through the College of Agriculture Department of Agronomy, and student and PhilNet RDl shall have equal rights of ownership to the farm practice and thesis output.

d. Any publication arising from the research and other activities undertaken in pursuant to this agreementshallidentifythe UPLB as the source of the output.

Particulars:

a. Project area shall initially cover the major vegetable production areas in Marilog District, Davao City, and the project proponent shall be the Marilog Highlander Farmers Multi-purpose Coopera tive.

b. The project shall seek to upgrade existing cultural management and post harvest handling practices of highland vegetables in the MarBog area and thus improve the quality of locally-produced highland vegetables, resulting in better farm-gate prices and higher incomes to vegetable fanners in the area. _ c. The MOA defines the various technical assistance and funding

support to be provided to the proponent by the different parties in the implementation of the project. It shall also define the coordinating mechanisms in the implementation and monitoring of the project.

d. Allexpenses and costs incurred by the parties in the fulfillment of their obligations under the MOA shall be borne by the party incurring the same. Upon mutual consent, however, the parties canpoolresources and co-share costsincarrying out their respective obligations and other activities related to the project.

e. All research outputs, discoveries and/or inventions/innovations producedby virtue of and pursuant to the Agreement shall be jointly owned by the parties.

Effectivity:Effective for two (2) years from the date of signing by the parties but not later than 28February2003

Project:Agro-lndustnal Development Program Il-Oriental Mindoro Particulars:

a. The Agre-Industrial Development Program (AIDP) II is a collaborative action program of the Provincial Government of Oriental Mindoro (PGOM), Mindoro State College of Agriculture and Technology (MinSCA1), and the UPLBCollege of Agriculture geared towards agricultural production, processing and enterprise development.

b. The PGOM, among others, shall:

1) Take the lead roleinproviding the overall policies, direction!

guidelines,inidentifying priorities and thrusts for agricultural production, processing and enterprise development of the municipality; and

2) Make available its human resources, equipment and facilities as neededbythe program; and source funding for the projects and activities under the Program;

c. MinSCAT and UPLB, among others, shall:

1) Provide technical staff to assist PGOMin the planning and implementation of the Program;

2) Provide technical expertise needed in the Program such as enterprise development, research backstaffing, organizational development, marketing services, project proposalj feasibility study preparation, data-basing and institutional policy support;

3) Provide financial resources in the implementation of the program, subject to availability of funds: and

4) Assist in the process of documentation of activities undertaken under AIDP.

5) The parties agree to prepare jointly a yearly status report on the project for effective monitoring purposes during the entire duration of the Agreement. The review shall be initiated by the Department of Agricultural Education and Rural Studies (DAERS) of the College of Agriculture.

Effectivity: Effective upon signing by the parties for five (5) years but not later than 31 December 2005

Project:Affiliation and Internship Training Program Affiliilh'on Fee: P200.00 per intern per month Particulars:

a. U.P. Manila, through the Department of Radiology-Philippine General Hospital, shall implement the projectinaccordance with the proposal contained in the MOA.

b. The Department of Radiology-Philippine General Hospital shall provide maximum opportunity for interns to gain experience and traininginalldiagnosis rooms, clinical wards and other facilities of the department as maybe available. The Department shall screen all qualified incoming interns and recommend the approval of their training to the Director of the hospital. The total number of Interns at any given time must not exceed 10.

Effectivity:Shall take effect upon approval and signing by both parties for one year
