AUTHORITY FOR CHANCELLOR OF UPLB TO DELE·

GATE FUNCTIONS

The Board granted authority to the Chancellor of UPlB to dele- gate functions and responsibilities to Vice-Chancellors and Deans, Directors, and other heads of principal units the main features of which are summarized hereinbelow:

1. The authorization indicates the specific functions (in the areas of personnel and fiscal administration and other administrative aspects) that the Chancellor may delegate to the Vice-Chancellors, the deans, and other heads of principal units.

2. On the other hand, it also identifies what functions may not be delegated.

3. Basic Ql!idelines are provided to enable the Chancellor to

TheBoard confirmed the provisional transfer of former peAS personnel to the University, effective10 Julv until 30 October 1979 (unless otherwise indicated).

REORGANIZATION OF THE COLLEGE OF FORESTRY The Board approved the reorganization of the College of Fores- try, including the following:

1. Creation of the position of Associate Dean;

2. Establishment of the Forestry Development Center;

3. Establishment of the Center for Forestry Education Researc and Development for the Asia/Pacific Region;

4. Reorganization of the Forestry Research Center into the Forestry Research and Extension Center;

5. Reorganization of the Department of Forestry Extension into the Department of Social Forestry and the Forestry Extension Office; and

6. Establishment of the Department of Silviculture and Forest Influences.

effectively supervise the discharge of delegated functions and see to it that the exercise thereof shall bein accordance with University policy.

4. The Chancellor retains full discretion as to when to delegate and what to delegate, asIlVeII as the power to review/modify/set aside any action taken by any official/employee of the University.

Justification:

In view of some questions issued by the UPLB Auditor on the authority of the Vice-Chancellors and other lower officiale to approve/act on matters, especially fiscal matters, there is urgent need to authorize the Chancellor to delegate functions. Obviously, it is almost impossible for the Chancellor to act on, or personally attend to, atl the functions assigned him by the Board of Regents, not to mention other matters usually pertaining to that position, although they have not been expressly assigned to the Chancellorby the Board.

The Board confirmed the absorption of former PCAS personnel into the Asian Center and the Institute of Islamic Studies, effective 1 November 1979 until the end of the second semester, AY 1979-1980, under the following conditions:

a. Such personnel shall continue to receive until 31 December 1979 the same salaries as they had been receiving as of 31 Octobe 1979;

b. The realignment of their ranks/designations and salaries shall take effect beginning 1 January1980.

GRANTS·IN·AID AND TUITION FEE DISCOUNTS In order to enable other financially needy and scholastically deserving students to benefit from grants-in-aid and tuition fee dis·

counts, the Board approved the following:

a. A financially needy and scholastically deserving student shall beeligible for grants-in-aid and/or tuition fee discounts toward the completion ofonly one curricular program, whether baccalaureate, masteral, doctoral, ornon-degree.

b. A student who, with grants-in-aid and/or tuition fee dis- counts, completes one curricular program shall be disqualifiedfrom further grants-in-aid and/or tuition fee discounts - even for mere enrollment in additional courses as a non-degree student, e.g., a 8.S.

Hygiene graduate who enrolls in higher English, Physics, and Zool- ogy courses to satisfy the requirements for admission into the College of Medicine as an M.D. student.

c. A financially needy and scholastically deserving student enrolled in a curricular program shall be eligible- for grants-in-aid and/or tuition fee discounts for a maximumspecified period,as follows:

DEFAULTING FELLOWS

A brief report was made, in a Memorandum dated 19 November 1979 by the Office of the University Legal Services. On the lrnple mentation so far ofsuqqesnons/recommendanonsregardingdefault ing fellows, and the following questions were raised'

"1. Should we now sue the principa!lsureties? Some reneging fellows are here, othersare abroad.

"Many of their guarantors are members of the faculty who signed in good faith.

"2 Should we now ask the Ministry of Foreign Affairs 10 revoke the passports of reneging fellows abroad?

"3 Should we seek the cooperation of imnuqratrcn authorities in the United States and other countries?

"4. Shouldweseek authortzation to condone Interest (in regard fellows who have paid a substantial amount of their contractual obligation)?

"5. In regard to manner of payment, is service to the Univers.tv (rather than money payments) acceptable?

"The Board called for a stricter and more vigorous enforcement of the rules.

"Itdesired, for its meeting in January, 1980, fuller information on individual cases and specific information on actions to be taken and procedures to be followed vis-a-vis each individual case.

OTHER MATTERS CONSIDERED BY THE BOARD

The Board epprcved in principle the granting of authority to U.P. College Tacloban to have the University property in Apitong, Tacloban City, consisting of 8.5 hectares, developed into a Housing Area: a BUSS Faculty Housing Project.

A formal Memo of Agreement between the UPS and the Minis- try of Human Settlements must first be worked out and approved by the Board.

The Board also approved the construction of a Post Office, near the U.P. gasoline station, by the Ministry of Public Works, Trans- oorrattonand Communication.

The Board approved the relocation of the Monument to Fathers Gomez, Burgos, and Zamora from Plaza Roma. lntrarnuros. to a suitable site in U.P. (Ditlrnan). to be negotiated by President E,V.

Soriano and Minister Jaime C. Laya, Action Office.. of the Intra- muras Restoration Project.

The Board authorized an Increase in service rates at the U.P.

Health Service, as per the New Revised Schedule of Fees. The proposed revision of existing rates is necessary to take care of the increased costof drugs and other medical supplies and utilities.

Moreover, for U.P.personnel and their dependents, the increase is very minimal while the rates for outsiders are comparable to those being char9'!dby nearby hospitals. Students are being char9'!d the costs for only the reagents which areused for laboratory examina- tions.

ESTABLISHMENT OF A NATIONAL DOCUMENTA·

TION CENTER FOR AGRICULTURE AND RURAL DEVELOPMENT

The Board established a National Documentation Center for Agriculture and Rural Development as a unit of the UPLB Library, to perform the following functions:

1. to develop the literature on forestry, agriculture, and rural development, from local and foreign sources;

2. to publish and disseminate abstracts and bibliographies in those fields for the scientific and pclicv-mekinq community; and

3. to solicit donations and grants for these purposes.

In this connection, the Board authorized the Chancellor to set up rules and regulations which shall redound to the more effective

nd efficient operation of the Center.

ESTABLISHMENT OF THE MANAGEMENT FOR RURAL DEVELOPMENT (MARD) PROGRAM

The Board established the Management for Aural Development (MARD) Program at the College of Development Economics and Managament, UPLB.

The new program will undertake degree and non-degree training, research, training materials development, and conferences and semi- nars, all designed to contribute to more effective and efficient man- agement of programs in the rural sector. MARD is envisioned to train implementors and decision-makers at the field and policy levels; It is also expected to help shape development strategies that would consider ethnical dimensions as well as total community transformation rather than merely sectoral change.

ESTABLISHMENT OF THE NATIONAL INSTITUTE OF BIOTECHNOLOGY AND APPLIED MICROBIOLOGY

The Board also established the National Institute of Biotech·

nology and Applied Microbiology at UPLB.

The Resolution providing for its establishment reads as follows:

Section 1. There is hereby created a National Institute of Bio- technology and Applied Microbiology, hereinafter referred to as the Institute, to serve as an integrating mechanism to mobilize and har- ness the various departments and disciplines in engineering, chemis- try, and applied microbiology to conduct research, training, and extension in biotechnology and applied microbiology.

Section 2. The Institute shall have the following objectives:

8. to undertake mission-oriented research, technology develop- ment, extension, and planning required to establish industries based on biotechnology and applied microbiology;

b. to develop and implement manpower training programs designed to upgrade the manpower pool to meet national needs in biotechnological industrial and applied microbiology;

c. to establish linkage between technical research and industrial operations, and to formulate and adopt techniques to facilitate the industrialization of laboratory-tested biotechnological processes;

d. to establish a microbial gene bank ~ichshall undertake the collection, storage, evaluation, genetic improvement, packaging. and distribution of suitableorganism~;and

e.

to provide scientific advice to government and private entities inmattersrelated to biotechnology and applied microbiology.

Section 3. The Institute shall have a Director and a Deputy Director~oshall be appointedby the U.P. Board of Regents.

DELEGATION OF AUTHORITY BY THE PRESIDENT The Board approved a proposal authorizing the President to delegate functions. The proposal isa set of general guidelines to govern delegation by the President of his functions and responsi- bilities, the main features of VYhich may besummarizedasfollows:

1. Functions that may bedelegated as well as those that may not be delegated by the President are defined.

2. The extent of authority of an officer-in-eharge of the Office of the President, or of an Acting President, is defined.

3. Authority of the President to delegate action/approval on fiscal matters (which authority is up to a certain ceiling) is limited to not more than 75% of the ceiling fixed for the President. "

4. The President's power to review action taken by lower cffl- cials/employees in the University System or in any autonomous university is reiterated Ii.e., as provided for in Article 50 of the University Code).

5. The last sentence in Article 54 of the University Code is proposed to be amended as follows (underscored portions edded, bracketed portions deleted);

"He may delegate in writing (any of) his [specific) functions to anvoffice, or officer,inaccordance with rules and other gutdelines prescribedbythe Board of Regents."

Justification:

While the President is already authorized to delegate his func- tions as provided for in Article 54 of the University Code, no gen- eral guidelines that should be observed in the exercise of such authority have been laid down so far.

At the same time, the President needs greater flexibility than is allowed him under Article54 in order to meet the increasing com- plexity of administering the affairs of the University System.

DELEGATION OF AUTHORITY BY THE CHANCELLOR The Board similarly wanted authority for the Chancellor of an autonomous unit to delegate functions. The main features of such authority maybesummarized as follows:

1. Functions that may bedelegated aswellasthose that may not be delegated by the Chancellor are defined.

2. The extent of authority of an officer-in-charge of the Office of the Chancellor, or of an Acting Chancellor, is defined.

3. Authority of the Chancel-lor to delegate action/approval on fiscal matters (lIIIhich authority is up to a certain ceiling) is limited to not more than 75%of the ceiling fixed tor the Chancellor.

4. For the first time, a specific policy would beestablished for the Chancellor's pO'IWr to review actions taken by lower offlcials/

employees in the autonomous university, without prejudice to the President's review power as provided for in Article 50 of the Univer- sity Code.

5. This action of the Board automatically supersedes the speci- fic authorization gran.ted the Chancellor of UPLB (9215t Meeting of the Board, 29 November 1979) to delegate functions.

JUSTIFICATION:

AsChief Executive Officer of the autonomous university, the Chancellor also needs sufficient flexibility in the administration of the affairs of the university. Such flexlbilltv should include author- ity to delegate functions, considering that the Chancellor would not have sufficient time to personally discharge the functions assigned himbythe Board or the President orbyoperation of law.
