I NVITATION TO B ID

Kalinga State University now invites bids for the purchase of various books in compliance with KSU Universitihood. Delivery of the goods is required 15 calendar days after receipt of the purchase order. Bidders must, within five (5) years from the date of submission and receipt of bids, have executed a contract corresponding to the project, the value of which is at least fifty percent (50%) of the ABC of the project to be bid. All bids must be accompanied by bid documents in any of the acceptable forms and in the amount specified in ITB Clause 18.

The bids will be opened in the presence of the representatives of the bidders who choose to be present at the address below.

I NSTRUCTIONS TO B IDDERS

Unless otherwise specified in the BDS, the provider may subcontract parts of the goods to the extent that can be approved by the client and specified in the BDS. In the event that the customer determines that the subcontractor is ineligible, the delivery of such part of the goods to subcontractors will be prevented. Unless otherwise stated in the BDS, the financial component of the offer must contain the following:

Unless otherwise specified in the BDS, payment of the contract price shall be made in Philippine pesos. if the project is no longer needed, as determined by the head of the client; and. iii). Irrespective of the issuance of the order placement notice, the following conditions for placing the order shall apply:

The values ​​of current assets and current liabilities of the domestic bidder shall be based on the most recent Audited Financial Statements submitted to the BIR. 16.1(b) Bid prices for goods supplied from outside the Philippines shall be quoted in Philippine Pesos. Valid for a period of at least one hundred and twenty (120) calendar days in accordance with Article 28 of the IRR of R.A.

All notices required by the terms of the contract shall be effective only at the time of their receipt by the successful bidder.

G ENERAL C ONDITIONS OF C ONTRACT

This Contract shall be construed in accordance with the laws of the Republic of the Philippines. Payments will only be made upon a declaration from the head of the procuring entity that the goods have been delivered or delivered in accordance with the terms of this contract and have been duly inspected and accepted. Ten percent (10%) of the amount of each payment will be retained by the procuring entity to cover the supplier's warranty obligations under this contract, as set forth in GCC clause 17.

The performance bond remains valid until the client issues a certificate of final acceptance. The client may release the security deposit for performance and return it to the supplier after issuing the certificate of final acceptance under the following conditions: The client must notify the provider in writing in a timely manner of the identity of any representatives he has engaged for these purposes.

The delivery of the goods and/or the provision of services will be carried out by the supplier in accordance with the timetable prescribed by the contracting entity in Part VI. Supplier's liability under this Contract is as determined by the laws of the Republic of the Philippines subject to any additional provisions in the SCC. The contracting authority terminates this contract for non-performance if one of the following conditions is attached to its performance:

Before recovery can be made, the supplier must establish the loss under oath to the customer's satisfaction before recovery can be made. All decisions recommended by the CTRC must be approved by the client manager; and. h).

S PECIAL C ONDITIONS OF C ONTRACT

Risk and title are transferred from the supplier to the customer upon receipt and final acceptance of the goods at their final destination. Delivery of the goods must be made by the supplier in accordance with the conditions specified in section VI. Four copies of the invoice receipt for property signed by the procuring entity's representative at the project site.

The Supplier is required to provide all of the following services, including additional services, if any, specified in Section VI. a) provision of a detailed operation and maintenance manual for each appropriate unit of the goods supplied. The Supplier shall arrange for such packaging of the Goods as is necessary to prevent their damage or deterioration during transport to their final destination as specified in this Contract. The size and weight of the packaging box must, where relevant, take into account the remote location of the GOODS.'

The goods remain at the risk and title of the Supplier until their final acceptance by the Procuring Entity. The Supplier shall indemnify the Procuring Entity against all claims of third parties for infringement of patent, trademark or industrial design rights arising out of the use of the Goods or any part thereof. However, the inspection regarding the compliance of the goods with the technical specifications, its order and condition, will be done in the presence of the representatives of the Supplier and the Procuring Entity after prior notification, in writing or verbally, to the authorized representative of the Supplier.

The inspection will take place according to the scheduled time even in the absence of the supplier's representative, if the latter has been duly informed. In this case, the results of the control performed by the customer are final and binding for the supplier.

The contracting entity named in the BDS (hereinafter referred to as the "Processor") wishes to receive bids for the supply and delivery of the goods as described in Section VII. It intends to use part of the funds received for the project, as defined in the BDS, to cover eligible payments under the contract. Unless otherwise specified in the BDS, the contracting authority, as well as bidders and suppliers, must adhere to the highest ethical standards during the procurement and execution of the contract.

Failure to comply with any of the above obligations is the responsibility of the provider concerned.

C ONTENTS OF B IDDING D OCUMENTS

The bidder may identify the subcontractor to whom part of the goods will be subcontracted at any time during the bidding process or during contract performance. Supplementary/bid bulletins may be issued at the initiative of the procuring entity for the purpose of clarifying or amending any provision in the bid documents no later than seven (7) calendar days before the deadline for submission and receipt of bids. Any Supplemental/Bid Bulletin issued by the BAC shall also be posted on the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the concerned procuring entity, if available, and in any conspicuous place on the premises of the procuring entity.

However, bidders who submitted bids prior to the issuance of the Supplementary/bid bulletin must be informed and allowed to amend or withdraw their bids in accordance with ITB clause 23.

Failure to enter into a joint venture in the event of a contract award will be grounds for forfeiture of the bid security. ix) Bid Security in accordance with ITB Clause 18. The Bidder shall enter rates and prices for all items of the Goods described in the Bill of Quantities. Unless otherwise stated in the BDS, the price of the Goods will be quoted DDP with the place of destination in the Philippines as specified in the BDS.

The bidder shall submit a Bid Secured Declaration, or any form of bid security, for an amount not less than the required percentage of the ABC stated in the BDS, in accordance with the following schedule:.

No bid may be withdrawn between the deadline for submission of bids and the expiry of the bid validity period specified by the Bidder on the Financial Bid Form. In the event that one or more of the requirements in the second envelope of a specific bid are missing, incomplete or apparently insufficient, and/or if the submitted total bid price exceeds the ABC unless otherwise stipulated in ITB Clause 13.2, the BAC will bid worriedly rates as "failed". Documents, the said certification can be submitted in lieu of the requirements summarized in ITB Clause 12.1(a), items (i) to (v).

The documents described in Clause 12.1(a) of the ITB may be substituted by relevant equivalent documents, if any, issued by the country of the foreign bidder concerned.

The Procuring Entity shall prepare the minutes of the proceedings of the bid opening which shall include at least: (a) names of Bidders, their bid price, bid security, findings of preliminary investigation; and (b) attendance sheet. The ranking of the total bid prices as calculated from lowest to highest. A negative determination will result in the rejection of the Bidder's Bid, in which case the Procuring Entity will proceed to the next Lowest Calculated Bid to make a similar determination of that Bidder's ability to perform satisfactorily.

If the source of funding for the project has been withheld or reduced through no fault of the contracting authority.
