The tender documents shall clearly and adequately define, among others: (i) the objectives, purpose and results and/or expected results of the proposed contract; (ii) eligibility requirements of bidders; (iii) the expected duration of the contract; and (iv) the obligations, duties and/or functions of the successful bidder. Care should be taken to check the relationship of the provisions of the PBDs to the requirements of the specific Works to be procured. If duplication of a subject is unavoidable in other sections of the document prepared by the Procuring Entity, care must be taken to avoid contradictions between clauses dealing with the same issue.
Specific details, such as "name of procuring entity" and "address for submission of bids," must be provided in the instructions to bidders, the tender data sheet and special conditions of contract. The cover should be modified as necessary to identify the bidding documents as to the names of the project, contract and procurement entity in addition to the date of issue. Bid – A signed offer or proposal to assume a contract made by a bidder in response to and in accordance with the requirements of the bidding documents.

West Visayas State University-Lambunao Campus intends through its income (F164 2020) to apply the sum of TWO MILLION TWO MILLION TWO HUNDRED FOUR-FOUR-FOUR THOUSAND FOUR-FOUR THOUSAND PESOS and 62/100 ONLY (Php payments in under the contract for the construction of WVSU-Lambus Motorpool/Garage Bids received beyond ABC are automatically rejected upon opening of bids. The description of an eligible bidder is contained in the bidding documents, particularly in Section II. Bidding is limited to Filipino citizens/sole proprietorships, cooperatives and partnerships or organizations with at least sixty percent (60%) interest or outstanding capital belonging to citizens of the Philippines and to citizens or organizations of a country whose laws or regulations grant similar rights or privileges to Filipino citizens pursuant to RA5183.
It may also be downloaded free of charge from the Philippine Government Electronic Procurement System (PhilGEPS) website and the Procuring Entity's website, provided that bidders must pay the applicable tender documents fee no later than when submitting their bids. These clauses serve as a secondary source for the terms and conditions of the contract. If the Contractor incurs delay or costs because the Client has not given possession in accordance with the terms of this clause, the Client's representative will extend the contract period to the Contractor and confirm that the amount is fair to cover the costs incurred to be paid by the Client.
