Article (103)

1.Upon enforcement, if there is an objection and an interim procedure is required therein, the enforcement officer or the person against whom enforcement shall be made (respondent), may bring the objection before the enforcement judge to stay the enforcement or proceed with it.

2.In all cases, the enforcement officer may not complete the enforcement procedures before having a judgment issued by the judge, objection thereto shall be according to article No. (72) – clause no. (1) of this regulation.

3.The enforcement judge may decline issuing the decision referred to in clause No. (1) of this article and set a hearing according to normal procedures to adjourn the case if he finds the objection forms a substantive enforcement dispute, while continuing enforcement, unless the court that is hearing the dispute decided to stay the enforcement.

4.If an objection is filed in a case relating to real estates, according to normal procedures for bringing a case before the competent court, it shall result in a stay of enforcement unless the court orders otherwise.

5.Filing any other objection shall not result in staying the enforcement, unless the enforcement judge issued a stay judgment. The provisions of this paragraph shall apply to all objections filed after the occurrence of any substantive enforcement dispute that result in stay of enforcement.

Article (104)

A real offer shall not result in a stay of enforcement if the offer is subject to dispute;

and the enforcement judge may order a provisional stay of execution accompanied by a deposit of the thing offered or a greater sum that he may specifies.

Article (105)

If the enforcement judge permitted the registration of an enforcement objection, the objecting party shall pay a security deposit of AED 5000 upon registering the objection, which shall be redeemed if the objection is granted or confiscated by law, if objection is denied.

In all cases, an objection may not be admitted unless a proof of paying the security deposit is submitted.
