ORDER OF COURT

The following order has been made by the Court after considering the application lodged by the Applicant:

1. The Application for Condonation of the Applicants failure to comply timeously with the provisions of Rule 18(f), 18(g) and 18(h) is granted.

2. The application for leave to appeal is granted.

Thus ordered at JOHANNESBURG on 23 FEBRUARY 1998.

DIRECTIONS

Leave to appeal having been granted, the following directions have been given by the President of the Constitutional Court:

1. The appellants are to give notice to the Minister of Justice as required by rule 4(8) within five(5) days of the date of these directions, and a copy of such notice is to be lodged with the Registrar of the Constitutional Court. A copy of these directions and of the certificate given by the High Court in terms of rule 18(e) must be attached to the notice given to the Minister.

2. The record in the appeal is to consist of:

(a) The record lodged in the Transvaal High Court of South Africa in case no 14618/95.

(b) The judgment in this matter that was delivered by McCreath J and Van Dijk J in the High Court on 29 August 1997.

(c) The order made by the High Court on 6 November 1997 containing the certificate required in terms of rule 18(e).

3. Clean photocopies of the relevant documents may be used in preparing the record, which shall be securely bound in a suitable cover disclosing the names of the parties, the Court appealed from and the names of the attorneys of the parties. If the record is bulky, it shall be divided into separate conveniently sized volumes.

4. The record shall be prepared by the appellants and shall be lodged with the Registrar of the Constitutional Court by not later than 24 March 1998.

5. Written argument on behalf of the appellant shall be lodged with the Registrar by not later than 31 March 1998.

6. Written argument on behalf of the respondent shall be lodged with the Registrar by not later than 14 April 1998.

7. The matter is set down for hearing before the Constitutional Court at Johannesburg on Thursday 7 May 1998 at 10 a.m.
