34; 'Self-propelled motorboat' means any motorboat for hire or reward at the charge of the hirer thereof. -tuck side or stern. Every motorboat and watercraft shall be fitted with the following approved pleasure equipment of surveyor:-.
The certificate issued in respect of a motor boat or motor ship shall be displayed in a conspicuous place on the ship during the period of validity of the certificate. No motorboat or motor vessel shall carry a greater number of persons than the number stated in the certificate of survey and registration of the vessel as the maximum number of persons the vessel may carry. The Council may require that any motor boat or craft registered under this Part of the Regulations be provided with an approved radiotelephone system for the transmission and reception of messages.
Part V
A person who wishes to obtain permission under section 199 of the Act to organize or promote-. I). A permit issued by the Board under section 199 of the Act must be in Form 5 in Schedule III to these Regulations. A person shall not permit, permit or allow any vessel in his possession or control to be navigated or used for the purpose of any commercial water-skiing in any waters of the jurisdiction, unless the person permitted, permitted or suffered, is the legal holder of a permit issued by the board pursuant to letter c) of this regulation.
The Council may, in respect of any such waters of the jurisdiction, impose any conditions it deems necessary in the interests of public safety and/or convenience. The Council shall, by notices published from time to time in the Government Gazette, specify the waters of the jurisdiction which have been approved for water skiing and the respective conditions which it has imposed in respect thereof. A person shall not navigate or operate a speedboat on any waters of the jurisdiction unless he is the lawful holder of a license to operate a speedboat issued by the Board.
A person shall not operate or operate a water ski boat on any waters of the jurisdiction unless he is the lawful holder of a license issued by the Council to operate a water ski boat. iii). A person shall not authorize, authorize or permit any speed boat or water ski boat in his possession or control to be navigated or used on the waters of the jurisdiction unless the person to whom it is so permitted is authorized or suffered, is the rightful holder of a permit to operate a speed boat issued by the Board, or in the case of a water ski boat, a permit issued by the Board to operate a water ski boat. Examinations for licenses to operate speed boats and water ski boats shall be conducted from time to time by officials of the Board and by such other examiners as may be approved by the Board.
A license to drive a water ski boat will entitle the holder to drive a speed boat during the validity of the licence. A speedboat of more than 6·1 meters in length provided. the owner first had and obtained the written approval of the Council.
Part VI
Any owner of a motor boat or motor vessel who fails to apply for the registration of such vessel at the time required or to renew such registration annually shall be punished by a fine not exceeding sixty dollars ($60). No person shall use or navigate a motor boat or motor vessel which-. a) is not properly equipped with the prescribed equipment;. For any violation of this regulation, the person in charge of the navigation of a motorboat or motor vessel shall be punished by a fine not exceeding sixty dollars ($60).
The registration of a motorboat or watercraft may be renewed on payment of such fee as may be prescribed by the Board: Provided that the Board may refuse to renew the registration of any motorboat or watercraft which in any respect does not comply with these regulations. Ownership of such motorboat or watercraft is transferred to a dealer who holds it solely for the purpose of resale:.
In the case of a motorboat or watercraft registered under Part III or Part IV of these regulations, the current Certificate of Survey and Registration shall be delivered to the recipient by the Registrar upon approval of the transfer of registration therein. For the purposes of these regulations, any sale or lease of a motorboat or motor watercraft on hire-purchase shall be deemed and deemed to be a transfer of ownership of a motorboat or motor watercraft to the lessee. ii). No explosives shall be on board, nor shall any explosives be taken on board, any motor boat or watercraft;.
A person sailing or operating a motorboat or watercraft must at all times keep a proper lookout. The owner, any member of the crew and any other person on board a motorboat or watercraft shall give his name and correct address to an inspector or surveyor when requested by the inspector or surveyor.
SCHEDULE I
The Council may, in its discretion, exempt any vessel of a new, unusual or experimental design, and its owner, master, operator or crew, from all or any part of the provisions of these Regulations and the navigation and use of a permit such vessel subject to such terms, conditions and provisions as it may deem fit to impose. The following testing fees are payable to the Council: (a) For testing a prototype vessel: $10; And. b) For testing a prototype or specimen of equipment.
SCHEDULE III
This is to certify that, having passed the prescribed examination, is hereby licensed as a driver of a water ski boat in terms of the provisions of the Queensland Marine Act to take charge of the navigation and control of a water ski boat boat in approved waters within the jurisdiction. Give the full name of the Club or Organisation;. tSpecify whether race, attempt to set or break a speed record, speed test, regatta or other aquatic carnival;.
