ITEM-1 CONFIRMATION OF MINUTES RESOLUTION

The Minutes of the Development Assessment Unit Meeting of Council held on 27 June 2017 be confirmed.

ITEM-2 DA NO. 1462/2017/HA - USE OF PART OF AN EXISTING BUILDING AS A HOME BUSINESS - LOT 2 DP 135824, NO. 58A ANNANGROVE ROAD, KENTHURST

RESOLUTION

The Development Application be refused on the following grounds:

(i) The proposal does not meet the definition of a home business under LEP 2012.

(Section 79C(a)(i) of the Environmental Planning and Assessment Act, 1979).

(ii) The proposal is best defined as a detached dual occupancy which is a prohibited use in the RU6 Transition zone.

(Section 79C(a)(i) of the Environmental Planning and Assessment Act, 1979).

(iii) The floor area will contribute to the total floor area of the secondary dwelling and will result in a non-compliance with Clause 5.4(9) of LEP 2012. Clause 5.4 cannot be varied under Clause 4.6 of LEP 2012 as it is excluded from the operation of the clause by Clause 4.6(8) of LEP 2012.

(Section 79C(a)(i) of the Environmental Planning and Assessment Act, 1979).

NB: Late submissions from the applicant were tabled and discussed at the meeting.

One of the submissions received at 7.32am on 4 July 2017 withdraws the application. Therefor the application is withdrawn.
