SUMMARY OF REPORT:
Council has received an application for a circus to use the Goorimahbah Precinct of Jack Evans Boat Harbour for four weeks from 31 December 2017 to 30 January 2018. Council’s practise in recent years has been to allow two weeks plus bump-in and bump-out time. This is because of concerns regarding the social impact of a circus occupying a high profile park for an extended length of time.
RECOMMENDATION:
That the Tweed Heads Jack Evans Boat Harbour Reserves Trust approves the application to hold a circus in the Goorimahbah Precinct of Jack Evans Boat Harbour for a two week period plus bump-in and bump-out days.

The Tweed Heads Jack Evans Boat Harbour Reserve Trust has received an application for a circus to use the Goorimahbah Precinct of Jack Evans Boat Harbour for four weeks from 31 December 2017 to 30 January 2018. The Trust's practice in recent years has been to allow two weeks plus bump-in and bump-out time and there have been no issues. In 2014 a circus was allowed to stay at that site for around four weeks. There were complaints from park users and adjoining residents about the length of time it was there.
Section 2.4.3 of the Tweed Shire Council draft “Commercial Recreation Activities on Public Open Space Policy”, which is currently out on exhibition, states:
“Activities that are consistent with this policy, and are considered to provide primarily economic rather than social benefits, and where the social or environmental impacts are considered significant, will be referred to Council for determination.”
Section 2.4.6 of the Tweed Shire Council draft “Commercial Recreation Activities on Public Open Space Policy” says:
“A license will not ordinarily be granted within 100 meters of a neighbouring residential property for higher impact activities.”
The circus location is around 80 metres from some residences.
The circus making the request will occupy around 100m x 70m with one large tent, a foyer tent, 20 staff and 12 caravans. Circus staff live onsite in the caravans. There are no circus animals. The circus is considered quite large, although not as big as the Moscow Circus from several years ago.
The requested booking period is 31 December 2017 to 30 January 2018. This includes the peak holiday period at New Year and early January. Circus management has indicated that while four weeks is strongly desired, a lesser time would be considered if that is all that’s available.
It is not uncommon for circuses to request more than two weeks. It is likely that, particularly for large circuses, the cost of moving is significant and longer periods in one location is a desirable business model. There is nothing to quantify this however.
The extended booking period, the relatively large size and the time of year proposed suggest this event could have significant social and environmental impacts and accordingly it is being referred to the Trust for consideration.
OPTIONS:
1. The Trust approves the circus for the full four weeks requested.
2. The Trust approves the circus for three weeks plus bump-in and bump-out.
3. The Trust approves the circus for two weeks plus bump-in and bump-out.

4. The Trust does not approve the circus.
CONCLUSION:
The Trust has received a request for a circus to occupy the Goorimahbah Precinct of Jack Evans Boat Harbour for four weeks. In recent years the Trust has only allowed circuses to stay two weeks plus bump-in and bump-out time because of concerns regarding the social impact of a circus occupying a high profile park for an extended length of time. Two weeks plus bump-in and bump-out time is considered appropriate.
COUNCIL IMPLICATIONS:

The fee for the circus is $125 for bump in/out days and $250 per day. The recommendation of two weeks plus bump in/out will amount to $3,838 (allowing two days bump in/out) in total fees to be paid.
