PROGRAM PERTAMA PERSETUJUAN KEBUDAYAAN
ANTARA PEMERINTAH REPUBLIK INDONESIA DE NGAN
PEMERINTAH REPUBLIK ITALIA UNTUK TAHUN 2002-2005
Pemerintah Republik Indonesia dan Pemerintah Republik Italia, selanjutnya disebut "Para Pihak";
Merujuk Pasal 9 Persetujuan Kebudayaan antara Pemerintah Republik Indonesia dan Pemerintah Republik Italia tentang Kerjasama Kebudayaan, ditandatangani di Jakarta tanggal 20 Oktober 1997;
Berkeinginan untuk mengembangkan hubungan kebudayaan antara kedua negara;
Didorong oleh komitmen bersama untuk meningkatkan sesuai kemampuan masing-masing, peningkatan kerjasama dalam bidang yang akan disebutkan kemud ian didasarkan pad a kesamaan, saling menghormati dan saling menguntungkan;
Sesuai ketentuan hukum dan perundang-undangan yang berlaku di masing-masing negara;
Telah menyetujui hal-hal sebagai berikut: 1. PENDIDIKAN
a. Pendidikan Dasar
Para Pihak akan saling tukar-menukar buku-buku, penerbitan dan audiovisual yang bertujuan untuk meningkatkan pengetahuan kebudayaan masing-masing dan sistem pendidikan serta akan menjajagi kemungkinan kekefllbaran di antara sekolah-sekolah dan lembaga-lembaga pendidikan.

b. Pengajaran Bahasa.
b.1. Para Pihak akan meningkatkan pelajaran bahasa dan kebudayaan masing-masing di kedua negara. b.2. Dalam hal ini, Pemerintah Republik Italia telah
menyiapkan dukungan keuangan bagi penunjukan seorang pengajar bahasa Italia dan buku-buku dalam bahasa Italia, kesusasteraan, sejarah dan geografi, untuk penyebaran bahasa dan kebudayaan Italia kepada lembaga pendidikan Indonesia yang memintanya melalui saluran diplomatik.
c. Pendidikan Tinggi
c.1. Para Pihak akan mendorong kerjasama di bidang-bidang yang lain termasuk Hak Azasi Manusia dengan meningkatkan kegiatan kebudayaan yang bertujuan untuk mengembangkan persepsi pentingnya hal tersebut dan mendukung persamaan kesempatan antara pria dan wanita, kerjasama antar universitas dan lembaga pendidikan tinggi di negara masing-masing dengan pembuatan pengaturan khusus untuk pertukaran profesor; informasi dan data, serta melalui kerjasama proyek penelitian.
c.2. Para Pihak akan saling memberitahukan persetujuan antar universitas yang telah ada dan yang akan dibuat di masa mendatang.
c.3. Para Pihak akan mengadakan pertukaran kunjungan tahunan paling banyak 4 orang dosen universitas dan/atau peneliti untuk jangka waktu sampai dengan 10 hari, untuk memberikan konferensi-konferensi atau seminar-seminar, dan memulai kontak pada tingkat akademik yang memberikan prioritas pada kunjungan-kunjungan yang bertujuan untuk membentuk kerjasama universitas.
2. BEASISWA
a. Pemerintah Republik Italia akan menyediakan beasiswa kepada 56 orang per bulan dalam bidang kebudayaan
dan 110 orang per bulan dalam bidang ilmu pengetahuan kepada warganegara Indonesia untuk tahun akademik 2002-2003/2003-2004/2004-2005.
b. Pemerintah Republik Indonesia setiap tahun akan menyediakan beasiswa non-gelar dalam kerangka program Darmasiswa kepada sekurang-kurangnya 2 orang warganegara Italia.
c. Setiap pihak dapat mengubah jumlah orang per bulan yang ditawarkan untuk tahun akademik berikutnya, disesuaikan dengan dana yang tersedia pada setiap tahun anggaran. Semua perubahan harus diberitahukan melalui saluran diplomatik.
d. ISIAO (Institute Italiano per !'Africa e l'Oriente), sesuai dengan anggaran dan prioritasnya, berkeinginan untuk menawarkan beasiswa non-gelar dalam kerangka program beasiswa di bidang studi Afrika dan Asia kepada sarjana Indonesia yang meminta.
3. BUDAYA DAN SENI
a. Pameran-pameran Seni dan Kegiatan-kegiatan dan Kerjasama di bidang Kesenian.
a.1. Pemerintah Republik Italia telah mendirikan Pusat Kebudayaan Italia di Jakarta untuk meningkatkan saling pengertian dan penghargaan melalui kebudayaan dan pertukaran budaya.
a.2. Para Pihak akan mengadakan pertukaran pameran tingkat tinggi. pengaturan yang relevan, demikian juga bidang keuangan akan ditetapkan melalui saluran diplomatik berdasarkan kasus per kasus. a.3. Para Pihak akan mengadakan pertukaran dan
memfasilitasi kegiatan budaya di sektor-sektor seni rupa dan seni drama dan akan mendukung pertukaran informasi mengenai festival, pameran, perayaan dan kegiatan budaya utama yang diselenggarakan di masing-masing negara.
b. Perlindungan Peninggalan Budaya
b.1. Para Pihak akan melakukan pertukaran informasi, para pakar dan pengalaman di bidang perlindungan, pemeliharaan, konservasi dan restorasi budaya, seni, arsitektur serta tempat peninggalan.
b.2. Para Pihak bekerjasama, melalui badan masing-masing yang berwenang, untuk mencegah segala bentuk imper, ekspor, atau pemindahan peninggalan budaya yang melanggar hukum, dalam penerapan ketentuan konvensi-konvensi dan persetujuan-persetujuan internasional yang berlaku di kedua negara demikian pula terhadap perundangan domestik setiap negara, dimana untuk tujuan ini mereka sepakat untuk menempuh semua langkah-langkah yang tepat.
b.3. Para Pihak akan menjajagi kemungkinan untuk membentuk, apabila diperlukan, sebuah kelompok kerja "ad hoc".
b.4. Para Pihak juga melaksanakan kerjasama dalam rangka membantu identifikasi dan pengembalian ke pemilik sebenarnya setiap karya seni atau warisan budaya yang telah memasuki wilayah mereka melaui jalan dan cara-cara apapun.
c. Museum-museum
Para Pihak akan mendorong kerjasama diantara administrasi museum masing-masing, melalui kerjasama tehnis, pertukaran publikasi-publikasi ilmiah, salinan-salinan dokumen serta peraturan-peraturan secara timbal balik.
d. Arsip
d.1. Para Pihak akan mendorong kerjasama kearsipan dan administrasi masing-masing, melalui pertukaran publikasi-publikasi ilmiah, mikrofilm, salinan-salinan dokumen dan peraturan-peraturan secara timbal balik.
d.2. Pemerintah Republik Italia (Direktorat Jenderal Kearsipan dari Kementerian Warisan dan Kegiatan Budaya) menyatakan keinginannya untuk mengorganisir tahap-tahap pelatihan khususnya di bidang perlindungan dan restorasi, transfer cetak, pembundelan buku dan restorasi Pusat Arsip Negara.
d.3. Para Pihak akan memfasilitasi akses ke arsip sejarah yang tersedia di Kementerian-kementerian Luar Negerinya, berdasarkan prinsip timbal balik dan tunduk kepada peraturan dan perundang-undangan yang berlaku, serta memfasilitasi pertukaran publikasi-publikasi mengenai dokumen-dokumen sejarah diplomatik kedua Kementerian.
e. Perpustakaan dan Penerbitan
e.1. Para Pihak ( untuk Pemerintah Republik Italia Departemen Pertukaran lnternasional dari Direktorat Jenderal Buku-Buku Peninggalan dari Kementerian Kegiatan Seni dan Peninggalan Budaya), akan mempromosikan pertukaran buku-buku, publikasi-publikasi, dan kepustakaan berkala antar perpustakaan'."perpustakaan, akademi-akademi dan lembaga budaya di kedua negara.
e.2. Para Pihak akan melakukan pertukaran salinan-salinan dan mikrofilm buku-buku yang tersimpan di Perpustakaan Nasional.
e.3. Direktorat Jenderal Buku-buku Peninggalan pada Kementerian Kegiatan dan Peninggalan Budaya menyatakan kesediaannya, untuk mengirimkan ahli-ahli di bidang konservasi, restorasi, penyusunan katalog, teknologi komputer, bangunan perpustakaan dan peningkatan aset-aset kepustakaan.
e.4. Pemerintah Republik Italia (Direktorat Jenderal Buku-buku Peninggalan pada Kementerian Kegiatan dan Peninggalan Budaya-MBAC) menyatakan keinginannya, selama jangka waktu pelaksanaan Program ini, untuk mengirim satu pameran penerbitan dan/atau tinjauan yang menunjukkan
pelestarian dan peningkatan kegiatan tentang buku peninggalan.
e.5. Divisi Penerbitan Kementerian Kegiatan dan Peninggalan Budaya (Divisione Editoria pada Kementerian Kegiatan dan Peninggalan Budaya) menyatakan kesediaannya untuk mengirim buku-buku mengenai berbagai bidang dan subyek kepada universitas dan lembaga-lembaga pendidikan tinggi lainnya. Permintaan-permintaan akan dilakukan melalui saluran diplomatik.
e.6. Pemerintah Republik Italia memberitahukan bahwa pemberian penghargaan dan hibah yang ada adalah:
• Penghargaan dan hibah (Kementerian Luar Negeri - D.G.P.C.C.) untuk penerbit Italia dan/atau Indonesia serta penterjemah untuk terjemahan karya sastra dan buku-buku ilmiah dan untuk produksi, pengisian suara serta pemberian sub judul film pendek dan panjang yang termasuk dalam proyek-proyek penting. • Pengajuan permohonan harus ditujukan
kepada Departemen Luar Negeri melalui Kedutaan Besar Italia di Indonesia dari tanggal 31 Maret hingga 30 September.
• Penghargaan Terjemahan Nasional, dibawah pengawasan Presiden Republik, dianugerahkan oleh Divisi Penerbitan Kementerian Kegiatan dan Peninggalan Budaya, kepada penterjemah dan penerbit Italia dan asing. Permohonan harus diajukan melalui saluran diplomatik setiap tahun pada tanggal 31 Maret.
• Pusat untuk para penerjemah dan prakarsa yang bertujuan untuk mendukung terjemahan (Centro per i Traduttori e le lniziative a favore della Traduzione) Divisi MBAC tersebut di atas berkeinginan untuk memulai mengadakan
hubungan-hubungan dengan mitra kerja yang berwenang di Indonesia.
• Penghargaan-penghargaan bagi penterjemah buku-buku Italia ke dalam bahasa-bahasa asing diberikan oleh Departemen lnformasi dan Penerbit pada kantor Perdana Menteri. Permohonan harus diajukan melalui saluran diplomatik setiap tahun pada tanggal 30 September.
f. Radio-TV
Para pihak akan mendorong pertukaran di bidang radio dan televisi guna meningkatkan dan memfasilitasi pemahaman tentang kegiatan-kegiatan di kedua negara dan perkembangan antar lembaga-lembaga terkait sebagai berikut:
f.1. Menyelenggarakan kursus kejuruan bagi para jurnalis, teknisi dan pembuat program, kemungkinan mengupayakan beasiswa-beasiswa yang ditawarkan oleh kedua negara;
f.2. Mengizinkan sambungan program-program televisi melalui satelit;
f.3. Memfasilitasi keikutsertaan pada festival radio/tinjauan program TV di kedua negara;
f.4. Menyelenggarakan festival program radio-TV; f.5. Menayangkan program-program standar dalam
bahasa asli. 4. FASILITAS-FASILITAS
Para Pihak akan menawarkan perlakuan yang paling menguntungkan, yang sesuai dengan perundangan-undangannya, kepada individu atau kelompok yang berkunjung ke negara lain dalam misi atau untuk kegiatan dalam lingkup Program ini yang berhubungan dengan masuk, tinggal atau keberangkatannya serta dalam kaitannya dengan impor
sementara barang-barang yang diperlukan untuk tujuan penyelesaian misi atau penampilan kegiatannya.
5. BENTUK-BENTUK PELAKSANAAN
Bentuk-bentuk kegiatan yang tercakup dalam Program ini dapat dilaksanakan melalui pengembangan suatu pengaturan yang spesifik, program atau proyek antar lembaga atau organisasi yang sesuai dari Para Pihak melalui saluran diplomatik atau Komisi Budaya Bersama. Pengaturan-pengaturan, program-program atau proyek-proyek tersebut hendaknya menjelaskan antara lain, tujuan, pengaturan pembiayaan serta hal-hal rinci lainnya yang berkaitan dengan kegiatan-kegiatan tertentu dari semua peserta yang terlibat. 6.PENGATURAN KEUANGAN
Para Pihak setuju bahwa semua inisiatif yang disebutkan dalam Program ini akan dilaksanakan, dalam batasan sumber-sumber keuangan tahunan yang ditentukan oleh anggaran masing-masing.
7. HAK CIPTA
Ketentuan dalam Program ini harus tunduk pada hukum dan peraturan yang berlaku di masing-masing wilayah Para Pihak mengenai perlindungan hak cipta dan hak-hak terkait lainnya dari setiap hasil kegiatan-kegiatan di bidang ilmu pengetahuan, seni dan kesusasteraaan sepanjang belum diatur dalam persetujuan umum yang bersifat internasional.
8. AMANDEMEN
Program ini dapat dikaji ulang atau diubah setiap saat atas persetujuan bersama secara tertulis oleh Para Pihak melalui saluran diplomatik. Revisi atau perubahan tersebut akan mulai berlaku pada tanggal yang akan ditetapkan oleh Para Pihak dan akan merupakan bagian yang tak terpisahkan dari Program ini.
9. KOMISI BERSAMA KEBUDAYAAN
Pertemuan Komisi Budaya Bersama akan diadakan secara bergantian, di Jakarta atau di Roma. Tanggal pertemuan akan disetujui bersama melalui saluran diplomatik.
10. MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN
Program m1 akan mulai berlaku sejak tanggal penandatanganan.
Program ini akan tetap berlaku sampai dengan 31 Desember 2005.
Pengakhiran Program ini tidak akan mempengaruhi keabsahan dan jangka waktu setiap program atau kegiatan yang sedang berjalan yang dibuat berdasarkan Program ini.
11. LAMPIRAN
Ketentuan umum dan ketentuan keuangan yang diatur dalam Lampiran I dan Lampiran II akan merupakan bagian yang tak terpisahk~n dari Program ·ini.

KETENTUAN UMUM DAN KEUANGAN DALAM RANGKA PERTUKARAN
PROGRAM PERTAMA PERSETUJUAN KEBUDAYAAN
ANTARA
PEMERINTAH REPUBLIK INDONESIA DAN
PEMERINTAH REPUBLIK ITALIA TAHUN 2002-2005
Beasiswa
a. Pemilihan calon penerima beasiswa akan dibuat setiap tahun di masing-masing negara oleh Komisi Bersama termasuk paling tidak seorang wakil dari Kedutaan dari negara pemberi beasiswa.
b. Daftar nama calon terpilih akan mencantumkan juga nama calon cadangan, dan akan diajukan ke Kedutaan dari negara pemberi beasiswa dalam batas waktu tertentu. Galon yang tidak tercantum dalam daftar tersebut di atas tidak dapat diterima.
c. Setiap Pihak akan memberitahukan Pihak yang lain, apabila memungkinkan dalam waktu 2 bulan sebelum dimulainya tahun akademik, apakah calon yang diusulkan dan bidang yang akan dipelajari telah diterima serta akan menunjuk lembaga yang akan menerimanya.
d. Penerima beasiswa tidak akan meninggalkan negara penerima sebelum diterimanya, dari Kedutaan Besar negara pemberi beasiswa, pemberitahuan formal yang menyebutkan tanggal keberangkatan secepatnya. e. Pemerintah Republik Italia akan memberikan kepada
penerima beasiswa Indonesia:
e.1. Tunjangan keseluruhan per bulan sekurang-kurangnya 619,75 Euro;
e.2. Asuransi kesehatan dan asuransi kecelakaan tidak termasuk gejala penyakit yang ada dan pemasangan gigi.
f. Pemerintah Republik Indonesia akan memberikan pelayanan medis kepada pemegang beasiswa Italia pada pusat-pusat kesehatan masyarakat, secara gratis, dalam hal terjadi sakit mendadak.
Pertukaran Kunjungan
Pertukaran kunjungan seperti diatur dalam Pasal 1.c.3. Program ini akan dilakukan sebagai berikut:
a. Pihak pengirim akan memberitahukan pihak penerima melalui saluran diplomatik paling lambat 3 (tiga) bulan sebelumnya:
a.1. Nama dan kebangsaan (harus warganegara Italia untuk orang yang akan berkunjung ke Indonesia dan warganegara Indonesia yang berkunjung ke Italia) pengunjung, riwayat hidup dan penguasaan bahasa asing;
a.2. Program yang di~sulkan untuk kunjungan mereka, seperti biasanya mengindikasikan nama mata kuliah dan nama pengajar penerima serta jurusan di universitasnya;
a.3. Rencana tanggal dan lama kunjungan.
b. Pihak penerima akan memberitahukan jadwal kepastian penerimaan kunjungan paling lambat empat minggu sebelum tanggal rencana kedatangan.
c. Pihak pengirim akan menanggung biaya perjalanan pulang-pergi dari ibu kota yang satu ke ibu kota yang lain.
d. Pihak penerima akan menanggung biaya perjalanan antar kota di wilayah negaranya, sebagaimana tercantum dalam rencana kunjungan.
e. Pihak penerima akan menanggung biaya penginapan sebagaimana dijelaskan berikut ini:
e.1. Pemerintah Republik Italia akan menanggung seluruh biaya uang harian bagi tamunya dari Indonesia sebesar 93 Euro.
e.2. Pemerintah Indonesia menanggung uang bulanan bagi tamunya dari Italia dengan jumlah minimal Rp. 350.000,- bagi setiap peserta Darmasiswa.
Pameran Seni
Sebagaimana disebut dalam Pasal 3.a.2, pertukaran pameran yang diatur dalam Program ini akan dilaksanakan sesuai dengan ketentuan-ketentuan keuangan sebagai berikut:
a. Pihak pengmm pameran akan bertanggung jawab atas biaya-biaya sebagai berikut:
a.1. mencakup biaya asuransi transportasi ke dan dari Pihak penerima dan selama pameran; a.2. biaya transportasi pameran ke lokasi
pertunjukan pertama dan kepulangan dari lokasi pertunjukan terakhir;
a.3. biaya perjalanan bagi para ahli yang mendampingi pameran ke lokasi pertunjukan pertama dan juga biaya kepulangannya dari lokasi pertunjukan terakhir Uika dibutuhkan lebih banyak ahli, jumlah dan lama tinggalnya akan disetujui kasus per kasus melalui saluran diplomatik).
b. Pihak penerima pameran akan menanggung biaya-biaya sebagai berikut:
b.1. biaya transportasi barang pameran didalam wilayahnya;
b.2. biaya promosi dan persiapan pelaksanaan pameran, termasuk pembayaran sewa gedung; b.3. pengeluaran untuk penerbitan katalog, kecuali

b.4. biaya transportasi lokal, biaya penginapan untuk para ahli yang mendampingi pameran; b.5. pengeluaran untuk pajak, termasuk pengapalan
barang pameran;
b.6. dalam hal terjadi kerusakan barang, negara penerima harus menyampaikan seluruh catatan yang berhubungan dengan kerusakan kepada negara pengirim. Biaya perkiraan kerusakan akan ditanggung oleh negara penerima. Jika tidak ada persyaratan khusus, perbaikan dapat dilakukan tanpa ijin tertulis dari negara pengirim.
Sinema
Biaya-biaya untuk pengorganisasian pameran dan festival film akan disetujui Para Pihak berdasarkan kasus per kasus, sesuai dengan fasilitas dan kondisi keuangan yang dapat diterima oleh kedua negara.
Kesusasteraan, seni, musik, drama, opera, kesenian tradisional, film, radio, televisi dan karya sejenis lainnya yang dilindungi oleh hukum hak milik intelektual di wilayah masing-masing Pihak juga akan dilindungi di wilayah Pihak lainnya sesuai dengan ketentuan hukum yang berlaku untuk karya-karya ini, tanpa mengesampingkan ketentuan-ketentuan dalam Perjanjian-perjanjian atau Konvensi-konvensi internasional dimana Para Pihak telah menjadi Pihak.

italiana, nonche libri sulla lingua, letteratura, storia e geografia italiane, per diffondere la lingua e la cultura italiana, alle istituzioni educative indonesiane che ne faranno richiesta attraverso i canali diplomatici.
c. lstruzione superiore
c.1. Le Parti incoraggeranno la cooperazione in differenti campi, inclusi i diritti umani, promuovendo attivita culturali volte a sviluppare la percezione deila loro importanza ed a favorire ie pari opportunita tra uomini e donne; svilupperanno la cooperazione tra le universita e gli istituti di studi superiori dei propri Paesi, attraverso la conclusione di accordi e convenzioni, lo scambio di docenti, informazioni e dati, come pure per mezzo di progetti di ricerca congiunti.
c.2. Ciascuna delle Parti informera l'altra in merito agli accordi lnteruniversitari esistenti ed a quelli che verranno conclusi in futuro.
c.3. Le Parti si scambieranno annualmente visite di fino a 4 docenti e/o ricercatori universitari per 10 giorni, per conferenze o seminari e per avviare contatti a livello accademico, assegnando la priorita alle visite intese ad avviare collaborazioni tra universita.
2. BORSE DI STUDIO
a. La Parte italiana offrira borse di studio per 56 mensilita, piu 11 O mensilita nel settore scientifico a cittadmi indonesiani per gli anni accademici 2002-2003; 2003-2004 e 2004-2005.
b. La Parte indonesiana offrira annualmente fino a 2 (due) borse di studio a cittadini italiani nell'ambito del programma Dharmasiswa .
c. Ciascuna Parte potra modificare ii numero delle mensilita dei successivi anni accademici, conformemente ai fondi disponibili per ciascun anno fiscale. Ogni modifica verra notificata attraverso i canali diplomatici.
d. L'ISIAO (lstituto Italiano per l'Africa e l'Oriente), sulla base delle 2
proprie disponibilita di bilancio e delle proprie priorita, intende offrire una borsa di studio, nel quadro dei propri programmi di studi sull'Africa e l'Asia, a cittadini indonesiani che ne facciano richiesta.
3. CUL TURA E ARTE
a. Mostre d'arte, eventi e collaborazione nel settore artistico
a.1. II Governo della Repubblica italiana ha insediato a Jakarta l'lstituto Italiano di cultura per incrementare la reciproca comprensione tra i due Paesi, attraverso la cultura e gli scambi culturali.
a.2. Le Parti si scambieranno mostre di alto livello. Le intese relative, incluse quelle finanziari.e, verranno definite, caso per caso attraverso i canali diplomatici
a.3. Le Parti favoriranno lo scambio eventi culturali nel settore delle arti visive e dello spettacolo e lo scambio di informazioni su festival, celebrazioni ed eventi culturali di rilievo organizzati nei rispettivi Paesi.
b. Protezione del Patrimonio Culturale
b.1. Le Parti favoriranno lo scambio d'informazioni, esperti ed esperienze nel campo della protezione, conservazione e restauro del patrimonio culturale, artistico architettonico e paesaggistico.
b.2. Le Parti, attraverso le competenti Autorita dei due Paesi, si impegnano a cooperare per impedire ogni illecita importazione, esportazione e trasferimento di beni culturali, ad attuare le norme delle Convenzioni e degli Accardi internazionali vigenti in entrambi i Paesi, nel rispetto delle normative e della legislazione interna ad ognuno dei due Paesi, e concordano a tal fine di prendere le opportune misure.
b.3. Le Parti esamineranno la possibilita di istituire, qualora necessario, un gruppo di lavoro ad hoc.
c. Musei
b.4. Le Parti si impegnano altresi a cooperare per facilitare l'individuazione e la restituzione agli aventi titolo delle opere d'arte e dei beni culturali illecitamente pervenuti nel proprio territorio.
Le Parti incoraggeranno la cooperazione tra le rispettive amministrazioni museali, attraverso lo scambio di pubblicazioni scientifiche, copie di documenti e regolamenti, conformemente alle loro legislazioni nazionali e su basi di reciprocita.
d. Archivi
d.1. Le Parti incoraggeranno la cooperazione tra le rispettive Amministrazioni degli Archivi, attraverso lo scambio di pubblicazioni scientifiche, microfilm, copie di documenti e regolamenti, conformemente alla rispettiva legislazione nazionale e su basi di reciprocita.
d.2. La Parte italiana (Direzione generale per gli Archivi del Ministero per i Beni e le Attivita Culturali) si dichiara disponibile ad organizzare stage professionali, con particolare riferimento ai settori della conservazione e del restauro, presso ii centro di fotoriproduzione, legatoria e restauro degli Archivi di Stato.
d.3. Le Parti faciliteranno l'accesso agli Archivi storici dei rispettivi Ministeri degli Affari Esteri, secondo ii principio di reciprocita, conformemente alle norme e regolamenti vigenti, e faciliteranno altresi lo scambio di pubblicazioni relative ai documenti storici e diplomatici dei due Ministeri. e. Biblioteche e Editoria
e.1. Le Parti (per la Parte italiana la Divisione Editoria della Direzione Generale per i Beni Librari del Ministero per i Beni e le Attivita Culturali) promuoveranno lo scambio di libri, pubblicazioni e periodici tra biblioteche, accademie e istituzioni culturali dei due Paesi.
e.2. Le due Parti effettueranno, conformemente alle rispettive legislazioni interne, lo scambio di riproduzioni e microfilm del materiale librario custodito nelle Biblioteche Nazionali.
e.3. La Direzione Generale per i Beni Librari e gli lstituti Culturali del Ministero per i Beni e le Attivita Culturali, si dichiara disponibile, qualora richiesto, ad inviare esperti nel settore della conservazione, del restauro, della catalogazione, dell'informatica, dell'edilizia bibliotecaria e della promozione dei beni librari.
e.4. La Parte italiana (Direzione Generale per i Beni Librari e gli lstituti Culturali del Ministero per i Beni e le Attivita Culturali) si dichiara disponibile, nel periodo di validita del presente Programma, ad inviare una mostra e/o rassegna editoriale volte ad illustrare l'attivita di tutela e valorizzazione nel settore del patrimonio librario.
e.5. La Divisione Editoria del Ministero per i Beni e le Attivita culturali manifesta la propria disponibilita a fornire libri di qualsiasi disciplina e materia alle Universita e lstituzioni Culturali che ne facciano richiesta per le vie diplomatiche e.6. La Parte italiana informa dell'esistenza dei seguenti premi
e contributi:
Premi e contributi finanziari (Ministero Affari Esteri -D.G.P.C.C.) a editori e traduttori italiani e/o indonesiani per la traduzione di opere letterarie e scientifiche, per la sottotitolatura e ii doppiaggio di cortometraggi e lungometraggi facenti pa rte di progetti significativi. Le domande documentate dovranno essere inoltrate al Ministero degli Affari Esteri tramite la Rappresentanza diplomatica italiana entro ii 31 marzo o ii 30 settembre di ciascun anno.
- "Premio nazionale per le traduzioni", sotto l'Alto Patronato del Presidente della Repubblica, assegnato dalla Divisione Editoria del Ministero dei Beni Culturali ed Ambientali anche a traduttori ed editori stranieri. Le domande andranno inoltrate tramite canali diplomatici entro ii 31 marzo di ciascun anno.
- II Centro per i traduttori e le iniziative a favore della traduzione della citata Divisione Editoria del Ministero dei Beni Culturali ed Ambientali
e
disposto ad avviare contatti con le competenti istituzioni indonesiane.- Premi a traduttori di libri italiani in lingue straniere, assegnati dal Dipartimento lnformazioni ed Editoria della Presidenza del Consiglio dei Ministri. Le domande andranno inoltrate per ii tramite dei canali diplomatici entro ii 30 settembre di ciascun anno.
f. Radio e T elevisione
Le Parti favoriranno gli scambi nel settore radiotelevisivo, al fine di promuovere e facilitare in entrambi i Paesi la conoscenza di avvenimenti e sviluppi tra le competenti istituzioni nei seguenti settori:
f.1. Organizzazione di corsi professionali e brevi stage di aggiornamento professionale per giornalisti, tecnici e programmisti, eventualmente utilizzando anche le borse di studio offerte dai due Paesi;
f.2. Ricezione dei programmi televisivi diffusi via satellite; f.3. Partecipazione a festival e rassegne radiotelevisive nei
due Paesi;
f.4. Organizzazione di festival di programmi radiotelevisivi; f.5. Trasmissione di programmi standard in lingua originale.
4. AGEVOLAZIONI
Le Parti offriranno ii trattamento piu favorevole, compatibile con le rispettive legislazioni, alle persone o gruppi che si rechino nell'altro Paese per missioni o attivita inquadrate nel presente Programma, tanto in ci6 che si riferisce all'entrata, alla permanenza o all'uscita delle persone quanto all'importazione temporanea degli oggetti necessari al compimento della missione o alla realizzazione dell'attivita.
5. DISPOSIZIONI ATTUATIVE
Le attivita descritte nel presente Programma possono essere realizzate attraverso lo sviluppo di specifici accordi, programmi o progetti tra le specifiche istituzioni o organizzazioni delle Parti, attraverso canali diplomatici o attraverso la Commissione mista. Tali accordi, programmi e progetti devono precisare, oltre al resto, le specifiche disposizioni finanziarie e gli altri dettagli relativi agli specifici impegni di tutti i soggetti partecipanti.
6. DISPOSIZIONI FINANZIARIE
Le Parti convengono che tutte le iniziative di cui al presente Programma saranno attuate nei limiti delle risorse finanziarie stanziate annualmente nei rispettivi bilanci.
7. COPYRIGHT
Qualsiasi prodotto delle attivita nei settori della scienza, delle arti e della letteratura realizzati all'interno del presente programma sara soggetto alle leggi ed ai regolamenti riguardanti la tutela della proprieta intellettuale e dei diritti che ne derivano nei territori delle Parti nella misura in cui esso non
e
coperto da un accordo generale di carattere internazionale.8. REVISIONI
II presente Programma pu6 essere riveduto o emendato in qualsiasi momenta attraverso mutuo reciproco consenso scritto delle parti comunicato attraverso canali diplomatici. Tali eventuali revisioni o emendamenti entreranno in vigore nella data che sara determinata dalle Parti e diventeranno parte integrante del presente Programma.
9. COMMISSIONE MISTA
Le prossime riunioni della Commissione Mista si terranno alternativamente a Jakarta ed a Roma. La data sara concordata per le vie diplomatiche.
10. ENTRATA IN VIGORE, DURATA E SCADENZA

vigente fino all'entrata in vigore del successive.II presente Programma rimarra in vigore fino al 31 dicembre 2005.
La conclusione di questo Programma non avra effetto sulla validita e durata dei programmi o delle attivita tuttora in corso di svolgimento, previste nell'ambito del Programma stesso.
11. ALLEGATI
Le Disposizioni generali e finanziarie negli Allegati I e II costituiscono parte integrale del presente Programma.

Borse di studio
a. La selezione dei candidati delle borse di studio verra effettuata ogni anno in ciascun Paese da una Commissione Mista, che comprendera almeno un rappresentante dell'Ambasciata del Paese che offre le borse di studio.
b. La lista dei candidati prescelti includera anche candidati di riserva e deve essere presentata all'Ambasciata del Paese offerente entro i termini previsti. I candidati che non saranno inclusi nella predetta lista non potranno essere accettati.
c. Ciascuna Parte notifichera all'altra, possibilmente due mesi prima dell'inizio dell'anno accademico, se i candidati proposti ed i relativi piani di studio sono stati accettati, indicando altresi anche le istituzioni che Ii accoglieranno.
d. I borsisti non potranno partire per ii Paese ospitante prima di aver ricevuto dall'Ambasciata del Paese formale comunicazione circa la prima data utile per la partenza.
e. La Parte italiana offrira ai borsisti indonesiani:
e.1. Una somma mensile non inferiore a 619, 75 Euro.
e.2. Assicurazione contro gli infortuni e le malattie ad eccezione delle malattie pregresse e delle protesi dentarie.
f. La Parte indonesiana offrira ai borsisti italiani assistenza medica gratuita presso ospedali e strutture sanitarie pubbliche in caso di sopravvenuta malattia.

Scambio di visite
Lo scambio di persone previsto dal punto 1.c.3. del presente Programma si attuera secondo ii seguente schema:
a. La Parte inviante notifichera alla Parte ricevente, attraverso i canali diplomatici ed almeno tre mesi prima:
a.1. I nomi dei visitatori, la loro nazionalita (che deve essere italiana per le persone che si recano in Indonesia e indonesiana per le persone che si recano in Italia), i loro curricula vitae e le lingue straniere parlate;
a.2. II programma previsto per la loro visita, indicando, se appropriati, i titoli delle conferenze, ii name del professore ospite ed ii suo dipartimento universitario;
a.3. Le date previste e la durata della visita.
b. La Parte ricevente confermera l'accettazione definitiva della visita almeno quattro settimane prima della data prevista per l'arrivo.
c. La Parte inviante sosterra le spese di via_ggio da capitale a capitale e ritorno;
d. La Parte ricevente sosterra le spese dei viaggi all'interno del proprio territorio previsti dalla visita;
e. La Parte ricevente sosterra le spese di vitto ed alloggio come qui di seguito specificato:
e.1. La Parte italiana eroghera agli ospiti indonesiani una diaria onnicomprensiva di 93 Euro;
e.2. La Parte indonesiana eroghera agli ospiti italiani 350.000 Rupie per ognuno dei partecipanti al programma Dharmasiswa.
Mostre d'arte
Subordinatamente a quanta previsto al punto 3.a.2., gli scambi di mostre previsti nel presente Programma verranno effettuati in base alle seguenti disposizioni finanziarie:
a. La Parte che invia la mostra si accollera i seguenti costi:
a.1 Le spese di assicurazione per ii trasporto per e dal Paese ricevente e durante ii periodo di esposizione;
a.2. Le spese di trasporto della mostra fino alla prima sede espositiva e dall'ultima sede espositiva;
a.3. Le spese di viaggio dell'esperto che accompagna la mostra fino alla prima sede espositiva e ritorno dall'ultima sede espositiva (qualora dovessero essere necessari piu esperti, ii loro numero e la durata del loro soggiorno verranno concordati caso per caso attraverso i canali diplomatici).
b. La Parte che riceve la mostra si accollera i seguenti costi:
b.1. Le spese per ii trasporto del materiale espositivo all'interno del proprio territorio;
b.2. Le spese di pubblicita e organizzazione della mostra, incluso l'affitto dei locali;
b.3. Le spese per la pubblicazione del catalogo, salvo diversamente concordato;
b.4. Le spese relative agli spostamenti interni ed al vitto ed alloggio dell'esperto che accompagna la mostra;
b.5. Le spese doganali, incluse quelle per ii trasbordo del materiale espositivo;
b.6. Qualora ii materiale dovesse subire dei danni, la Parte ricevente
e
tenuta ad inviare al Paese inviante tutta la documentazione relativa ai danni. Le spese di perizia dei danni saranno a carico del Paese ricevente. In nessun caso si potranno effettuare restauri senza l'espressa autorizzazione del Paese inviante.Cinema
Le spese concernenti l'organizzazione delle rassegne cinematografiche e di eventi musicali teatrali e di danza verranno concordate, di volta in volta, tra le Parti in base alle disponibilita finanziarie e alle modalita economicamente piu vantaggiose per le Parti stesse
Le opere letterarie artistiche, musicali, drammatiche, liriche, folcloristiche, cinematografiche, radiofoniche, televisive, e le altre opere di natura analoga protette dalla legislazione sulla proprieta intellettuale di una delle Parti contraenti, usufruiranno, nel territorio sotto la giurisdizione dell'altra Parte, della protezione che la legislazione di quest'ultima concede a questo tipo di opere, senza pregiudizio di quanto stabilito negli Accordi o Convenzioni internazionali che le due Parti abbiano sottoscritto.

FIRST PROGRAM OF THE CUL TURALAGREEMENT
.BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF THE ITALIAN REPUBLIC FOR THE YEARS 2002-2005
The Indonesian Party and the Italian Party, hereinafter referred to as "The Parties";
Referring to Article 9 of the Cultural Agreement between the Government of the Republic of Indonesia and the Government of the Italian Republic on Cultural Cooperation, done at Jakarta on 20 October 1997;
Desiring to develop cultural relations between the two countries; Inspired by the common commitment to enhance within their respective capabilities, the promotion of cooperation in the afore-mentioned fields on the basis of equality, mutual respect and benefit;
Pursuant to the prevailing laws and regulations of their respective countries;
Have agreed as follows:
1. EDUCATION
a. Lower Education
The Parties shall exchange books, publications and audiovisuals with the aim of enhancing the knowledge -of their respective cultures and education system and shall try the possibility of twinership among schools and educational institutions.
b. Language Teaching
b.1. The Parties shall promote the study of their respective languages and cultures in both countries.
b.2. In this respect, the Italian Party is ready to provide financial support to the appointment of one lecturer of Italian language as well as books on Italian language, literature, history and geography, for the dissemination of the Italian language and culture to those Indonesian educational institution requesting them through diplomatic channels.
c. Higher Education
c.1. The Parties shall encourage cooperation in different fields including Human Rights by fostering cultural activities aimed at developing the perception of their importance and favouring equal opportunities between men and women, cooperation between universities and higher education institutions of their respective countries, through the establishment of specific arrangements for the exchange of professors; information and data, as well as through joint research projects.
c.2. The Parties will inform each other of existing inter-university agreements and of those, which will be concluded in the future.
c.3. The Parties shall exchange yearly visits up to 4 of university teachers and/or researchers for a period of up to 10 days, to give conferences or seminars, and start contacts on academic level giving priority to visits aimed at the setting out of university co-operations.
2. SCHOLARSHIPS
a. The Italian Party shall award scholarships of 56 person/months in cultural sectors and of 110 person/months in scientific sectors, to Indonesian citizens for the academic year 2002-2003/2003-2004/2004-2005.
b. The Indonesian Party shall yearly award a non-degree scholarship in the framework of the Darmasiswa program for at least 2 (two) Italian citizens.
c. Each Party may change the number of person/months offered for the following academic years, in accordance with the funds available each financial year. All changes shall be notified through diplomatic channels.
d. The ISIAO (lstituto Italiano per l'Africa e l'Oriente), according to its budgets and priorities, is willing to offer a non-degree scholarship in the framework of its scholarships programs in the field of Africa and Asian Studies to requesting Indonesian scholars.
3. CULTURE AND ART
a. Art Exhibitions and Events and Cooperation in the Artistic Sectors
a.1. The Government of the Italian Republic has established in Jakarta the Italian Cultural Institute to enhance mutual understanding and appreciation through culture and cultural exchange.
a.2. The Parties will exchange exhibitions of a high level. The relevant arrangements, also the financial field, shall be defined through diplomatic channels on a case-by-case basis.
a.3. The Parties shall exchange and facilitate cultural events in the sectors of visual and performing arts and shall favour the exchange of information on festivals, exhibitions, celebrations and major cultural events organized in their respective countries.
b. Protection of Cultural Heritage
b.1. The Parties shall favour the exchange of information, experts and experiences in the field of protection, preservation, conservation and restoration of cultural, artistic, architectural and landscape heritage.
b.2. The Parties undertake to cooperate, through their respective authorities, to prevent any form of unlawful import, export or transfer of cultural property, in implementation of the prov1s1ons of international Conventions and Agreements in force in both countries as well as of the domestic legislation of each country, to which end they agree to take all appropriate measures. b.3. The Parties shall examine the possibility to set up, if
necessary, an "ad hoc" working group.
b.4. The Parties also undertake to cooperate in order to facilitate the identification and return to the right-holders of any works of Arts or cultural property, which has entered their territory by whatever manner or means. c. Museums
The Parties shall encourage the cooperation between their respective museums administrations, through technical cooperation, exchange of scientific publications, copies of documents and regulations on a reciprocal basis.
d. Archives
d .1. The Parties shall encourage cooperation between their respective Archives and Administrations, through the exchange of scientific publications, microfilms, copies of documents and regulations on a reciprocal basis.
d.2. The Italian Party (Directorate General for Archives of the Ministry of Cultural Heritage and Activities) expresses its willingness to organize training stages particularly on preservation and restoration, at the dye transfer, bookbinding and restoration Centre of the State Archives. d.3. The Parties shall facilitate the access to the historic
archives available at their Ministries of Foreign Affairs, according to the principle of reciprocity and subject to existing rules and regulations, and facilitate the exchange of publications concerning the historic diplomatic documents of the two Ministries.
e. Libraries and Publishing
e.1. The Parties (for the Italian Party the International Exchange Department of the Directorate General for Books Heritage of the Ministry of Cultural Heritage and Activities) shall promote the exchange of books, publications, and periodicals between libraries, academies and cultural institutions in the two countries. e.2. The Parties shall carry out the exchange of copies and
microfilms of the books kept in National Libraries.
e.3. The Directorate General for Books Heritage at the Ministry of Cultural Heritage and Activities declares its willingness, to supply experts on conservation, restoration, cataloguing, computer technology, library building and the promotion of library assets.
e.4. The Italian Party (Directorate General for Books Heritage at the Ministry of Cultural Heritage and Activities - MBAC) declares its willingness, during the period of implementation of this Program, to send a publishing exhibition and/or review to show the preservation and enhancement activities of Book heritage.
e.5. The Publishing Division of the Ministry of Cultural Heritage and Activities (Divisione Editoria of the Ministry of Cultural Heritage and Activities) expresses its willingness to send books in any field and subject to universities and other institutions of higher learning. Applications shall be made through diplomatic channels. e.6. The Italian Party informs that the following awards and
grants exist:
• Awards and grants (Ministry of Foreign Affairs -D.G.P.C.C.) for Italian and/or Indonesian publishers and translators for the translation of literary and scientific works and for the production, dubbing and subtitling of short and long motion pictures included in significant projects. Applications should be submitted to the Ministry of 5
Foreign Affairs through the Italian Embassy in Indonesia, within March the 31st up to September the 30th.
• The National Translation Prize, under the patronage of the President of the Republic, awarded by the Publishing Division of the Ministry of Cultural Heritage and Activities, to both Italian and foreign translators and publishers. Applications should be submitted through diplomatic channels every year within March the 31st.
• The Centre for translators and for initiatives aimed at supporting translations (Centro per i Traduttori e le lniziative a favore della Traduzione) of the above-mentioned Division of MBAC is willing to begin establishing contacts with its counterpart authorities in Indonesia.
• Prizes for translators of Italian books in foreign languages awarded by the Department of Information and Publishing at the Office of the Prime Minister. Applications should be submitted through diplomatic channels every year within September the 301h.
f. Radio - TV
The Parties shall encourage exchanges in the radio and television fields to promote and facilitate in both countries the knowledge of events and developments between the relevant institutions in the following areas:
f.1. organize vocational courses for journalists, technicians and programmers, possibly even utilizing the scholarships offered by the two countries;
f.2. allow the link-up of television programs via satellite;
f.3. facilitate the participation to festivals and radio - TV program reviews in the two countries;
f.4. organize radio - TV programs festivals;
f.5. provide the broadcast of standard programs in the original language;
4. FACILITIES
The Parties shall offer the most favourable treatment, compatible with their legislation, to the individuals or groups visiting the other country on missions or for activities falling within the scope of this Program in relation to their entry, stay or departure, and in relation to the temporary import of any items necessary for the purposes of completing their mission or performing their activity.
5. FORMS OF IMPLEMENTATION
Activities described in this Program may be implemented through the development of specific arrangements, programs or projects between the appropriate institutions or organizations of the Parties, through diplomatic channels or Joint Cultural Commission. Such arrangements, programs or projects should specify, inter alia, the objectives, financial arrangement and other details relating to specific undertakings of all participants involved.
6. FINANCIAL PROVISIONS
The Parties agree that all initiatives mentioned in this Program shall be carried out, within the limits of the financial resources annually established by their budget.
7. COPYRIGHT
Any result of activities in the fields of science, arts and literature which performed under this Program shall be subject to the laws and regulations concerning the protection of copyright and its neighbouring rights in the respective territories of the Parties insofar as these are not covered by a general agreement on an international character.
8. AMENDMENT
This Program can be reviewed or amended at anytime by mutual written consent by the Parties through diplomatic channels. Such revisions or amendments shall enter into force on such date as may be determined by the Parties and shall form an integral part of this Program.
9. JOINT CULTURAL COMMISSION
The meeting of the Joint Cultural Commission will take place alternately, in Jakarta or in Rome. The date shall be agreed upon through the diplomatic channels.
10. ENTRY INTO FORCE, DURATION AND TERMINATION
This Program shall enter into force on the date of its signing.
This Program shall remain in force until 31 December 2005.
The termination of this Program shall not affect the validity and duration of any on-going programs or activities made under this Program.
11. ANNEX
The general and financial provisions set out in the Annex I and Annex II shall form an integral part of this Program.

ANNEX II GENERAL AND FINANCIAL PROVISIONS
COVERING THE EXCHANGES UNDER THE FIRST PROGRAM OF
THE CULTURAL AGREEMENT BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF THE ITALIAN REPUBLIC FOR THE YEARS 2002-2005
Scholarships
a. The selection of candidates for scholarships shall be made yearly in each country by a Joint Committee including at least one representative of the Embassy of the offering country.
b. The list of selected candidates shall also include alternate candidates, and shall be submitted to the Embassy of the offering country within the foreseen deadline. Candidates not included in the above mentioned list cannot be accepted.
c. Each Party shall notify the other, possibly within two months before the beginning of the academic year, whether the proposed candidates and their study plans have been accepted, and shall also indicate the institutions where they will be received.
d. Scholarship holders shall not leave for the host country until they have received, from the Embassy of the offering country, a formal notification specifying the earliest date of departure. e. The Italian Party shall grant to Indonesian scholarship holders:
e.1. a monthly all-inclusive allowance of at least 619,75 Euro ; e.2. health and accident insurance excluding of pre-existing
illnesses and dental prosthesis.
f. The Indonesian Party shall grant to Italian scholarship holders a medical treatment in public health care centres, free of charge, in case of sudden illness.
Exchange of Visits
The exchange of visits envisaged in Article 1.c.3 of this Programs shall take place in the following manner:
a. The sending Party shall notify the receiving Party, through diplomatic channels and at least 3 (three) months in advance: a.1. the names and nationality (it must be Italian for persons
visiting Indonesia and Indonesian for persons visiting Italy) of the visitors, their curricula vitae, and foreign languages spoken;
a.2. the proposed program of their visit, indicating, where appropriate, the titles of lectures, as well as the name of the host professor and of his/her university department; a.3. the planned dates and duration of the visit.
b. The receiving Party shall confirm final acceptance of the visit at least four weeks before the planned date of arrival.
c. The sending Party shall pay for the travelling expenses from one capital city to the other capital city and back.
d. The receiving Party shall pay for the travelling expenses within its own territory, as planned in the visit;
e. The receiving Party shall bear the costs for board and lodging as specified hereinafter:
e.1. the Italian Party shall pay its Indonesian guests an all-inclusive daily allowance of 93 Euro;
e.2. the Indonesian Party shall pay its Italian guests a monthly allowance of at least Rp. 350.000,- for each participant of Darmasiswa;
Art Exhibitions
Subject to what have been in Article 3.a.2, the exchanges of exhibitions envisaged by this Program shall be carried out according to the following financial provisions:
a. The Party sending the exhibition shall be responsible for the following expenses:
b.
a.1. covers the expenses of transportation insurance to and from the receiving Party and during the exhibitions;
a.2. transport costs of the exhibition to its first display location and return from the last display location;
a.3. travel expenses for the expert accompanying the exhibition to the first display location as well the return expenses from the last display location (should more experts be required, their number and the length of their stay shall be agreed, case by case, through diplomatic channels).
The Party receiving the exhibition shall bear the following expenses:
b.1. transport costs of the exhibits within its own territory; b.2. advertising and setting up costs for the exhibition,
including the hiring of the premises;
b.3. expenses for publishing the catalogue, unless otherwise agreed upon;
b.4. costs for local transport, board and lodging for the expert accompanying the exhibition;
b.5. customs expenses, including trans-shipment of the exhibits;
b.6. in case of damage of any material, the receiving country must forward all documentation relating to the damages to the sending country. Damage appraisal expenses are to be covered by the receiving country. Under no 12

circumstances, may restoration be carried out without the explicit authorisation by the sending country.
Cinema
The costs for the organization of film exhibitions and festivals shall be agreed upon by the Parties, case by case, according to the financial facilities and the conditions more convenient for both Parties.
Literary, arts, music, drama, opera, folklore, film, radio, television and other similar works protected by intellectual property legislation in the territory of each one of the Parties shall enjoy the protection in the territory of the other Party according to the legal provisions granted by it to works of this kind, without prejudice to the provisions of the interrational Agreements or Conventions of which the Parties are signatories.
