DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 731/MPP/Kep/10/2002 DATED OKTOBER 21, 2002

ON

METROLOGICAL MANAGEMENT AND METROLOGICAL LABORATORY MANAGEMENT

THE MINISTER OF INDUSTRY AND TRADE

Considering :

a. that in the framework of implementing Article 2 paragraph (2) point 5g and Article 3 paragraph (5) point 5e as well as Article 6 of Government Regulation No. 25/2000, it is deemed necessary to specify tasks of metrological management and metrological laboratory management;

b. that in relation thereto , a decree of the Minister of Industry and Trade needs to be issued.

In view of :

1. Law No. 2/1981 on Legal Metrology (Statute Book of 1981 No. 11, Sup plement to Statute Book No. 3193); 2. Law No. 8/1999 on Consumer's Protection (Statute Book of 1999 No. 42, Supplement to Statute Book No.

3821);

3. Law No. 22/1999 on Regional Administration (Statute Book of 1999 No. 60, Supplement to Statute Book No. 3839);

4. Government Regulation No. 2/1989 on National Standards of Measurement Units (Statute Book of 1989 No. 3, Supplement to Statute Book No. 3388);

5. Government Regulation No. 25/2000 on the Authority of the Government and the Authority of Provinces as Autonomous Regions (Statute Book of 2000 No. 54, Supplement to Statute Book No. 3952);

6. Presidential Decree No. 228/M/2001 on the Establishment of the Mutual Cooperation Cabinet;

7. Presidential Decree No. 102/2001 on the Position, Task, Function, Authority, Organizational Structure and Work Mechanism of Ministry;

8. Presidential Decree No. 109/2001 on the Organizational Unit and Task of First Echelon Officials of Ministry;

9. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the Organization and Work Mechanism of the Minister of Industry and Trade;

DECIDES :

To stipulate :

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON METROLOGICAL MANAGEMENT AND METROLOGICAL LABORATORY MANAGEMENT.

CHAPTER I GENERAL PROVISION

Article 1

Referred to in this decree as :

2. Legal metrology is metrology managing metric units, measuring methods and measuring tools regarding technical requirements and regulations on the basis of laws aimed at protecting public interests in the case of the truth of measurement.

3. Measuring, weighing, balancing tools and accessories hereinafter abbreviated to UTTP are all kinds of UTTP used in the legal metrology field.

4. UTTP needing special management are UTTP in provinces not yet having calibration standard apparatuses and/or whose calibration standards are not yet based on national and/or international cooperation.

5. Goods in a covered condition hereinafter abbreviated to BDKT are goods placed in closed wrapper or package and in the case of the goods being used, the wrapper or wrapping seal must be torn.

6. Supervision over UTTP and BDKT is an acidity of supervision over the implementation of Law No. 2/1981 on legal metrology.

7. Metrological counseling is an activity executed by providing counseling, directive, explanation and planting trust to the society in metrology-related matters, especially legal metrology.

8. Calibration is to mark with legitimate calibration marks or invalid calibration marks or provide written information having legitimate calibration marks or invalid calibration marks by emplo yees righteous to do it on the basis of test applied to measuring, weighing, balancing tools and their apparatuses which are not used yet.

9. Calibration is to mark periodically with legitimate calibration marks or invalid calibration marks or provide written information having legitimate calibration marks or invalid calibration marks by employees righteous to do it on the basis of test applied to measuring, weighing, balancing tools and their apparatuses already calibrated.

10.Verification is confirmation through test and provision of evidences that the stipulated requirements have been fulfilled.

11.Laboratory accreditation is a series of activities to obtain formal recognition by the government that other institutions or agencies have fulfilled the requirements for undertaking metrological activities which are certified by accreditation certificates.

12.Educational and training accreditation of functional calibrators is a series of activities to secure formal recognition by the government that other institutions or agencies have fulfilled requirements for organizing educational and training courses of functional calibrators certified by accreditation certificates.

13.Calibration marks seal is a state document used for affixing legitimate mark, invalid mark, warranty mark, identity of righteous employees and/or regional identity to UTTP or issuing written certificates to UTTP which cannot be affixed by calibration seal, have been calibrated and/or have been re-calibrated with the model, dimension, material and usage regulated by the Minister.

14.Legal metrology unit is an organization established to undertake metrological activities.

15.Minister is the minister responsible for legal metrological affairs.

CHAPTER II

The application of metrology consists of : a. metrological management; and

b. metrological laboratory management.

Article 3

The Minister of Industry and Trade applies the metrological management as meant in Article 2 letter a, covering activities of formulation, planning, stipulation of national policies, implementation, evaluation, which are related to :

a. metric units, metric standards and measuring methods of UTTP; b. nationwide metrological supervision and counseling;

c. development of metrological human resources at the national level as well as education and training; d. domestic and imported UTTP;

e. management of calibration-mark seal; f. UTTP needing special management; g. tariff of calibration cost;

h. metrological cooperation nationally and internationally;

i. accreditation of metrological laboratories in the framework of implementing the legal metrology law and accreditation of educational and training courses of functional calibrators;

j. legal metrology system; k. information and reporting.

Article 4

Provinces undertake the metrological laboratory management as meant in Article 2 letter b, covering technical operational activities by referring to legislation in force in the legal matrology field, which are related to : a. verification of standards for metric units;

b. procurement of laboratory facilities and infrastructures;

c. maintenance of standards equipment of metric units, laboratory room as well as testing installations; d. fostering of metrological human resources;

e. maintenance and use of calibration-mark seal; f. calibration and re-calibration of UTTP; g. management of calibration costs; h. supervision over UTTP and BDKT; i. metrological counseling;

j. fostering of personnel repairing UTTP and producers of UTTP; and k. examination of UTTP for licensing factory mark and type.

CHAPTER III

INSTITUTIONAL AFFAIRS Article 5

(1) Governors can establish and stipulate working areas of legal metrology units in accordance with the needed on the basis of the legislation in force.

(2) Leaders of legal metrology units report results of their activities to governors or the appointed officials with a copy made available to the Director General of Domestic Trade, Ministry of Industry and Trade, in this case the Director of Metrology.

Article 6

(1) The activities of calibration and re-calibration of UTTP as meant in Article 4 letter f are executed by righteous employees.

(2) The righteous employees as meant in paragraph (1) must meet the following requirements : a. civil servants assigned in legal metrology units;

b. passing education and training as calibrators;

c. entitled to undertake metrological activities by the Minister.

CHAPTER VI

TRANSITIONAL PROVISION Article 7

Calibrators not yet fulfilling the requirements as meant in Article 6 paragraph (2) letter c can execute tasks of calibration and re-calibration not later than one year as from the date of stipulation of this decree.

CHAPTER VII CLOSING PROVISION

Article 8

With the enforcement of this decree, all provisions in Decree of the Minister of Industry and Trade No. 61/MPP/Kep/2/1998 on the application of metrology as already amended by Decree No. 251/MPP/Kep/6/1999 that contravene this decree are declared null and void.

Article 9

This decree comes into force as from the date of stipulation.

For public cognizance, this decree shall be announced by placing it in State Gazette of the Republic of Indonesia.
