DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 419/MPP/Kep/4/2002 DATED APRIL 30, 2002
ON
THE ESTABLISHMENT OF THE TEAM FOR SELECTING MEMBERS OF THE CONSUMER DISPUTE SETTLEMENT AGENCY
THE MINISTER OF INDUSTRY AND TRADE OF THE REPUBLIC OF INDONESIA
Considering :
a. that in the framework of the establishment of the Consumer Dispute Settlement Agency, as mandated in Law No. 8/1999 on consumer protection, it is necessary to establish a team for the selection of prospective members of the Consumer Dispute Settlement Agency;
b. that in relation thereto, it is necessary to issue a decree of the Minister of Industry and Trade. In view of :
1. Law No. 8/1999 on consumer protection (Statute Book of 1999 No. 42, Supplement to Statute Book No. 3821);
2. Presidential Decree No. 17/2000 on the implementation of State Revenues and Expenditures Budget (APBN);
3. Presidential decree No. 90/2001 on the establishment of Consumer Dispute Settlement Agency in Medan, Palembang, Central Jakarta, Western Jakarta, Bandung, Semarang, Yogyakarta, Surabaya, Malang, and Makassar (Statute Book of 2002 No. 105);
4. Presidential Decree No. 228/M/2001 on the establishment of mutual cooperation cabinet;
5. Presidential Decree No. 102/2001 on status, tasks, functions, authority, organizational structures, and work procedures of ministries;
6. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
7. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on organizations and work procedures of the Ministry of Industry and Trade;
DECIDES : To stipulate :
FIRSTLY :
To establish the Team for Selecting Prospective Members of the Consumer Dispute Settlement Agency, which is hereinafter called "Selection Team for BPSK" with membership structure as specified in the attachment to this decree.
SECONDLY :
The Selection Team for BPSK as set forth in the FIRST paragraph has the following duties : 1. To prepare guide to the designation of members of the Consumer Dispute Settlement Agency;
2. To compile and prepare list of proposal of candidate members of Consumer Dispute Settlement Agency from each region;
3. To propose names of candidate members of the Consumer Dispute Settlement Agency from each region to the minister of trade and industry;
THIRDLY :
In performing their duties, Chairman of the Selection Team for Consumer Dispute Settlement Agency shall be responsible and must deliver a report, in writing, to the minister of trade and industry.
FOURTHLY :
For the acceleration of the performance of duties of the team, chairman of the team may establish a secretariat in accordance to the needs.
FIFTHLY :
The Selection Team for Consumer Dispute Settlement Agency, as set forth in the FIRST paragraph, shall take a three (3) month-term of office, and shall be dissolved after expiration of their term of office.
SIXTHLY :
All costs related to the execution of duties of the team shall be imposed on Consumer Protection Empowerment Project Budget of the Ministry of Industry and Trade for the fiscal year of 2002.
SEVENTHLY :
This decree comes into full force and effect from the date of stipulation, and shall be valid retroactively to April 1, 2002.
