SPECIFIC AGREEMENT BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE KINGDOM OF BELGIUM CONCERNING

THE PROJECT LTA-30/1 "BEDUGUL HIGH PLAINS IRRIGATION" BEING A SUBPROJECT OF LTA- 30 "BALI REGIONAL DEVELOPMENT

PLANNING PROJECT" - PHASE U

The Government of the Kingdom of Bei{,rium and t he Government of the Republic of

Indo-nesia, 11

Within the framework of U1e Genera] Agreement on Technical Co-operation of June 16, 1969,

Desiring to contribute jointly in the development of the High Plains of Bedugul in the Pro-vince of Bali as a vegetable growing region.

Willing to co-operate for that purpose in the irnplcwcnlalion of the project descrilicd here· after,

Have agreed as follows :

ARTICLE 1 Objectives or the project 1. Primary objective

The Project aints at the detailed design of an irrigation scheme, which should cover an aJ'ea of 285 HA in the vicinity of the Lakes BRATAN and BUY AN by making use of their water.

2. Additional objectives

The Project should at the same time :

assess the impact of the scheme on the BUY AN and BRAT AN lakes define the appropriate kind of horticulture

provide detailed 11pecifications of the scheme and ita equipment and prep31·e U1c

tender documents

prepare a manual for operation and maintenance of the scheme

take care of a transfer of knowledge and technical know-how to the Indonesian co1mterparts.

3. The Project is further described and detailed in the Terms of Reference attached to

ARTICLE ll

Executing Agency

The Government of the Republic of Indonesia designates the Directorate of Irrigation I,

hereinafter referred to as "DI - I" of the Directorate General of Water Resources Deve-lopment, the Ministry of Public Works, as i_ts Executing Agency イセウーッョウゥィャ・@ for the implementation of its contribution and operational matters of the proJect.

2. The Government of the Kingdom of Belgiwn designates the Belgian Administration for Development Co-operation (hereinafter referred to as "BADC") as its executing agency,BADC is represented in Indonesia by the Development Co-operation Section of the Belgian Embassy in jakarta. The BADC will entrust the implementation of its contribution to experienced consultant(s).

ARTICLE Ill

Contribution of the Government of the Republic of Indonesia

l. In accordance with the prevailing laws and regulations, the Coverrunenl of Indonesia shall contribute the following :

a. Provide U1c Belgian experts with the exemptions and privilegPs mentioned in article 7 of the General Agreement on Technical Co-operation of June 16, 1969.

b. Grant exoneration from all duties, other levies and taxes on the technical apparatus and equipment brought into Indonesia by the consultant and which is required to im plement the project.

c. Give U1e required approval of the Belgian eA'J)Crts by a written notice and for the duration of the project.

2. Furthermore, through the Directorate General of Water Resources Development and the Provincial Office of Public Works in the Province of Bali, the Government of U1e Republic of Indonesia shall :

a. appoint a responsible project engineer who will act as an interface between the consultant and all Indonesian services and organizations.

b. provide accommodation for the long term and short term experts.

c. make available furnished and equipped offices and domestic telecommunication facilities as required for the implementation of ilie project and in accordance with Indonesian standards.

d. provide secretarial services as available at the pwject office.

e. provide all available reports, maps, documents and technical data and other infor-mation required fo•· the propet· implementation of the project. Whenever possible, this information will be given to the Consultant in the English language. In case documents have to be studied which are not available in English, they will be translated accordingly.

f. give the consultants every reasonable assistance to enable them to perform their study.

The implemenlalion tmd disbursement of the contribution of the Republic of Indonesia will be limited by and subject to its normal budget appropriation.

ARTICLE IV

Contribution of the Government of the Kingdom of Belgium

In accordance with the prevailing laws and regulations and subject to the final approval of the proposed budget by the Belgian budgetary authorities, the Government of Belgium shall contribute the following :

l. Carry out the detailed study and the preparations for the implementation of the project as specified in the TOR and take all required administrative and budgetary measures to tlris end.

2. Provide the services of a Belgian consultant including the wages of the experts, their international travel to and from Denpasar, their international communication expenses and miscellaneous expenses not covered b) the Indonesian contribution.

3. Submit tJ1e nominations of the consultant's experts for approval to the Indonesian Government.

4. Provide the cost of additional surveys and investigations as demanded by the Belgian Consultllnt to carry out their study.

5. Provide the operating costs of the two vehicles which were provided under Phase I and were trarlSferred to the Indonesian Authorities for safekeeping till Phase II.

6. Provide the cost of the printing of the final report. This report should be presented to the Indonesian Government within a period of three montllS after the approval of the draft final report.

Plan of Operation

For the implementation of the project, Belgium and Indonesia shall develop a plan of ope-ration which will constitute an operational document between BADC and Dl-1 and being an integral of this Specific Agreement. The plan of ッセイ。エゥッョ⦅@ Gセ@ he completed 。ョセ@ signed

BADC and DI-1 within 90 days from the date of this Spec1f1e Agreement, and will contam, inter alia, the following :

a. Detailed description of t he project.

h. An outline of the methods and means to be used to carry out the project, including organizational structure with operational relationship.

c. A schedule for the implementation of the project activities, including a milestone chart.

d. The reporting requirements for the project.

e. The nature, timing and responsibilities for project monitoring and evaluation and the means l>y which they shall be made.

f. A statement of eventual additional obligations, duties and responsibilities of Belgium and Indonesia.

ARTICLE VI

Commu n ications

Any communication or document given, made or sent by either Government or their designated agent pursuant to this Agreement or annexes hereto shall be in writing and shall be deemed to have been duly given made or sent to tlte party to which it is addressed at the time of its delivery by hand, mail, telex, cable or radiogram at its respective address, namely:

ARTICLE Vll

Control and Evaluation

l. Bolla Goverrunents may review the aims, objectives and implrmenlation of the Project

and if necessary discuss the main problems occuring during the implementation of the project by covening a Joint Commission for this purpose.

2. The Government of Indonesia reserves the right to request the Belgian Government to recall any of the consultant's personal in Indonesia whose services and/or activities are found tmSatisfactory or for reasons of misconduct, misbehaviour or illness.

3. At any time, both Governments may supervise and/or contaol on the spot the state of progress of the project.

4. Where necessary and after consultation, both Govenunents may evaluate the project or part of its implementation aspects.

Settlement of Dispute

Any dispute arising out of the interpretation or impleu1cntation of this Specific Agreement shall be settled amicably by consultation or negotiation between the two Governments.

ARTICLE IX

Entry into force and validity

This Specific Agreement and the attached Terms of Reference shall enter into force on the date ..>f signing and remain in force until the completion of the project.

Amendments to the Specific Agreement, not resulting in any increased cost to any of the contracting parties, may be made at any time with the mutual consent of the two Govern-ments by exchange of letters.

TERM OF REFERENCE

BEDUGUL HIGH PLAIN IRRIGATION

I. Background Information

1.1. Introduction

The Project location is in Buleleng Regency, Province of Bali,

Irrigate a 285 Ha high pla1n area in the vicinity of Br·atan and

Buyan lakes by using the water from the two lakes .

The benefitted areas extends by the right and left sides of the

main road of Denpasar- Singaraja.

The study phases consists of

a. Environmental impact analysis

b. Detail Design

c. Operation and maintenance.

Justification of the project

- There in limited high plain area in Bali for vegetable culti-vation duo to the mountainous and hilly physical features of

the area . But the water availability is also limited

although the temperature is good fur vegetable.

- By the Tourism indus try impact it is expected that the vege

-table demand could be supplied by the local production even

more to export out of Ba 1 i .

- On the hi gh plain of.Bedugul, exteds between Batan and Buyan

lakes, the is a good area of 285 ha for vegetable cultivation

but at present has not enough water supply for it.

The area セ Q ゥ ャ ャ@ be developed by supplying irrigation water from

Bratan and Buyan lakes . The purposes of the study among

others

a. Notice the impact of v1ater irnplementation on Buyan and

Bra tan 1 ake.

b . To get a clear idea on what kind of horticulture could be cultivated according to the soil structure and marketing

1.3. Present Situation

Vegetables cou l d be grown mostly during rainy season because in

dry season it can be grown only near the lakes by direct watering

by pails water.

with the letter No. 195/30/Bappeda dated January 21, 1985 saying

among others
