PROVISIONS ON PLYWOOD EXPORTS
(Decree of the Minister of Industry and Trade No. 28/MPP/Kep/I/1998 dated January 21, 1998)
THE MINISTER OF INDUSTRY AND TRADE Considering :
a. that in the framework of national economic reforms, the enhancement of orderliness in business and support for efforts to conserve natural resources, it is necessary to re-stipulate the provisions on plywood exports;
b. that to this end it is necessary to issue a decree of the Minister of Industry and Trade.
In View of :
Decree of the Minister of Industry and Trade No. 228/MPP/KEP/7/1997 on general provisions in the export area.
DECIDES: To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING PROVISIONS ON PLYWOOD EXPORTS
Article 1
Referred to as plywood in this decree shall be plywood and blockboard under HS No. 4412 and veneer under HS No. 4408 produced by the plywood industry.
Article 2
(2) Companies which may be recognized as ETKLs shall be :
a. companies owning a plywood industry and already obtaining an industrial business licence (IUI), or
b. companies not owning a plywood industry but establishing a marketing contract with plywood industrial companies already obtaining an IUI and not yet recognized as ETKLs.
Article 3
The procedure and requirements for being able to be recognized as an ETKL shall be as follows :
(1) Filing an application to the Director General of International Trade in this case the Director of Exports through a local regional office of the Ministry of Industry and Trade in order to obtain his recommendation.
(2) Attaching supporting documents in the form of the following :
• an industrial business licence issued by the Ministry of Industry and Trade or the investment coordinating board (BKPM).
As for a company not owning a plywood industry, it shall be required to attach a marketing cooperation contract with a company owning a plywood industrial company and not having been recognized as a ETKL, legalized by local regional office of the Ministry of Industry and Trade and also a trade business licence (SIUP).
• Corporate Registration Mark (TDP); • Taxpayer’s Code Number (NPWP);
• A notarial act on the establishment of the company.
Article 4
Recognition as an ETKL shall be valid indefinitely as long as the requirements are fulfilled and the plywood export activities are still carried out.

A plywood export quota to each ETKL already stipulated prior to the issuance of this decree shall remainvalid until the issuance of further provisions.
Article 7
Exporters violating the provisions in this decree may be subject to the imposition of a sanction on the basis of the prevailing laws.
Article 8
This decree shall take effect as from February 2, 1998.
For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia
