As one of the third most important food comodity after rice and corn, soybean also rich in proteins which is important in the food and feed industry. Soybean as one of the basic needs are particularly vulnerable to price increases. Oligopolistic market structure in the soya industry raises the possibility of the occurrence of monopolistic practices and or unfair business competition, especially through the practice of price fixing cartel. The enactment of Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition aims to create a climate of fair competition and avoiding concentration of economic power in certain individuals or groups. KPPU as an institution that oversees competition in performing their duties and authorities suspect the pricing practices by 4 companies importer of soybeans. Based on this, the issue is whether the KPPU against the alleged price fixing by 4 importers can be categorized as a cartel in terms of Act No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition and how the juridical implications of pricing practices by the cartel to tahu and tempe’s business actors.
The research method used is a normative juridical writer who focuses on the use of secondary data analytic descriptive specifications elaborated on the legislation in force and the legal theories that need to be applied in achieving legal certainty to the issues raised writer. Data analysis using the method of qualitative analysis.
In this study it is concluded that the allegations of the Commission against 4 major soybean importer, PT. Cargill Indonesia, Teluk Intan, Liong Seng and Gunung Sewu can be categorized as a cartel practice and the practice of price fixing by cartels clearly have an impact for the tahu
and tempe’s business actors. This loss can be used as the strong ground

Sebagai salah satu komoditas tanaman pangan terpenting ketiga setelah padi dan jagung, kedelai juga merupakan tanaman yang kaya akan protein yang memiliki arti penting dalam industri pangan dan pakan. Kedelai sebagai salah satu kebutuhan pokok sangat rentan terhadap kenaikan harga. Struktur pasar oligopolis pada industri kedelai semakin membuka peluang terhadap terjadinya praktik monopoli dan atau persaingan usaha tidak sehat, yaitu praktik penetapan harga melalui kartel. UU Nomor 5 Tahun 1999 Tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat bertujuan menciptakan iklim persaingan usaha yang sehat dan kondusif. KPPU sebagai lembaga yang bertugas mengawasi persaingan usaha menduga adanya praktik penetapan harga yang dilakukan oleh 4 perusahaan importir kedelai. Berdasarkan hal ini, maka permasalahannya adalah apakah dugaan KPPU terhadap penetapan harga yang dilakukan oleh 4 importir tersebut dapat dikategorikan sebagai kartel ditinjau dari UU Nomor 5 Tahun 1999 dan bagaimanakah implikasi yuridis praktik kartel tersebut terhadap pelaku usaha tahu dan tempe.
Metode penelitian yang digunakan penulis adalah secara yuridis normatif yang menitikberatkan pada penggunaan data sekunder dengan spesifikasi deskriptif analitis yaitu memaparkan tentang peraturan perundang-undangan yang berlaku serta teori hukum yang perlu untuk diterapkan dalam mencapai kepastian hukum terhadap permasalahan yang diangkat penulis. Analisis data yang digunakan menggunakan metode analisis kualitatif.
