Le Gouvernement de la Republique de l'Indonesie et le Gouver-nement de la Republique fran9aise sont convenus des dispositions ｳｵｩｶ｡ｮｴ･ｾ＠

en vue de faciliter l'effort de redressement et de developpement econo-mique de l'Indonesie :

ARTICLE 1

-Une somme globale de CENT SOIXANTE DIX MILLIONS de francs

(170.000.000

F.) est mise

la disposition du Gouvernement indonesien sous forme de credits, pour financer l'achat par l1_{Indonesie de biens}

et de services fran9ais.

ARTICLE 2

-L'ensemble de ces concours financiers est constitue par :

Les inter3ts sur le solde ､ｾ＠ sont payables

la fin de chaque semestre. Une convention d'application entre la Banque Centrale de l'lndonesie agissant pour le compte du Gouvernement indonesien et le Credit National, agissant pour le compte du Gouvernement fran9ais, precisera les modalites d'utilisation et de remboursement de ces pr3ts.

ARTICLE

4

-Les credits bancaires garantis sont amortissables en dix ans. Leur taux ､Ｇｩｮｴ･ｲｾｴ＠ est le taux usuel de credit

a

l'exportation, auquel s'ajoute le ｣ｯｾｴ＠ de l'assurance-credit.

Un accord financier entre la Banque Centrale de l'Indonesie et les etablissements bancaires fran9ais precisera les mod.alites de leur utilisation et de leur remboursement.

Les accords relatifs aux credits bancaires destines au

finan-cement des equipements lourds de l'article 6, alinea a), seront ｡ｰｰｲｾｾｳ＠

par la Banque Centrale de l'Indonesie s'ils ne sont pas signes directement par elle.

ARTICLE 5

-Les prets du Tresor ·et les credits bancaires garantis qui l'accompagnent seront, pour chaque contrat utilises dans une proportion egale.

Les droits de tirage sur les pr3ts du Tresor seront done egaux

Ia ｾｯｩｴｩ･＠ de la valeur des biens commandes en France au titre de chaque

contrat.

ARTICLE 6

-Les moyens de financement prevus

l'article 1er sont affectes

concurrence de :

a) CENT QUINZE! MILLIONS de francs (115.000.000 F.) au financement d'importations d'equipements lourds, ｴ･ｬｾ＠ qu'ils sont definis par la liste des priorites du plan de developpement economique de l'Indonesie ;

b) CINQUANTE CINQ MILLIONS de francs (55.000.000 F.)

l'achat de tous biens et produits dont l':i:mportation est autorisee par le reglement du commerce exterieur de l'Indonesie au titre des listes A, B et C du decret

indonesien du 24 janvier 1967 modifie,

a

l 'exception des produi ts mineraux metaux a l'etat brut et produits de premiere transformation de ces metaux, ainsi que des armes, munitions et materiels de guerre.

Des derogations pourront ｾｴｲ･＠ autorisees par le Conseiller Commercial de l'Ambassade de France en Indonesie en ce qui concerne les biens et produits inscrits

la liste D du decret mentionne ci-dessus.

ARTICLE

7

-Chaque commande relative aux equipements lourds de

!'article 6, alinea a) fait l'objet entre l'acheteur indonesien et le fourni s seur frangais d'un contrat dont l'admission sur le present protocole doit ｾｴｲ･＠ prealablement approuvee par les autorites indone-siennes et frangaises competentes.

La monnaie de compte et la monnaie de paiement des contrats sont le franc frangais.

FINANCIAL AGREEMENT

Relating to french credits destined for the economic

The Government of the Republic of Indonesia and the Government of the Republic of France have, with a view to facilitate the economic rehabilitation and development efforts of Indonesia, agreed on the following provisions :

ARTICLE 1

A total amount of one hundred and seventy million francs (F. 170.000.000) is made at the disposal of the Indonesian Government in the form of credits to finance the purchase of French commodities \ and services by Indonesia.

ARTICLE 2

The entire financial aid consists of :

- A loan from the French Treasury to the Central Bank of Indonesia, actin g for account of the Indonesian Government of fifty seven million and five hundred thousands francs (57.500.000) and bankers' credits guaranteed by the French Treasury of fifty seven million and five

ｾｵｮ､ｲ･､＠ thousands francs (F. 57.500.000), making a total of one hundred

and fifteen million francs (F. 1 15.000.000) destined for financing the importation of heavy equipment in accordance with the provisions men-tioned in article 6, paragraph a, of the present agreement.

- A loan from the French Treasury to the Central Bank of Indonesia, acting for account of the Indonesian Government of twenty seven million and five hundred thousands francs (F. 27.500.000) and bankers' credits guaranteed by the French Treasury of twenty seven million and five hundred thousands francs (F. 27.500.000), making a total of fifty five million francs (F. 55.000.000) destined for financin g the importa tion of goods, in accordance with the provisions men ti on e d in article 6

paragraph b, of the present agreement.

ARTICLE 3

The two loans from the French Treasury are repayable in twen-ty five years by equal and successive semi-annual instalments which are calculated from the date of each drawing and bearing an interest r a te of 3

per annum, allowing a grace period of eight years.

- The interests due on the balance are payable at the end of each half year. An agreement on the implementation between Cred it Na tional acting for account of the French Government and the Central Bank of Indone s ia acting for account of the Indonesian Government will stipulat the terms and conditions of utilisation and reimbursement of these loan

ARTICLE 4

- A financial agreement between the French Institutions and the Central

Bank of Indonesia will stipulate the modalities of utilization and reimbursement of these guaranteed bankers' credits.

The agreements relating to the bankers' c redits intended for finan-cing of heavy equipment of article 6, paragraph a, will be approved by the Central Bank of Indonesia in case they are not directly si gn ed by this Bank.

ARTICLE

The loans from the Treasury and the guaranteed bankers' credits which are extended in conjunction with the former will be utilised in equal proportions for each contract.

The rights of drawing on the Government loans will thus be equal to half of the value of the goods ordered in France for each contract.

ARTICLE 6

ｾ＠

The means of financing provided for in article 1 are earmarked to the amount of :

a) one hundred am fifteen million francs (F. 115.000.000) for the financing of the importation of such heavy equipment as mentioned in the priority list of the economic development plan of Indonesia.

b) fifty five million francs (F. 55.000.000) for the purchase of a l l commodities and products the importation of which is governed by the foreign trade regulations of Indonesia under lists, A, B and C of the Indonesian decree of 24 th of january 1967 as amended, with the exception of mineral products, raw metals, products of the first transformation of these metals, weapons, amunitions and military equipment.

Derogations in f a vour of items of the D list of above mentioned decree as amended can be authorised by the commercial counsellor to the French Embassy in Indonesia.

This credit will be utilized up to ten million francs for purchase of fertilizers and up to ten million francs for the purchase of steel pro-ducts.

The minimum unit amount of each order is fixed at twenty five thousands francs.

ARTICLE

Each order rel a tin g to the heavy equipment under article 6, para-graph a, is subject to a contract between the French Supplier and the Indone-sian buyer, the qualification of which into the present agreement requires a prior approval of the competent Indonesian and French authorities.

French Fra nc will be used as currency of account and currency payment of the contra cts.

A down-payment equal to 10

%

of the amount of the contract will be paid when placing the order and the ba lance will be settled between the order and its receipt in conformity with the terms and conditions each contract, by successively utilizing the means of financing foreseen in ar-ticle 2 in accordance with the modalities of arar-ticle 5 of the present a greement.

The ultimate date for the drawing up of contracts to be

fi-nanced under the present agreement is fixed on december

ARTICLE 9
