AGREEMENT

RELATI NG TO FRENCH CRED I TS FOR THE FINANCING

OF FOUR SEMI-CONTA I NER

The Government of the Republic of Indonesia and the Government of the French Republic, with a view to facilitate the development efforts of Indonesia, agreed on following provisions .

ARTICLE 1

-A maximum amount of FIVE HUNDRED HILLION FRENCH FR-ANCS

(500.000.000 F .) is put at the disposal of the Indonesian Government in the form of credits to finance the purchase of four semi-container ships from french shipyards, if the Indonesian Government decides to choose french shipyard(s) for this order.

ARTICLE 2

-The credits set in article 1 consist of a loan from the French Treasury to Hank Indonesia, acti .ng on theaacount of the Indonesian

Government of a maximum of TV/0 HUNDRED HILLION FRENC.I FRANCS

(200.000.000 F .) and bankers 'credits guaranteed by French Treasury of a maximum amount of THREE HUNDRED MILLION FRENCH FRANCS ( 3 0 0 . 000 . 000 F . ) destined for financing the importation of the said semi - container ships in accordance with the p rovisions mentioned in article

agreement .

ARTICLE

3

-The loan fr om the Treasury and the guaranteed bankers ' cr e dits which are extended in conjunction with the former will be respectively utilized in the proportion of 40

of the contra ct .

The rights of drawing on the Treasury loan will thus be e q ual to 40 % of the value of the s h ips ordered in France.

The means of financing provide d for in a r t icle 2 a re e a r mar k ed for t h e sole purchase of the four semi - container ships and cannot be used for any other purpose . Should the cost of the project be finally less than FIVE HUNDRED MILLION FRANCS ( 5 00 million F.) , the b a lance of the

credit would be c a n c elled .

ARTICLE

-The guaranteed bankers' credits mentioned in articl e ｾ＠ will be redeemed in ten (10) years by twenty (20) equal and successive semi-annual instalments, the first one falling due six months after thedelivery dates, as stipulated in the commercial contract or in the banker

.credit agreement. The rate of interest is the current export rate to ｷｨｩ｣ｾｾ､､･､＠

the cost of credit insurance of COFACE.

A financial agreement between Bank Indonesia and the French Institutions will stipulate, if necessary, the modalities of utilization and reimbursment of these guaranteed bankers ' credits.

The agreements relating to the bankers' credits will be appro-ved by Bank Indonesia in case they are note directly signed by this Bank.

ARTICLE 7

-The order is subject to a contract between the French supplier and the Indonesian buyer, t he qualification of which into the present

agreement requires a prior approval of the competent Indonesian and French authorities.

French franc will be used as currency o f a ccount and currency of payment of the contract.

A down-payment equal to 10

%

of the amount of the contract will be paid when placing the order and the balance will be settled

between the order and its receipt in conformity with the terms and condi-tions of the contract, by successively utilizing the means of financing foreseen in articla 2 in accordance with the modalities of article 3 of the present agreement .

ARTICLE 8

-The Indonesian Government shall inform the French Government about their decision regarding the award of the contract before the 30 of june 19 79. Unless a new limit date has been fixed by mutual agreement, the credits will be cancelled after that date.

POUR L ' INDONESIE

-Le Gouvernement de la ｾ･ ｰｵ｢ｬｩｱｵ･＠ de l'Indone sie et le Gouverneme nt de la Republique ｆｲ｡ｮｾ｡ｩｳ･＠ sont convenus des dis p ositions suivantes en vue de faciliter l'effort de developpement e c onomique de l'Indonesie.

ARTICLE 1

-Une somme maximum de CINQ CENT MILLIONS DE FRANCS

(500.000.000 F.) est mise a la disposition du Gouvernement indonesien sous forme de credits pour fin a ncer l'achat par l'Indonesie a des chantiers

ｦｲ｡ｮｾ｡ｩｳ＠ de quatre navires semi-porte conteneurs, si le GouverPement _{ｩｮｾｯﾭ}

n esien decide de choisir un ou des chantiers ｦｲ｡ｮ ｾ ｡ｩｳ＠ pour cette nommand e.

ARTICLE 2

-Les concours financie rs prevus a l'article 1 ci-dessus sont constitues ､ Ｑ ｵ ｾ＠ prc t ｾ ｵ＠ Tresor ｦｲ｡ｮｾ｡ｩｳ＠ a l a Banque d'Indones ie, agissant pour le compte de l'Etat indonesien, d'un montant maximum de DEUX CENT MILLIONS DE FRailCS ( 2 00 . 000 . 000 F .) et de credits b a nc aires garantis par le Tresor ｦｲ｡ｮｾ｡ｩｳ＠ d'un montant ma ximum de TROI S CENT MILLIONS DE FRANCS

(300.000.000 F .) destines a financer l'import a tion des quatre na vires semi-porte contenears susmentionnes selon les modalites definies a l'ar-ticle 4 du present texte.

ARTICLE 3

-Les prets du Tresor et les credits bancaires garantis q ui les accompagnent seront utilises dans les proportions de 40

Les droits de tirage sur les prets du Tresor seront done egaux a 40

de la valeur des navires commandes en France.

ARTICLE 4

-Les moyens de financements prevus a l'article 2 c i-dessus ne pourront etre affectes qu ' au financement de l ' i mp ortation des q uatre navires semi-porte conteneurs et ne pourront etre utilises pour un autre objet. Si le coUt du p rojet etait fin a lement inf e rieur a CINl CENT MILLION DE FRANCS (500.000.000 F .), le reste des credits se rait annule .

ARTICLE 5

-Les pret s du Tresor ｦｲ ｡ｮｾ｡ ｩｳ＠ mentionnes a l'article 2 ci-des s u s sont amortissables en vingt-six (2 6)ans j par semestrialites egales et successives a co mp ter de la da te de chaque tirag e, et portent interet au taux de

Les interets sur le solde du sont payables a la fin de chaq ue semestre. Une convention d'application entre la Banque d'Indonesie, agissant pour le compte du Gouvernement indonesien et le Credit National, agissant pour le compte du Gouvernement ｦｲ｡ｮｾ｡ｩｳＬ＠ precisera les modalites d'utili-sation et de remboursement de ces prets.

ARTICLE

6

-Les credits bancaires garantis mentionnes a l'article 2 ci-dessus sont amortissables en DIX (10) ans par semestrialites egales et successives, la premiere echeant six mois apres les dates de livraison, selon les stipulations du contrat commercial ou de la convention de credit bancaire. Leur taux d'interet est le taux usuel des credits a l'exportation, auquel s'ajoute le cout de l'assurance-credit de la COFACE.

Un accord financier entre les etablissements bancaires

fran-ｾ｡ｩｳ＠ et la Banque d'Indonesie precisera si necessaire, les modalites de

l'utilisation et du remboursement de ces credits bancaires garantis.

Les accords relatifs aux credits bancaires seront approuves par la Banque d' I ndonesie ｳＧｩｾｮ･＠ sont pas signes directement par elle.

ARTICLE

7

-La commande fait l'objet entre l'acheteur indonesien et le fournisseur ｦｲ｡ｮｾ｡ｩｳ＠ d'un contrat dont l'admission sur le present protocole doit etre prealablement approuvee par les autorites indonesiennes et fran-ｾ｡ｩｳ･ｳ＠ competentes.

La monnaie de compte et la monnaie de paiement des contra ts sont le franc ｦｲ｡ｮｾ｡ｩｳ＠ •

Un commande et le conformement a successive des lites definies

-Le Gouvernement indonesien informera avant le 30 juin 1979 le Gouvernement

de sa decision quant a l'attribution de la com-mande. Sauf si une nouvelle date limite a ete fixee d'uh commun accord

les credits seront annules apres cette date . '
