DALAM
KERJA SAMA ELECTRONIC GOVERNMENT
MEMORANDUM SALING PENGERTIAN ini dibuat oleh dan antara
KEMENTERIAN PENOAYAGUNAAN APARATUR NEGARA DAN
REFORMASI BIROKRASI REPUBLIK INDONESIA (selanjutnya disebut sebagai "KEMENPAN-RB") dan KEMENTERIAN KOMUNIKASI DAN INFORMA TIKA REPUBUK SINGAPURA (selanjutnya disebut sebagai
"MCI"),
selanjutnya masing-masing disebut sebagai"Plhak"
dansecara
bersama-sama disebut sebagai"Para Pihak".
MENGINGAT bahwa salah satu misi dari KEMENPAN-RB adalah untuk meningkatkan kualitas penyetenggaraan administrasi pemerintahan dan 11 pelayanan publik melalui pengaturan sistem electronic government yang
efektif dan efisien.
MENGINGAT bahwa misi MCI adalah untuk mengawasi perkembangan sektor informasi dan komunikasi yang dinamis untuk membangun bangsa dengan masyarakat yang sating terhubung serta meraih kualitas hidup yang lebih baik.

MERWUK kepada Persetujuan Dasar mengenai Kerjasama Ekonomi dan T eknik antara Pemerintah Republik Indonesia dan Pemerintah Republik
Singapura yang ditandatangani pada tanggal 29 Agustus 1974.
MENGAKUI bahwa kedua Pihak memiliki kepentingan strategis yang sama dan menyepakati kerangka kerja yang luas untuk kerja sama di bidang electronic Government (selanjutnya disebut "e-Govemmenf'), atas dasar kesetaraan dan saling menguntungkan, serta untuk mempromosikan
kemajuan lebih lanjut dalam pengembangan
e-Govemment
dan layanandigital untuk Republik Indonesia dan Republik Singapura.
KEDUA PIHAK TELAH MENCAPAI KESEPAHAMAN SEBAGAI BERIKUT:
PASAL 1
TUJUAN KERJASAMA
1. Kedua Pihak akan berusaha untuk bekerjasama di bidang
e-Govemment sesuai dengan Memorandum Saling Pengertian ini (selanjutnya disebut "MSP"). Untuk tujuan tersebut, Para Pihak dapat
bersama-sama mengidentifikasi
satu atau lebih proyek
e-Govemment
untuk dikerjasamakan.
2. Untuk setiap proyek e-Govemment sebagaimana dimaksud dalam
Pasal 1, kedua Pihak dapat menentukan ruang lingkup kerja sama
yang terdiri dari:
(a) berbagi pengalaman dan pengetahuan dalam kegiatan terkait
e-Govemment yang diselenggarakan o&eh masing-masing Pihak
untuk memperkuat kerja sama bilateral; dan
(b) bidang lain yang menjadi kepentingan bersama mengenai
e-Govemment yang disepakati bersama oleh Para Pihak.
3. Untuk tujuan melaksanakan kegiatan-kegiatan dibawah MSP ini,
lembaga pelaksana untuk Singapura adalah Info-Communications
Development Authority of Singapo19 (sebuah badan yang dibentuk
dibawah the Info-Communications Development Authority of Singapore
PASAL.2
PERJANJIAN KHUSUS
Untuk pelaksanaan MSP ini, Para Pihak dapat, sesuai dengan ketentuan
hukum di masing-masing negara Para Pihak, dapat menandatangani
perjanjian terpisah untuk pelaksanaan proyek yang ditentukan bersama atau aktivitas sesuai dengan ruang lingkup MSP ini. Perjanjian-perjanjian
tersebut akan merinci tugas dan tanggung jawab Para Pihak, keter1ibatan
pihak ketiga, dan pengaturan administrasi dan keuangan sesuai
kesepakatan bersama.
PASAL3
HAK KEKA Y AAN INTELEKTUAL
1. Hak terhadap kekayaan intelektual, ataupun yang menyangkut, setiap dokumen atau bahan yang diberikan oleh satu Pihak kepada Pihak lain dibawah MSP akan tetap menjadi milik Pihak yang memberikan
dokumen atau bahan. Hak-hak tersebut akan diatur dan dilindungi oleh
Pihak yang menerima dokumen atau bahan.
2. Masing-masing Pihak akan mengupayakan untuk melindungi, dalam
wilayahnya, hak kekayaan intelektual Pihak lainnya sesuai dengan
hukum nasional yang berlaku di negara Pihak pertama.
3. Bila terdapat kekayaan intelektual baru yang merupakan hasil dari
pengaturan, program ataupun proyek yang dilaksanakan dibawah MSP
ini, Para Pihak akan mendiskusikan dan menyepakati mengenai
kepemilikan hak kekayaan intelektual dalam seluruh kekayaan
intelektual baru sebelum dimulainya pengaturan, program atau proyek
dan akan membentuk perjanjian terpisah untuk pengaturan, program atau proyek tersebut.
PASAL.4
BIAY A, PENGELUARAN DAN SUMBER DAYA
1. Kecuali ditentukan sebaliknya secara tertulis oleh kedua Pihak,
masing-masing Pihak akan menanggung biaya dan pengetuarannya masing-masing, dan menyediakan sumber daya masing-masing untuk

diatur dibawah MSP ini akan tergantung ketersediaan dana dan sumber daya lain dari masing-masing pada saat itu.PASAL5 KERAHASIAAN

Setiap Pihak wajib menjaga kerahasiaan dokumen
, informasi dan data
lainnya yang diterima untuk pelaksanaan MSP ini dan wajib menggunakan dokumen tersebut, informasi, dan data lainnya hanya untuk maksud dan tujuan dari MSP ini.
2. Dalam hal berakhimya MSP ini, ketentuan Pasal ini wajib tetap bertaku ter1epas dari pengakhiran MSP ini.
PASAL6
PENYELESAIAN SENGKETA
Setiap perbedaan yang timbul dari penafsiran, pelaksanaan dan/atau penerapan MSP ini akan diselesaikan secara damai melalui konsultasi dan negosiasi antara Para Pihak tanpa melibatkan Pihak ketiga atau pengadilan internasional.
PASAL 7
KERANGKA HUKUM
Kegiatan kerjasama yang akan dilakukan di bawah MSP ini akan dilakukan sesuai dengan hukum dan peraturan masing-masing negara yang bertaku. MSP ini tidak menciptakan atau dimaksudkan untuk menimbulkan hak yang dapat diberiakukan ataupun menimbulkan kewajiban hukum yang mengikat terhadap salah satu Pihak.
PASAL8
PENANGGUHAN
1. Setiap Pihak berhak untuk alasan keamanan nasional, kepentingan
nasional, ketertiban umum atau kesehatan masyarakat, untuk
menghentikan sementara, baik seluruhnya atau sebagian,
pelaksanaan Mou ini.
2. Penangguhan akan ber1aku segera setelah pemberitahuan tertulis
diberikan kepada Pihak lain mefalui saluran diplomatik.
PASAL9
AMANDEMEN
Mou ini dapat ditinjau kembali atau diubah setiap saat dengan persetujuan
tertulis dari Para Pihak. Setiap perubahan akan mulai bertaku pads
tanggal yang dapat ditentukan bersama oleh Para Pihak dan merupakan bagian yang tidak terpisahkan dari MoU ini.
PASAL 10
MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN
1. MoU ini akan mulai ber1aku pada tanggal penandatanganannya.
2. MoU ini wajib tetap ber1aku untuk jangka waktu 3 (tiga) tahun dari
tanggal penandatanganan, dan dapat diperbaharui untuk periode 3
(tiga) tahun berturut-turut masing-masing dengan persetujuan tertulis dari Para Pihak.
3. Setiap Pihak dapat mengakhiri MoU ini setiap saat dengan
memberikan pemberitahuan tertulis ke Pihak lain setidaknya 6 (enam) bulan sebelumnya.
4. Pengakhiran MoU ini tidak mempengaruhi keabsahan dan bertakunya
setiap proyek, program dan kegiatan yang sedang ber1angsung dan
SEBAGAI BUKTI, yang
bertanda
tangan di bawah ini, telah menandatanganiMoUini.
Dibuat datam rangkap dua di Singapura pada tanggal dua puluh delapan
bulan Juli tahun dua ribu lima belas dalam bahasa lnggris dan Indonesia,
semua naskah memitiki kekuatan hukum yang sama. Dalam hal perbedaan
penafsiran atas Mou ini, maka naskah bahasa lnggris yang berlaku.

ON
ELECTRONIC GOVERNMENT COOPERATION
THIS MEMORANDUM OF UNDERSTANDING is made by and between the
MINISTRY OF ADMINISTRATIVE AND BUREAUCRATIC REFORM OF THE REPUBLIC OF INDONESIA (hereinafter referred to as ·KEMENPAN-RB"), and
the MINISTRY OF COMMUNICATIONS AND INFORMATION OF THE
REPUBLIC OF SINGAPORE (hereinafter referred to as "MCr), collectively
referred to as
"both
Parties" and individually as "Party".NOTING that one
of
the missionsof
KEMENPAN-RB is to improve the qualityof
government administration and public services through the setting up of
effective and efficient electronic Government systems.
NOTING that the mission
of
MCI is to oversee the developmentof
a vibrantIi 11.
infocomm sector so as to build a nation
of
connected people and achieve a 11better quality
of
life.REFERRINGto the Basic Agreement on Economic and Technical Cooperation
between the Government
of
the Republicof
Indonesia and the Government ofthe Republic
of
Singapore signed in Singapore on 29thof
August 1974.RECOGNISING that both Parties share similar strategic interests and agree on
a broad framework for cooperation in the area of electronic Government
(hereinafter referred to as "a-Government"), on the basis
of
equality and mutual l1benefit, to promote further advancements
in
the developmentof
a-Government and digital services to the Republic of Indonesia and the Republicof
Singapore.Both parties have reached the following understandings:
ARTICLE 1
PURPOSE OF COOPERATION
1. Both Parties will endeavour to collaborate in the field of e-Govemment in
accordance with this Memorandum
of
Understanding (hereinafter referredto as this •MolJ•). For this purpose, both Parties may jointly identify one or
more e-Govemment projects
for
collaboration.2. For each e-Govemment project identified under Article 1, both Parties may
detennine their scope
of
collaboration which may indude:(a) the sharing
of
their respective experiences and knowledge on thedevelopment
of
E-Govemment, with the purpose of strengtheningbilateral cooperation between the parties; and
(b) Other areas that become mutual interest between the Parties and
mutually agreed by the Parties.
3. For the purposes
of
carrying outof
activities under this MoU, theimplementing agency for Singapore will be the Info-Communications
Development
Authority of
Singapore (a statutory board fonned under theInfo-Communications Development Authority
of
Singapore Act).ARTICLE2
SPECIFIC AGREEMENTS
For the implementation of this MoU, the Parties may, within
the
limits of the respective lawsof
each Party, enter into separate agreements forthe
executionof
mutually identified projects or activities within the scopeof
this MoU. These agreements will detail the respective roles and responsibilities of the Parties,involvement
of
third Parties and other financial and administrative arrangementsAR11CLE3
INTELLECTUAL PROPERTY RIGHTS
1. The title to, and intellectual property rights in, or in relation to, any
document or material supplied by one Party or the other Party under this
Mou will remain
with
the Party supplying the document or material. Suchtitte and rights will be respected and protected by the Party receiving the document or material.
2. Eadl Party will use reasonable endeavour to protect within its territory, the intellectual property rights of the other Party in accordance with the domestic laws in force in the first-mentioned Party's country.
3. If any new intellectual property is created as a result of any arrangement.
programme or project carried out under this MoU, the Parties will discuss and agree on the ownership of the intellectual property rights in all such
new intellectual property prior to the commencement of the arrangement,
programme or project and have this agreement documented in a separate
agreement for that arrangement, programme or project.
ARTICLE4
COSTS. EXPENSES
ANDRESOURCES
1. Unless otherwise decided in writing by both Parties, each Party will bear its
own costs and expenses, and provide its own resources for the
implementation of this Mou and any matter related thereto.
2. Any activity or project organised under this MoU will always be subject to
the availability of funds and other resources of each Party at the material time.
ARTICLES CONFIDENTIALITY
1. Each Party shall maintain the confidentiality of documents, information, and other data received for the implementation
of
this MoU and shall use such documents, information and other data only for the purpose and objectives of this MoU.2. In the event of the termination of this MoU, the provisions of this paragraph shall remain in effect notwithstanding the termination of this MoU.
ARTICLE&
DISPUTE SETI'L.EMENT
Any differences arising from the interpretation, implementation and/or application of this MoU shall be settled amicably through consultations and negotiations between the Parties without reference to any third Party or international tribunal.
ARTICLE7 LEGAL FRAMEWORK
Cooperative activities to be carried out under this MoU will be conducted in accordance with the applicable laws and regulations of each country. This MoU neither creates nor is intended to create any enforceable rights or impose any legally binding obligations on either Party.
ARTICLES SUSPENSION
1. Each Party reserves the right for reasons of national security, national interest, public order or public health to suspend temporarily, either in whole or in part, the implementation of this MoU;
2. The suspension shall be effective immediately after written notification has
been given to the other Party through diplomatic channels.
ART1CLE9 AMENDMENTS
This MoU may be reviewed or amended at any time by mutual written consent
of the Parties. Any amendments will come into effect on such date as may be
ARTICLE 10
ENTRY INTO FORCE, DURATION AND TERMINATION
1. This. MoU shall come into force on the date of its signing;
2. This MoU shall remain in force for a period of 3 (three) years from the date of its signing, and may be renewed for a successive periods of 3 (three) years each by mutual written consent of the Parties;
3. Either Party may terminate this MoU at any time by giving to the other Party written notification at least 6 (six) months in advance;
4. The Tennination of this Mou will not affect the validity and duration of any ongoing projects, programs and activities made under this MoU.
