PROVISIONS ON THE EXPORT OF ROUND RATTANS

(Decree of the Minister of Industry and Trade No. 440/MPP/Kep/9/1998 dated September 25, 1998)

THE MINISTER OF INDUSTRY AND TRADE

Considering :

a. that since rattan processing industries provide very wide job opportunities

especially for grass-roots people, it is necesssary to maintain sustainable

their supply of rattans;

b. that in the framework of enhanching orderly business, supporting natural

resources conservation efforts to contribute global environment quality as

well as facilitating supervision and at the same time ensuring smooth

export, it is necessary to restipulate the export provisions on round rattans;

c. that in relation thereto, it is necessary to issue a decree of the Minister of

Industry and Trade.

In view of:

1. The Trade Ordinance of 1934 (Statute Book of 1938 No. 86) as already

amended and supplemented;

2. Law No. 5/1967 on the principles of forestry (Statute Book of 1967 No. 8,

Supplement to Statute Book No. 2823);

3. Law No. 5/1984 on industrial affairs (Statute Book of 1984 No. 22,

Supplement to Statute Book No. 3274);

4. Law No. 5/1990 on conservation of natural resources and their ecosystem

5. Law No. 7/1994 on validation of the Agreement establishing The World

Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute

Book No. 3564);

6. Law No. 1995 on customs affairs (Statute Book of 1995 No. 75,

Supplement to Statute Book No. 3612);

7. Government Regulation No.1/1982 on the realization of export, import and

the flow of foreign exchange (Statute Book of 1982 No. 1, Supplement to

Statute Book No. 3210) as already amended by Government Regulation

No. 24/1985 (Statute Book of 1985 No. 33, Supplement to Statute Book

No. 3291);

8. Government Regulation No. 20/1994 on share ownership in compaies set

up in the framework of foreign investment (Statute Book of 1994 No. 28,

Supplement to Statute Book No. 3552);

9. Presidential Decree No. 260/1967 on the definition of tasks and

responsibility of the Minister of Trade in the field of international trade;

10. Presidential Decree No. 44/1974 on principles of organizations of

ministries;

11. Presidential Decree No. 61/1998 on the functions, tasks, organizational

structures and working arrangements of ministries;

12. Presidential Decree No. 122/M/1998 on the establishment of the

Development Reforms Cabinet;

13. Decree of the Minister of Industry and Trade No. 225/Kp/X/1995 jo. No.

317/MPP/Kep/9/1997 on the releace of goods to other countries outside the

general provisions in the field of export;

14. Decree of the Minister of Industry and Trade No. 29/MPP/SK/2/1996 jo

No. 92/MPP/Kep/4/1997 on the organization and working arrangement of

15. Decree of the Minister of Industry and Trade No. 12/MPP/Kep/1/1998 on

corporate regristration;

16. Decree of the Ministry and Trade No. 408/MPP/Kep/10/1997 on the

provisions and procedures for granting Trade Business Registration

Centificates (TDUP) and Trade Business Licences (SIUP);

17. Decree of the Minister of Industry and Trade No. 182/MPP/Kep/4/1998 on

the general provision in the field of export.

D E C I D E S

To stipulate :

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERING PROVISIONS ON THE EXPORT ROUND RATTANS

Article 1

Referred to in this decree as round rattans which can be exported shall be rattans

already rubbed roughly, washed, smoked or sulphured and round rattans already

fine-polished under tariff headings HS 1401.20.100, 1401.20.500 and

1401.90.210, organating in both Production Natural Forests and results of

cultivation.

Article 2

(1) The quantity of round rattans which can be exported every year shall be

adjusted to the total causing no threat to the conservation of forest resources

and the environment.

(2) The quantity as meant in paragraph (1) shall be stipulated by the Minister

Article 3

(1) Round rattans can exported by business entities fulfiling specific and

general requirements.

(2) The general requirement as meant in paragraph (1) shall be to enclose to

documents of export;

a. a copy of the Trade Business Licence (SIUP);

b. a copy of the Trade Business Regristration Certificate (TDUP);

c. a copy of the Taxpayer Code Number (NPWP);

d. a copy of the certificate of incorporation.

(3) The specific requirements as meant in paragraph (1) shall be according to

the provisions stipulated by the Minister of Forestry and Plaantations.

Article 4

Round rattans shall be only exported under the following conditions:

a. by means of Sight L/C payments in through State-owwned foreign exchange

banks;

b. L/C opened by importers abroad must not be lower than the Export Check Price

(HPE) effective upon the opening of the L/C.

Article 5

(1) After securing the annual export quantity from the Director General of

Forest Exploitation, exporters of round rattans shall be obliged to convey

the monthly plan of export of round rattans to the Director of export Affairs

of the Ministry of Industry and Trade with a copy made available to the

Director of Utilization and Distribution of Forest Products, Ministry of

Forestry and Plantations.

Ministry of Industry and Trade shall convey a written notification to Customs and Excise Service Offices at loading ports, containing the following matters:

a. the total and kinds of the round rattans to be exported

b. the loading port and the destination port.

Article 6

Exporters of round rattans shall be obliged to report the realization of their export, not later than 10 (ten) days after shipment, to the Directorate General of International Trade in this case the Director of Export Affairs, Ministry of Industry and Trade, with a copy made avilable to the Director of Utilization and Distribution of Forest Products, Ministry of Forestry and Plantations, by enclosing copies of L/C, the Export Declaration Document (PEB) and B/L.

Article 7

Any violation of the provisions in this decree shall be liable to sanctions on the basis of the laws in force.

Article 8

With the stipulation of this decree, the Decree of the Minister of Industry and Trade No. 187/MPP/Kep/4/1998 concerning the export of rattans shall be declared null and void.

Article 9

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be published by placing it in State Gazette

of the Republic of Indonesia.
