THE STIPULATION OF THE EXPORT TAX ON OIL PALM, PALM OIL, COCONUT OIL AND THEIR DERIVATIVE PRODUCTS
(Decree of the Minister of Finance No. 30/KMK.01/1999 dated January 29, 1999)
THE MINISTER OF FINANCE Considering :
that in the frar-tework of boosting the growth of exports and increasing foreign exchange earnings as well as creating national economy efficiency, it is deemed necessary to review and stipulate tariffs of the export tax on oil palm, palm oil coconut oil and their derivative products.
In view of:
1. Law No. 20/1997 on the non-tax state receipt (Statute Book of 1 997 No. 43, Supplement to Statute Book No. 3687);
2. Government Regulation No. 1/1982 on the realisation of exports - imports and the flow of foreign exchange as lerads amended by Government Regulation No. 24/1985 (Statute Book of 1 985 No. 32, Supplement to Statute Book Ne .3291); 3. Government Regulation No. 22/1997 on the kinds and remittance of non-tax state
receipts (Statute Book of 1997 NO 57, Supplement to Statute Book No. 3694); 4. Presidential Decree No. 1 22/Mll 998;
5. Decree of the Minister of Finance No. 487/KMK.05/1996 on the investigation of customs into export goods;
6. Decree of the Minister of Finance No. 488/KMK.05/1996 on the customs procedure in the field of export as alrady amended by Decree of the Minister of Finance No. 501/KMK.01/1998;
D E C 1 D E S : To stipulate:
Article 1
The export of oil palm, palm oil, coconut oil and their derivative products as meant in the column 2 of the At tachment to this decree shall be subjected to the export tax whose tariffs are as stipulated in column 4.
Article 2
(1) The calculation of the export tax as meant in Article 1 shall be as follows Export tax = Tariff of export tax X Export Check Price x units of goods x exchange rate.
(2) Export Check Prices (HPE) shall be the check prices stipulated periodically by the Minister of Industry and Trade after considering opinion of the Minister of Finance, and shall be effective as from the issuance of the stipulation.
(3) In the case of any lateness in the issuance of HPE, the old HPE shall remain effective until the issuance of the new HPE.
(4) In the case of HPE being unavailable, the export tax shall be calculated on the basis of FOB prices contained in the export declaration documents (PEB).
(5) The exchange rate as meant in paragraph (1) shall be the exchange rate stipulated periodically by the Minister of Finance.
Article 3
The procedure for the payment and remittance of the export tax as meant in Article 1 shall be in accordance with the provisions stipulated in the Decree of the Minister of Finance No. 335/KMK.01 711998.

This decree shall come into force as from February 1, 19 99.
For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
