DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 213/MPP/Kep/7/2001 DATED JULY 6, 2001
STIPULATION OF FISH BENCHMARK PRICES FOR THE CALCULATION OF LEVIES ON FISHERY PRODUCTS
THE MINISTER OF INDUSTRY AND TRADE,
Considering :
In order to implement the provisions of Article 5 paragraph (4) of Government Regulation No. 142/2000 regarding Tariffs of Non-Tax State Revenues applicable at the Ministry of Marine and Fishery, it is necessary to issue a decree of the Minister of Industry and Trade on the stipulation of fish benchmark prices for the calculation of levies on fishery products.
In view of :
1. Law No. 9/1985 on Fishery (Statute Book of 1985 No. 16, Supplement to Statute Book No. 3299);
2. Government Regulation No. 141/2000 on the Second Amendment to Government Regulation No. 15/1990 on fishery business (Statute Book of 2000 No. 256, Supplement to Statute Book No. 4058);
3. Government Regulation No. 142/2000 regarding Tariffs of Non-Tax State Revenues within the Ministry of Marine and Fishery (Statute Book of 2000 No. 257, Supplement to Statute Book No. 4059);
4. Presidential Decree No. 165/2000 regarding the Status, Tasks, Functions, Authority, Organizational Structures, and Working Arrangements of Ministries, which has most recently been amended by Presidential Decree No. 37/2001;
5. Presidential Decree No. 177/2000 regarding Structures and Duties of Ministries, which has most recently been amended by Presidential Decree No. 58/2001;
6. Presidential Decree No. 234/2000 regarding the Establishment of the Cabinet for the 1999-2004 period, which has been amended by Presidential Decree No. 177/M/2001;
7. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/SK/12/1998 regarding General Provisions in the Export Field, which has been amended by the Decree of the Minister of Industry and Trade No. 146/MPP/Kep/4/1999;
8. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 regarding Organization and Working Arrangement of the Ministry of Industry and Trade;
Observing :
Results of the inter-ministerial meeting with the All Indonesian Fisherman Association (HNSI), the Indonesian Fishery Businessmen Association (GAPPINDO), the Indonesian Fishery Businessmen Association (HPPI), the Indonesian Tuna Association (ASTUIN) and the Indonesian Non-Shrimp Tuna Businessmen (ASPINTU), held on January 18, 2001.
DECIDES :
To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE DECISION CONCERNING FISH BENCHMARK PRICES FOR THE CALCULATION OF LEVIES ON FISHERY PRODUCTS.
Article 1
Article 2
(1) The fish prices on the local market, as mentioned in Article 1, shall be decided by the Minister of Marine and Fishery based upon the average price of each kind of fish at the main Fish Landing Places in the Special Capital District of Jakarta, West Java, Central Java, East Java, Lampung, North Sumatera, North Sulawesi, South Sulawesi, Bali and Nusa Tenggara.
(2) The fish prices on the international market, as mentioned in Article 1, shall be decided by the Minister of Marine and Fishery based upon the average FOB price of each kind of fish for export purposes.
(3) Percentages of selling volume of fish products on the local market and for export purposes shall be decided by the Minister of Marine and Fishery based upon the volume of sales of fish products sold in the local market and the volume of sales of fish products for export purposes.
(4) HPI shall be stipulated based on the following formula :
HPI = ax + by
a = percentage of sales volume of fish on the local market; b = percentage of sales volume of fish for export purposes;
x = the average weigh price of each kind of fish on the local market; y = the average FOB weigh price of each kind of fish for export purposes.
Article 3
HPI as contained in the Attachment to this Decree, shall be effective for 3 (three) months, starting from the date of stipulation.
Article 4
The decree comes into full force as of date of stipulation.
