REGARDING
DELEGATION OF TASK AND AUTHORITY OF MINISTER OF INDUSTRY AND TRADE REGARDING ESTABLISHMENT AND SUPERVISION OF APPRAISAL COMPANY TO MINISTER
OF FINANCE

MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA
Considering :
a. that appraisal company has very important role in increasing national economic efficiency and protecting public interest;
b. that at present permit of appraisal profession was issued by Minister of Finance, while permit of appraisal company was issued and by Minister of Industry and Trade;
c. that in the framework of creating effective and sustainable supervision of appraisal, it is deemed necessary to restructure such permit and establishment of appraisal company in one institution;
d. that based on the consideration referred to in letter a, b and c, it is necessary to stipulate a Joint Decree of Minister of Industry and Trade and Minister of Finance regarding Delegation of Task and Authority of Minister of Industry and Trade Regarding Establishment And Supervision of Appraisal Company To Minister Of Finance.
In View of:
1. Bedrijsreglementerings Ordonnantie Tahun 1934 (Staatsblad Year 1938 No. 86) as amended and added; 2. Law Number 3 Year 1982 regarding Company Registration Requirement (State Gazette Year 1982 Number
7, Supplementary to State Gazette Number 3214);
3. Law Number 7 Year 1994 regarding Ratification to Agreement Establishing The World Trade Organization (State Gazette Year 1994 Number 57, Supplementary to State Gazette Number 3564);
4. Law Number 1 Year 1995 regarding The Limited Liability Company (State Gazette Year 1995 Number 13, Supplementary to State Gazette Number 3587);
5. Law Number 8 Year 1999 regarding Consumer Protection (State Gazette Year 1999 Number 42, Supplementary to State Gazette Number 3821);

2 Letter of Minister of Industry and Trade Number 560/MPP/IX/2003 dated September 23, 2003 regarding Delegation of Authority on Establishment of Appraisal Company.

Stipulate:
JOINT DECREE OF MINISTER OF INDUSTRY AND TRADE AND MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA REGARDING DELEGATION OF TASK AND AUTHORITY OF MINISTER OF TRADE AND INDUSTRY REGARDING APPRAISAL COMPANY ESTABLISHMENT AND SUPERVISION TO MINISTER OF FINANCE
Article 1
(1) Minister of Industry and Trade hereby delegates task and authority regarding regulation, establishment, and supervision of appraisal company to Minister of Finance.
(2) Under such delegation of authority referred to in paragraph (1) task and authority regarding regulation, establishment, and supervision of appraisal company shall be executed by Minister of Finance.
Article 2
Appraisal Company’s Business license (SIUPP) issued by Ministry of Industry and Trade is still valid until the expiry date of the relevant Business License (SIUPP).
Article 3
The SIUPP referred to in Article 2 shall be reregistered to Ministry of Finance, c.q., Directorate of Accounting and Appraisal, Directorate General of Financial Institution by submitting the SIUPP at the latest 6 (six) months after date of stipulation this Decree.
Article 4
Appraisal company desiring to obtain or extend the SIUPP, is obliged to comply with provision for obtaining business license stated by Minister of Finance.
Article 5
With the enforcement of this Joint Decree of Minister of Industry and Trade and Minister of Finance, Decree of Minister of Industry and Trade Number 594/MPP/Kep/VIII/2002 regarding Business License Provision for Appraisal Company is stated invalid accordingly.
Article 6
This Joint Decree of Minister of Industry and Trade and Minister of Finance shall be effective as of the date it is stipulated.
