THE RESTRICTION OF EXPORT OF CERTAIN GOODS SECURING SUBSIDY FROM THE GOVERNMENT
(Decree of the Minister of Industry and Trade No. 350/MPP/Kep/7/1998 dated July 27, 1998)
THE MINISTER OF INDUSTRY AND TRADE,
Considering:
a. that the continued monetary crisis causes a higher disparity between domestic
and international prices so that it prompts the flow of goods to other countries
including goods securing subsidy from the government;
b. That in order to ensure the fulfillment of domestic basic needs, particularly
goods securing subsidy from the government, it is deemed necessary to
stipulate the restriction of export of goods securing subsidy from the
government.
In view of :
1. The Trade Ordinance of 1934 (Statute Book of 1938 No. 86) as already
amended and supplemented;
2. Law No. 10/1995 on the customs affairs (Statute Book of 1995 No. 75,
Supplement to Statute Book No. 3612);
3. Government Regulation No. 1/1982 on the realization of export, import and
the flow of foreign exchange (Statute Book of 1982 No. 1, Supplement to
Statute Book No. 3210) as already amended by Government Regulation No.
24/1985 (Statute Book of 1985 No. 33, Supplement to Statute Book No.
3291);
4. Presidential Decree No. 260/1967 on the confirmation of tasks and
responsibility of the Minister of Industry and Trade in the field of
international trade;
5. Presidential Decree No. 44/1984 on the principles of ministerial
6. Presidential Decree No. 122/M/1998 on the establishment of the
Development Reforms Cabinet;
7. Decree of the Minister of Finance No. 228/KMK.016/1997 on the purchase
price of rice by the government to the Logistics Board;
8. Decree of the Minister of Finance No. 41 /KMK.01 /1998 on the exemption
from import duty on soybeans;
9. Decree of the Minister of Industry and Trade No. 29/MPP/SK/2/1 996 jo.
No. 92/MPP/Kep/9/1997 on the organization and working arrangement of
the Ministry of Industry and Trade;
10. Decree of the Minister of Trade No. 225/Kp/X/1995 jo. No.
317/MPP/Kep/9/1997 on the release of goods to other countries outside the
export general provisions;
11. Decree of the Minister of Industry and Trade No. 115/MPP/Kep/2/1998 on
the kinds of basic needs of society;
12. Decree of the Minister of Industry and Trade No. 182/MPP/Kep/4/1998 on
general provisions in the field of export.

To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE RESTRICTION OF EXPORT OF CERTAIN GOODS SECURING SUBSIDY FROM THE GOVERNMENT
Article 1
Referred to in this decree as certain goods securing subsidy from the government
shall be several kinds of goods imported under special facilities in the form of

The export of the goods as meant in the Attachment to this decree shall be subject
to export tax whose rates are stipulated by the Minister of Finance.
Article 3
Before the stipulation of the export tax as meant in Article 2, all the certain goods
contained in the Attachment to this decree shall be prohibited from being
sent/taken abroad or exported starting from July 28, 1998 through August 16,
1998.
Article 4
Violation of provisions in this decree shall be subject to sanctions according to
the laws in force.
Article 5
This decree shall come into force as from the date of stipulation.
For public cognizance, this decree shall be published by placing it in the State
Gazette of the Republic of Indonesia.
