REPUBLIK INDONESIA DAN
REPUBLIK BO LIV ARIA VENEZUELA
MENGENAI PEMBENTUKAN KOMISI BERSAMA TING KAT TINGGI
Pemerintah Republik Indonesia dan Pemerintah Republik Bolivaria Venezuela, yang selanjutnya disebut sebagai "Para Pihak".
Merujuk Persetujuan antara Pemerintah Republik Indonesia dan Pemerintah Republik Bolivaria Venezuela mengenai Kerjasama Ekonomi dan Teknik yang ditandatangani tanggal 26 Nopember 1991 dan Memorandum Saling Pengertian antara Pemerintah Republik Indonesia dan Pemerintah Republik Bolivaria Venezuela yang ditandatangani tanggal 12 Agustus 2000.
Telah menyetujui hal-hal sebagai berikut: Pasal I
Komisi Bersama Tingkat Tinggi dibentuk, dengan mandat penuh untuk mendorong dialog, sating tukar, fotmulasi dan pelaksanaan inisiatif, proyek-proyek, program-program dan proposal lainnya, yang bertujuan untuk meningkatkan dan meluaskan kerjasama dan aksi yang konkrit antara kedua negara.
Pasal II
Untuk mencapai tujuan sebagaimana terkandung dalarn mandat tersebut, Komisi Bersama Tingkat Tinggi mernpunyai fungsi-fungsi sebagai berikut:

Menilai dan mengevaluasi perkembangan perjanjian yang ditandatangani kedua negara.
Mendorong kesepakatan dari setiap Perjanjian-Perjanjian dan Persetujuan-Persetujuan bagi ke1jasama dibidang perdagangan, ekonomi, ilmu pengetahuan, teknologi, kebudayaan, keamanan, hukum dan sebagainya. Mengidentifikasi, menganalisa dan mengevaluasi perubahan dan kerjasama bidang-bidang baru yang disetujui untuk memperluas ruang lingkup kepentingan kedua negara.
4. Mengusulkan mekanisme yang akan memfasilitasi dan mempercepat pelaksanaan berbagai Pe1janjian dan Persetujuan yang telah ditandatangani oleh kedua negara.
Pasal Ill
Komisi Bersama Tingkat Tinggi tersebut akan dipimpin oleh pejabat setingkat menteri dan terdiri dari wakil-wakil pejabat pemerintah yang terkait dalam program kerjasama pembangunan antara kedua negara.
Komisi Bersama Tingkat Tinggi sepakat untuk mengikutsertakan wakil-wakil dari lembaga pemerintah lainnya yang terkait untuk melakukan kerjasama sebagaimana temmsuk dalarn agenda, serta wakil-wakil lain yang ada kaitannya dengan bidang; perekonornian, ilrnu pengetahuan, kebudayaan dan akademik. Kornisi dapat membentuk kornisi teknis untuk pembahasan isu-isu khusus.
Pasal IV
Komisi Bersama Tingkat Tinggi akan bertemu di Jakarta dan Caracas secara bergantian yang rnana kedua Pihak menganggap perlu untuk melaksanakan Memorandum Saling Pengertian ini.
Tindaklanjut dari kegiatan-kegiatan tersebut akan menjadi tanggungjawab kelompok ketja yang dibentuk oleh suatu koordinator dan duta besar kedua belah Pihak yang bertugas di negara akreditasinya, yang dapat bertemu sesering mungkin apabila diperlukan, yang sebelullU1ya juga telah menyampaikan kepada masing-masing Ketua Kornisi yang mana mereka harus menyan1paikan laporannya.
Pasal V
Memorandum Saling Pengertian dapat diubah setiap saat, jika dianggap perlu, dengan kesepakatan kedua Pihak.
Pasal VI
Setiap perselisihan antara Pihak mengenai interpretasi dan pelaksanaan Memorandum Saling Penge11ian ini dapat diselesaikan melalui konsultasi atau negosiasi antara Para Pihak.
Pasal VII
Memorandum Saling Penge1tian berlaku ·sejak tanggal penandatanganan dan berlaku selama dua tahun, secara otomatis dapat diperpanjang dalam jangka waktu yang sama, kecuali jika salah satu Pihak memberitahukan kepada Pihak lainnya keinginan untuk menghentikan Memorandum ini, paling tidak tiga bulan sebelum masa berakhimya atau setiap saat perpan jangannya.
Pengakhiran dari Memorandum Saling Pengertian ini tidak berakibat pada keabsahan dan masa berlaku kegiatan-kegiatan yang dibuat berdasarkan Memorandum Saling Pengertian ini hingga kegiatan tersebut selesai, kecuali Para Pihak menyetujui lain.
SEBAGAI BUKTI, yang bettandatangan dibawah ini, yang diberi kuasa oleh masing-masing pemerintah telah menandatangani Memorandum Saling Penge1tian tersebut.

MEMORANDUM DE ENTENDIMIENTO ENTRE
LA REPUBLICA DE INDONESIA
y
LA REPUBLICA BOLIVARIANA DE VENEZUELA PARA EL ESTABLECIMIENTO DE UNA COMISION
MIXT A DE AL TO NIVEL
El Gobierno de la Republica de Indonesia
y
el Gobierno de laRepublica Bolivariana de Venezuela, en adelante denominados "Las Partes";
Recordando el Acuerdo entre el Gobierno de la Republica de
Indonesia
y
el Gobierno de la Republica de Venezuela en Cooperaci6nEcon6mica y Tecnica, suscrito el 26 de noviembre de 1991, y el Memorandum de Entendimiento entre el Gobierno de la Republica de Indonesia y el Gobierno de la Republica Bolivariana de Venezuela, suscrito el 12 de agosto de 2000.
Han acordado lo siguiente:
ARTiCULO I
Las Partes acuerdan establecer una Comisi6n Mixta de Alto Nivel,
de amplio mandato, para estimular el dialogo, intercambio, formulaci6n
y
ejecuci6n de iniciativas, proyectos, programas y otras propuestas, con
miras a profundizar y ampliar el desarrollo de las acciones concretas de
cooperaci6n entre ambos paises.
ARTiCULO II
Para el logro de los objetivos contenidos en amplio mandato, la Comisi6n tendra las siguientes atribuciones:
1. Revisar
y
evaluar el estado de los Conveniosy
Acuerdos suscrito entrelos dos paises.
2. Promover la conclusion de acuerdos y convenios en materia de
cooperaci6n en las areas de comercio, economia, ciencia, tecnologia,
3. ldentificar, analizar
y
evaluar nuevas areas de intercambioy
colaboraci6n que permitan ampl iar el alcance de los intereses entreambos paises.
4. Proponer mecanismos que faciliten y agilicen la ejecuci6n eficaz de los
acuerdos y convenios suscritos por ambos paises.
ARTiCULO Ill
La Comisi6n Mixta de Alto Nivel estara presidida a nivel ministerial e
integrada por representantes de alto nivel de los sectores
gubernamentales que participan en el desarrollo de los programas de cooperaci6n entre ambos paises.
La Comisi6n Mixta podra acordar invitar a participar a otros representantes de organismos gubernamentales cuyas competencias, sean relevantes para el tratamiento de los temas incluidos en la agenda, asi como, otros representantes de la vida econ6mica, cientifica, cultural y
academica del pais.
La Comisi6n Mixta podra establecer comisiones tecnicas para el analisis de temas especfficos.
ARTiCULO IV
La Comisi6n Mixta de Alto Nivel se reunira altemativamente en Yakarta y Caracas cuando ambas Partes lo consideren conveniente para impulsar el cumplimiento del presente Memorandum de Entendimiento.
El seguimiento de las actividades y gestiones de la Comisi6n estara a cargo de un Grupo de Trabajo integrado por un Coordinador por cada Parte y el Embajador acreditado en las respectivas capitales, quienes podran reunirse cada vez que sea necesario, previa notificaci6n a los respectivos presidentes de la Comisi6n Mixta de Alto Nivel, a quienes remitiran un informe de los asuntos tratados.
ARTiCULOV
El Memorandum de Entendimiento podra ser modificado en cualquier momenta si es considerado necesario por mutuo consentimiento
ARTiCULOVI
Cualquier diferencia entre las Partes concernientes a la interpretaci6n o aplicaci6n de este Memorandum de Entendimiento debera ser resuelta amigablemente a traves de consultas o negociaciones entre las Partes.
ARTiCULO VII
El presente Memorandum de Entendimiento entrara en vigor en la fecha de su firma y continuara en vigor por dos anos renovables automaticamente por iguales periodos, a menos que una de las Partes manifieste a la otra su deseo de denunciarlo por lo menos tres meses antes de la fecha de su expiraci6n o de cualquiera de sus pr6rrogas.
La denuncia de este Memorandum de Entendimiento no afectara la validez
y
duraci6n de cualquiera actividad efectuada bajo el mismo hasta la finalizaci6n de dichas actividades a menos que las Partes acuerden otra cosa.EN FE DE LO CUAL los infrascritos debidamente autorizados por sus respectivos Gobiernos han firmado el presente Memorandum de Entendimiento.

MEMORANDUM OF UNDERSTANDING BETWEEN
THE REPUBLIC OF INDONESIA AND
THE BOLIVARIAN REPUBLIC OF VENEZUELA
FOR THE ESTABLISHMENT OF A HIGH LEVEL JOINT COMMISSION
The Government of the Republic of Indonesia and the Government of the Bolivarian Republic of Venezuela, hereinafter referred to as "The Parties";
Referring the Agreement between the Government of Republic of Indonesia and the Government of the Bolivarian Republic of Venezuela on Economic and Technical Cooperation, signed on 26 November 1991, and the Memorandum of Understanding between the Government of Indonesia and Government of the Bolivarian Republic of Venezuela, signed on 12 August 2000.
Have agreed as follows : ARTICLE I
A High Level Joint Commission is hereby established, with ample mandate to stimulate the dialogue exchange, formulation and implementation of initiatives, projects, programs and other proposals, with the view of deepening and widening the development of concrete actions of cooperation between both countries.
ARTICLE II
For the achievement of the objectives contained in this ample mandate the Commission will have the following functions :
1. To review and evaluate the situation of Treaties and Agreements signed between both countries.
2. To promote the conclusion of treaties and agreements for cooperation in
the areas of trade, economics, science, technology, culture, security, justice, etc.
3. To identify, analyze and evaluate new areas of exchange and cooperation that allow to expand the scope of interests between both countries.
4. To propose mechanisms which will facilitate and expedite the efficient implementation of treaties and agreements signed by both countries.
ARTICLE III
The High Level Joint Commission shall be presided at a ministerial level and composed of high level representatives of governmental sectors participating in the development of cooperation programs between both countries.
The Commission may agree to invite as participants representatives of other government bodies with relevant competence to deal with the items included in the agenda, as well as others representatives from life of the country: economic, scientific, cultural and academic. The Commission may establish technical commissions for the analysis of specific issues.
ARTICLE IV
The High Level Joint Commission shall meet alternatively in Jakarta and Caracas whenever both Parties consider it convenient in order to push forward the fullfilment of the present Memorandum of Understanding.
The follow up of the activities and good offices of the Commission will be the responsibility of a Working Group formed by a Coordinator for each of the Parties and the Ambassador accredited in the respective capitals, who may meet
as o~en as necessary, having previously notified the respective Presidents of the
High Level Joint Commission, to whom they will submit a report about the issues dealt with.
ARTICLEV
This Memorandum of Understanding may be amended at any time, if deemed necessary, by mutual consent of both Parties.
ARTICLE VI
Any disputes between the Parties concerning the interpretation or application of this Memorandum of Understanding should be settled amicably through consultations or negotiations between the Parties.
ARTICLE VII
This Memorandum of Understanding shall come into force on the date of
signature and shall continue in force for two years, automatically renewable for equal periods, unless one Party notifies the other of its desire to terminate it at
least three months before the date of its expiration, or any of its prorogation.
The termination of the Memorandum of Understanding shall not affect the validity and duration of any activity made under Memorandum of Understanding until the completion of such activity, unless the Parties agree otherwise.
IN WITNESS WHEREOF, the undersigned, duly authorized by their respective Governments, have signed the Memorandum of Understanding.
