PERSETUJUAN ANTARA PEMERINTAH

REPUBLIK INDONESIA, PEMERINTAH REPUBLIK INDIA DAN . PEMERINTAH KERAJAAN THAILAND TENTANG PENETAPAN

TITIK PERTEMUAN TIGA GARIS BATAS DAN PENETAPAN GARIS BATAS KETIGA NEGARA DI LAUT ANDAMAN

PEMERINTAH REPUBLIK INDONESIA, PEMERINTAH REPUBLIK INDIA, DAN PEMERINTAH KERAJAAN THAILAND,

BERHASRAT untuk memperkuat ikatan persahabatan bersejarah yang ada antara ketiga Negara,

DAN BERHASRAT untuk menetapkan titik pertemuan tiga garis batas dan menetapkan garis batas yang bersangkutan dari ke-tiga Negara di Laut Andaman,

TELAH MENYETUJUI SEBAGAI BERIKUT

PASAL I

Untuk maksud-maksud Pasal ini

1. Titik pe. emuan tiga garis batas Indonesia, India dan Thailand di Laut Andaman adalah titik-titik yang ko-ordinatnya 07° 47' 00" Lintang Utara 95° 31' 48" Bujur Timur.

2. Garis batas landas kontinen Indonesia dan India adalah garis lurus yang ditarik dari titik pertemuan tiga garis batas menuju ke arah Barat Daya sampai ke titik 0 yang dimaksud pada Pasal 1 Persetujuan Antara Pemerintah Republik Indonesia dan Pemerintah Republik India tentang Perpanjangan Garis Batas Landas Kontinen Tahun 1974

Antara Kedua Negara di Laut Andaman dan Samudera Hindia,

-yang ditandatangani di New Delhi pada tanggal 14 Januari 1977, dan koordinat titik 0 tersebut adalah 07° 46' 06" Lintang Utara 95° 31' 12" Bujur Timur.

3. Garis batas dasar laut antara India dan Thailand adalah

garis lurus yang ditarik dari titik pertemuan tiga garis

batas menuju ke arah Timur Laut ke titik nomor 1 yang

di-sebut dalam Pasal ! Persetujuan antara Pemerintah Republik

India dan Pemerintah Kerajaan Thailand tentang Penetapan Garis Batas Dasar Laut antara kedua Negara di Laut Andaman yang ditandatangani di New Delhi pada tanggal 22 Juni 1978, dan koordinat titik nomor 1 itu adalah 07° 48' 00" Lintang Utara 95° 32' 48" Bujur Timur.

4. Garis batas dasar laut antara Indonesia dan Thailand adalah

garis lurus yang ditarik dari titik pertemuan tiga garis batas menuju kearah Tenggara sampai ke titik nomor L seperti yang disebut dalam Pasal I Persetujuan Antara Pemerintah Republik Indonesia dan Pemerintah Kerajaan Thailand Tentang Penetapan Garis Batas Dasar Laut Antara Kedua Negara di Laut Andaman, yang ditandatangani di Jakarta pada tanggal 11 Desember 1975, dan koordinat titik L itu adalah 07° 46' .1 Lintang Utara 95° 33' .1 Bujur Timur.

5. Koordinat titik-titik yang dimaksud di atas adalah koordinat

geografis yang diperoleh dari British Admiralty Chart No. 830, yang diterbitkan tanggal 3 Januari 1975 dan garis-garis lurus yang menghubungkan titik-titik itu ditunjukkan dalam peta yang dilampirkan sebagai Lampiran "A" pada Persetujuan ini.

6. Letak yang sebenarnya dari titik-titik tersebut di atas di

laut akan ditentukan dengan suatu cara yang disetujui ber-sama oleh pejabat-pejabat yang berwenang dari ketiga

Pemerintah yang bersangkutan.

7. Yang dimaksud dengan istilah "pejabat-pejabat yang berwenang"

-termasuk setiap orang yang dikuasakannya; untuk India, Chief Hydrographer pada Pemerintah India, termasuk setiap orang yang dikuasakannya; dan untuk Kerajaan Thailand, Director of the Hydrographic Department, Thailand, ter-masuk setiap orang yang dikuasakannya.

PASAL II

Pemerintah Republik Indonesia, Pemerintah Republik India dan Pemerintah Kerajaan Thailand mengakui dan menerima hak-hak berdaulat Pemerintah masing-masing atas dasar laut, termasuk tanah dibawahnya dalam batas-batas yang ditentukan dalam Per-setujuan ini.

PASAL III

Apabila suatu struktur tunggal atau lapangan minyak dan gas bumi atau kandungan mineral lain apapun sifatnya, melintasi garis batas yang dimaksud Pasal I, maka ketiga Pemerintah akan saling memberitahukan satu sama lainnya semua keterangan-keterangan tentang hal itu dan akan berusaha untuk mencapai persetujuan tentang cara yang paling efektif untuk mengusaha-kan eksploitasi struktur, lapangan atau mengusaha-kandungan itu dan keuntungan yang diperoleh dari eksploitasi itu akan dibagi secara adil.

PASAL IV

Setiap perselisihan antara ketiga Pemerintah yang timbul dari penafsiran atau pelaksanaan Persetujuan ini akan diselesaikan secara damai melalui musyawarah atau perundingan.

UNTUK MEMBUKTIKANNYA, yang bertandatangan di bawah ini, yang dikuasakan untuk maksud ini oleh Pemerintah masing-masing, telah menandatangani Persetujuan ini.

DIBUAT DALAM RANGKAP TIGA di New Delhi pada tanggal 22 Juni 1978, dalam bahasa Indonesia, Hindi, Thai dan Inggris. Dalam hal timbul perbedaan pengertian antara naskah-naskah tersebut, maka naskah dalam bahasa Inggris yang akan menentukan.

AGREEMENT BETWEEN THE GOVERNMENT

OF THE REPUBLIC OF INDONESIA, THE GOVERNMENT OF THE REPUBLIC OF INDIA AND THE GOVERNMENT OF THE KINGDOM OF THAILAND CONCERNING THE DETERMINATION OF THE TRIJUNCTION POINT AND

THE DELIMITATION OF THE RELATED BOUNDARIES OF THE THREE COUNTRIES IN THE ANDAMAN SEA

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA, THE GOVERNMENT OF THE REPUBLIC OF INDIA, AND THE GOVERNMENT OF THE KINGDOM OF THAILAND,

DESIRING to strengthen the existing historical bonds of friendship among the three c.ountries,

AND DESIRING to determine the trijunction point and to delimit the related boundaries of the three countries in the Andaman Sea,

HAVE AGREED AS FOLLOWS

ARTICLE I For the purposesof this Article

1. The trijunction point of Indonesia, India and Thailand in the Andaman Sea shall be a point whose co-ordinates are Latitude 07° 47' 00" North Longitude 95° 31' 48" East. 2. The boundary of the continental shelves of Indonesia and

India shall be formed by a straight line drawn from the trijunction point in the south-westerly direction to point number 0 mentioned in Article 1 of the Agreement Between the Government of the Republic of Indonesia and the

Government of the Republic of India on the Extension of the 1974 Continental Shelf Boundary Between the Two

The seabed boundary of India and Thailand shall be formed by a straight line drawn from the trijunction point in the north-easterly direction to point number 1 mentioned in Article 1 of the Agreement between the Government of the Republic of India and the Government of the Kingdom of Thailand on the Delimitation of Seabed Boundary between the two countries in the Andaman Sea signed in New Delhi on 22nd June 1978, the co-ordinates of which are Latitude 07° 48' 00" North Longitude 95° 32' 48" East.

4. The seabed boundary of Indonesia and Thailand shall be formed by a straight line drawn from the trijunction point in the south-easterly direction to point number L mentioned in Article I of the Agreement Between the

Government of the Republic of Indonesia and the Government of the Kingdom of Thailand Relating to the Delimitation of the Sea-Bed Boundary Between the Two Countries in the

Andaman Sea, signed at Jakarta on the 11th of December, 1975, the co-ordinates of which are Latitude 07° 46' .1 North Longitude 95° 33' .1 East.

5. The co-ordinates of the points Specified above are geographical co-ordinates derived from the British

Admiralty Chart No 830, published on 3rd January 1975 and the straight lines connecting them are indicated on the Chart attached as Annexure "A" to this Agreement.

6. The actual location of the above mentioned points at sea shall be determined by a method to be mutually agreed upon by the competent authorities of the three respective Governments concerned.

7. For the purposes of paragraph 6, "competent authorities" in relation to the Republic of Indonesia shall be the Chief of the Co-ordinating Body for National Survey and Mapping, Republic of Indonesia, and includes any person authorized by him; in relation to the Republic of India means the Chief Hydrographer to the Government of India, and includes any person authorized by him;

-and in relation to the Kingdom of Thail-and shall be Director of ｴｨｾ＠ Hydrographic Department, Thailand, and includes any peison auth6rized ｢ｾｨｩｭＮ＠

ARTICLE II

The Government of the Republic of Indonesia, the Govern-ment of the Republic of India and the GovernGovern-ment of the Kingdom of Thailand recognise and acknowledge the sovereign rights of the respective Governments over the seabed, including the

subsoil thereof, within the limits established by this Agreement.

ARTICLE III

If any single geological petroleum or natural gas structure or field, or other mineral deposit of whatever character, extends across the boundary lines referred to in Article I, the three Governments shall communicate to one another all information in this regard and shall seek to reach agreement as to the manner in which the structure, field or deposit will be most effectively exploited and the benefits arising from such exploitation will be equitably shared.

ARTICLE IV

Any dispute between the three Governments relating to the interpretation or implementation of this Agreement shall be settled peacefully by consultation or negotiation.

ARTICLE V

This Agreement shall be ratified in accordance with the oonstitutional requirements of each country. It shall enter into force on the date of the exchange of the Instruments of Ratification which will take place at Bangkok as soon as possible.

-DONE IN TRIPLICATE at New Delhi on 22nd June 1978, in the Indonesian, Hindi, Thai and English languages. In the event of any conflict between the texts, the English text shall prevail.
