WHEREAS, in compllance with the provisions of ^RA 9l 84, the Kalinga State University ^(KSU) posted in the

November 2, 201 7 the lnvitation to Bid (lB) for Procurement of Service Utility Vehicle ^(Ref. No. 264.004080300003) with an Approved Budget for the Contract ^(ABC) amounting to One Million, Five Hundred Thousand Philippine Pesos (Php 1,500,000.00) and posted the same at the KSU website

WHEREAS,

in

response

to the

said posting/advertisement,

no

bidders have browsed/read the opportunity ^at the Ph|IGEPS and KSU websites and BAC Bulletin Board;

WHEREAS, the Bids and Awards Committee and the Technical Working Group for Goods (TWG-Goods) conducted the Pre-bid Conference on November 3, 2017 whereupon no prospective bidders have attended and no Supplemental Bid was issued;

WHEREAS, during the Receipt of Bids on November 15,2017, no bidders have submitted their bids which resulted to the BAC'declaration offailed bidding based on Section 35.1(a)

WHEREAS, the BAC re published the lB, upon recommendation of the TWG-Goods, at the required sites for the ^period: November 10 23,2017;

WHEREAS,

in

response

to the said

posting/advertisement,

one (1) bidder:

FDG Consulting browsed/read the opportunity at

the

PhiIGEPS and KSU websites, whiie another bidder: Manindra Auto Corporation ^read the lB at the BAC Bulletin Board;

WHEREAS,

the

^BAC and ^TWG-Goods conducted

the

Pre-bid Conference

on

November 24,2017 whereupon no prospective bidders have attended and no Supplemental Bid was issued;

WHEREAS, during the Receipt and Opening of Bids on December 6, 2017, Manindra Auto Corporation availed the bid documents, submitted its bid envelope, was evaluated and declared ineligible due to patently insufficient on-golng and completed government and private contracts;

WHEREAS, the bidder's representative, after contacting his principal, waived his right to file a motion for reconsideration and the BAC returned the bid envelope;

NOW, THEREFORE, We the members of the ^Bids and Awards Committee, exercising prudence, good faith and transparency, hereby RESOLVE AS lT 15 HEREBY RESOLVED:

to declare another failure of bidding due to ineligibility of a prospective bidder pursuant to Section 35.1(b) of the ^IRR of ^RA 9184;

to

recommend

for

approval

by the

President

of

Kalinga

state

university

for a

^Negotiated

Procurement underTWO FAILED BIDDINGS

forthe

Procurement of Service Utility Vehicle; and

to

task the TWG and BAC Secretariat

for

review and evaluation,

if

necessary,

of

the Terms and Conditions

to

suit the applicable requirements for the use of alternative method

of

procurement modality pursuant to

Annex "H"
