DIRECTIONS DATED 18 MAY 2009
The Chief Justice has issued the following directions in this matter.
1. The application for leave to appeal against the whole of the judgment and order of the Supreme Court of Appeal handed down on 27 March 2009 is set down for hearing in this Court on Thursday 20 August 2009 at 10h00.
2. The record, properly paginated and indexed, shall be prepared by the applicants and lodged on or before Monday 8 June 2009.
3. The record shall consist, without duplication, only of those portions of the record before the High Court, the Supreme Court of Appeal and the papers filed in this Court that are necessary for the determination of the appeal.
4. Written argument must be lodged by:
a. the applicants on or before Thursday 18 June 2009; and b. the respondents on or before Thursday 2 July 2009.
5. Written argument must also deal with the merits of the appeal to enable this Court to consider them if leave to appeal were to be granted.
6. Further directions may be issued in due course.
