Your correspondence with the Registrar of the Constitutional Court relating to the above matter was forwarded to the Board for attention and reply.

On 11 May 1998 you were advised per the Board's letter of that date that legal aid has been granted for the litigation in the High Court and that you should refer your client to the Legal Aid Officer at the nearest Legal Aid Office or Magistrate's court to complete the prescribed application form. You were also advised that the Legal Aid Officer had to ascertain whether or not your client qualifies for legal aid in terms of the Board's means test and that you should not proceed with the matter without a formal legal aid instruction having been issued. Although you undertook in your letter of 31 July 1998^r to submit a duly completed legal aid form to the Board no such form has been received at this office nor, to our knowledge, by a Legal Aid Officer at a branch office of the Board or Magistrate's Office. This is, as far as I am concerned, the main reason why a formal legal aid instruction has not been issued to you.

Be that as it may, to expedite matters I have instructed the Legal Aid Officer, Burgersdorp to issue the following instruction to your firm:

"To represent the applicant as from 4 May 1998, in litigation relating to section 35(1) of the Compensation for Occupation Injuries and Diseases Act in the High Court, Grahamstown and any proceedings pursuant thereto in the Constitutional Court.

An attorney and junior counsel may be appointed to act on behalf of the

applicant in both courts.

The practitoners will be remunerated in accordance with the prescripts contained in the Legal Aid Guide. The High Court tariff is to be used by the attorney when he drafts his bill of costs. "

This instruction will be issued on condition that your client's calculated income does not exceed R4 000 per month. To enable the Board to ascertain whether or not your client's calculated monthly income exceeds this amount, she will have to furnish full particulars of her monthly income to the Legal Aid Officer, Burgersdorp. Kindly request your client to pay a visit to the office of that official at her very earliest convenience.

I place on record that the amount of R4 000 is not the usual income limit prescribed by the Board's means test, but a limit decided on in the excercise of the discretion which the Director has in terms of paragraph 2.6 of the Legal Aid Guide.

In conclusion I point out that this instruction is only valid up until the date on which the Constitutional Court delivers its judgment in the matter. Further assistance by the Board will be considered if a request therfore, together with a full merit report as envisaged in paragraph 3.5.2 of the Legal Aid Guide, is submitted.
