NOTICE OF MOTION

BE PLEASED TO TAKE NOTICE THAT the Applicant intends to make an application to the above honourable Court on the date to be determined by the Registrar of the honourable Court for an order in the following terms:

1. The Applicant is granted leave to appeal to this Court against the whole judgment and orders handed down in the High Court (Limpopo Local Division, Thohoyandou) on the 02^th August 2017, application for leave to appeal which was dismissed by the High Court on the 20^th September 2017 and application for leave to appeal was dismissed by the Supreme Court of Appeal on the 22^nd November 2017;

2. Granting the Applicant further or alternative relief.

TAKE NOTICE FURTHER THAT if you intend opposing the application, you are required to:

(a) Notify the Applicant’s attorneys in writing on or before 10(ten) days from receipt of this application.

(b) Within 15 (fifteen) days after you have given notice of your intention to oppose the application, file your answering affidavit, if any, and further that you are required to appoint in such notification an address at which you will accept notices and service of all documents in these proceedings.

KINDLY TAKE NOTICE THAT the accompanying affidavit of NDISHAVHELAFHI THOMAS NEKOKWANE and annexures are attached in support of this application.
