That the Tasman District Council agrees to receive the Late Item - Tasman Regional Transport Committee - Appointment of Chair and Deputy Chair, Report RCN13-12-24.

The reason why the item was not on the agenda was because the matter came to staff’s attention after the publication of the agenda.

The reason why the discussion of the item cannot be delayed until a subsequent meeting is because the Tasman Regional Transport Committee requires this item resolved to proceed with its first scheduled meeting on 14 February 2014.

6 REPORTS

6. 1. R es ult fr om t he D eliberati ons on Submis sions t o the Bright wat er/Volleyball Lease at Bright water Domain

6.1 Result from the Deliberations on Submissions to the Brightwater/Volleyball Lease at Brightwater Domain, Report RCN13-12-21

A Subcommittee, consisting of Councillors Edgar, Bouillir and Bryant, met on 6 December 2013 to deliberate on submissions received to the Brightwater/Volleyball Lease at Brightwater Domain.

At that meeting, recommendations were made to the Community Development Committee. As the Committee is not meeting until 13 February 2014, it was deemed necessary to bring the recommendations to this Full Council meeting, in order to finalise the lease for those involved.

This was at the request of the Community Development Committee Chair.

Moved Cr Norriss/Cr Bryant CN13-12-28

That the Full Council:

1) receives the Result from the Deliberations on Submissions to the Brightwater/Volleyball Lease at Brightwater Domain, Report RCN13-12-21; and

2) grants a lease of 5 years to the Wanderers Sports Club and the Tasman Volleyball Association over part of the Brightwater Recreation Reserve for the purposes of operating a Gymnasium and undertaking Volleyball administration; and

3) agrees that the lease in 2 above includes the following conditions:

a. Gymnasium to operate from 7.00 am – 9.00 pm 7 days a week.

b. Amplified music level to be minimal and no amplified music before 10.00 am or after 7.00 pm.

c. Groups and teams will park at Lord Rutherford car park and walk across the Reserve to the access the gymnasium, to keep traffic to a minimum.

d. Speed limit restrictions of 20kph for gymnasium members if they park next to the leased area.

e. Gymnasium membership to be restricted to Wanderers Sports Club members only.

f. No liquor is to be consumed in the grounds or premises by Club members.

g. Restrictions on the number of users of the gymnasium, at any given point in time, is to be included in membership terms.

h. The Wanderers Sports Club is to nominate a contact person for local residents and Council staff to liaise with.

i. The Wanderers Sports Club to erect signage, at their own cost, to advise members to keep noise to a minimum and to respect the rights of neighbours, with the wording to be approved by Council’s Property Services Manager.

5) agrees that any lease incorporates an annual review of the conditions and terms of the lease agreement and for membership terms and conditions for use of the gymnasium to be approved by the Chair of the Community Development Committee, Community Development Manager and Property Services Manager; and 6) agrees that the Engineering department places a 20kph speed restriction on

Charlotte Lane, Brightwater, through the next review of the Speed Limits Bylaw.

LATE ITEM

6.2 Tasman Regional Transport Committee - Appointment of Chair and Deputy Chair, Report RCN13-12-24

At its meeting on 31 October 2013, the Council resolved to appoint Cr Trevor Norriss as Chair and Cr Barry Dowler, Deputy Chair of the Tasman Regional Transport Committee.

At the subsequent Council meeting on 5 December 2013 the Council amended the minutes of the 31 October 2013 meeting on the basis that the Tasman Regional Transport Committee made the Chair and Deputy Chair appointments. The advice to revoke these appointments was incorrect.

The Land Transport Management Act 2003 was amended in October 2013. This Act requires that

“Each regional council must appoint from its representatives the chair and deputy chair of the committee”.

That the Full Council:

1) receives the Tasman Regional Transport Committee - Appointment of Chair and Deputy Chair report RCN13-12-24; and

2) appoints Cr Trevor Norriss as Chair and Cr Barry Dowler as Deputy Chair of the Tasman Regional Transport Committee.
