ITEM 2 DA 247/2020/LD/B - SECTION 4.55 (2) MODIFICATION TO AN APPROVED TWO STOREY DWELLING AND RETAINING WALL – LOT 3 DP 286704 – NO. 14 BERNABEAU STREET, NORTH KELLYVILLE
PUBLIC NOTIFICATION OF THE DETERMINATION PURSUANT TO ITEM 20(2)(c) AND (d) OF SCHEDULE 1 OF THE ENVIRONMENTAL PLANNING & ASSESSMENT ACT, 1979
DECISION
The Modification Application be deferred to relocate the dwelling and increase the setbacks to the south-western elevation (front) by a minimum of 1 metre to each building element as follows;
 Proposed 5 metre setback to guest bedroom to increase to 6 metres.
 Proposed 3.560 metre setback to porch columns to increase to 4.560 metres.
 Proposed 6.230 metre setback to garage door to increase to 7.230 metres.
 Proposed 6.0 metre setback to garage wall to increase to 7.0 metres.
REASONS FOR THE DECISION
 Having regard to the context of surrounding lots, built form and location of private open space, it is considered the proposed setbacks unreasonably impact on the amenity of adjoining residents.
HOW COMMUNITY VIEWS WERE TAKEN INTO ACCOUNT IN MAKING THE DECISION Notification letters were issued to adjoining properties on three occasions over 14 days.13
submissions were received from two property owners. The issues raised in the submissions were addressed in the report. Further submission by adjoining owners after the preparation of the report were also considered.
