The Minutes of the Development Assessment Unit Meeting of Council held on 14 January 2020 be confirmed.
ITEM-2 DA 443/2020/LA - BOUNDARY FENCING - LOT C DP 354363, NO. 48 GREEN ROAD KELLYVILLE
PUBLIC NOTIFICATION OF THE DETERMINATION PURSUANT TO ITEM 20(2)(c) AND (d) OF SCHEDULE 1 OF THE ENVIRONMENTAL PLANNING & ASSESSMENT ACT, 1979
DECISION:
The Development Application be approved subject to the following conditions of consent outlined in the report with the exception of Conditions 2 and 3 which will be amended to read as follows:
PAGE 2 2. Street Tree Planting
Street trees/ screen planting is required along Green Road in the existing road verge fronting the fence. The street tree species are to be Melaleuca bracteata (minimum 45 litre pot size) planted at 2m centres set 1m from the fence.
All planting works are to be at the cost of the applicant/owner. The applicant is required to contact Council’s Infrastructure & Works team prior to undertaking the planting works to ensure the location of the required landscaping works will not impact on sight distances. The required landscaping shall be completed within three months of the endorsed date of this consent.
3. Activation of DA 1531/2018/ZA – Removal of Access to Green Road
Following issue of an operational consent in respect to DA 1531/2018/ZA for a subdivision creating two residential lots including demolition, vehicle access to Green Road shall be removed prior to issue of the Subdivision Certificate. The vehicle access gates along the Green Road boundary shall be removed and replaced with infill 1.8 metre high lapped and capped timber fencing. All disused laybacks and driveways along Green Road must be removed and replaced with kerb and gutter together with the restoration and turfing of the adjoining footpath verge area. In addition, infill planting of Melaleuca bracteata shall be undertaken within the length of the fencing where the gates have been removed.

The development application was notified and two (2) submissions were received. The issues raised were discussed in the report. Two further late submissions (from the same objectors) were tabled and discussed at the meeting.
NB: The Chair declared a non-pecuniary, non-significant interest in this item and left the meeting. The meeting was chaired by Paul Osborne for this item.
